The Cornell 7: Inside the Chi Phi Frat House Case

A 20-year-old Cornell student says she walked into a Chi Phi party on the night of October 19, 2024, and did not walk out the same. In a lawsuit filed nearly two years later, the woman identified only as Jane Doe alleges she was plied with alcohol and ketamine inside the fraternity house and sexually assaulted by seven members of the chapter while she was unable to consent.
She reported the night to Cornell police weeks afterward. Tompkins County prosecutors reviewed her statement and closed the case without charges. That decision held until September 16, 2026, when Jane Doe sued Cornell, Chi Phi, her own sorority, and the seven men, accusing the university and law enforcement of failing her.

19 Hey everyone, welcome back to Exposed. I am Jim Chapman, and today I am going to break down a current case that is really all over the news in the internet right now, cover everything we know about it, and what can be expected going forward. And I am speaking about the alleged rape case involving a student at Cornell University and the involvement of a campus fraternity on that particular case. So, This case, y'all, centers around Jane Doe, who on September 16th, just a few weeks ago, filed a lawsuit in New York regarding this case in which the allegations were alleged to have occurred in October of 2024 involving a popular fraternity at Cornell, and a lot has come out in this case, so let's get into it.

16 And I think the best way to start this one out is to first cover the allegations in the lawsuit that dropped just a couple of weeks ago. I do have that lawsuit in front of me, and as y'all know, I am going to cover it verbatim and give you all the details, not just partial details. So let's read it. That lawsuit says, in August of 2022, plaintiff, who in this case is a Jane Doe, was 18 years old when she flew across the country from her family home to begin her studies at Cornell University, which incidentally, y'all, that is an Ivy League college. That's no different, or some people might say it's different if they went to Harvard or if they went to Yale, but it's considered Ivy League. based in New York. The lawsuit goes on to read, with similar hopes, expectations, and trepidations of other high school graduates embarking on something so seemingly monumental. She arrived on campus where the university actively promoted Greek membership as a vital part of the campus community. and endorsed these organizations as well. Managed, worthy pathways to new friendships and improving one's educational and professional opportunities. Large fraternity and sorority houses were in prominent locations on campus. Before and when plaintiffs set foot on campus, she never knew that the university had been the scene of numerous incidents of

49 sexual assault and rape in the months and years prior to her arrival. Students were afraid, protesting, and demanding reforms. And again, this is alleged in this lawsuit from the Jane Doe. Now, by the time the university had established campus organizations to address those prevailing issues, such as the SHARE, and that stands for Sexual Harassment and Assault Response and Education Office, implementing anti-sexual violence training in the university's Greek houses, advising incoming students about the risk of sexual assault and harassment in college, and offering services to victims slash survivors.

31 These reforms took place after Resolution 34 was passed on March 19, 2021, requesting that Cornell University review policies and actions over fraternity systems, including reform, disband, or abolish, and have the Office of Sorority and Fraternity Life to perform a yearly review of all fraternities, and any fraternity accused of sexual harassment will be placed on probation or have its recognition revoked. Even still, in the following fall 2022 semester, Cornell University saw at least five reported cases of drugging and two reported cases of sexual assault on Cornell's campus, all of which occurred at fraternity addresses. This triggered a response from the Cornell University Student Assembly, who presented Resolution 16 condemning Greek life on December 1st of 2022. Plaintiff also never knew that the dangers of fraternities were so widespread in the decade before her arrival, as they had been ranked as the sixth worst risk for insurance companies, just behind hazardous waste disposal companies and asbestos. contractors. So dangerous were their activities that they had their commercial insurance carriers decline insuring them any further. And that was kind of an eyebrow raiser for me. National fraternities and sororities and their executives knew that fraternity chapters and members were

04 incapable of responsibly managing the provision, use and misuse of alcohol and drugs in fraternity houses during recruiting and at Greek-sponsored events. One fraternity executive, an industry leader, confirmed that 99% of insurance claims were related to the misuse of alcohol. Fraternity recruiting events with alcohol would eventually be labeled by another fraternity executive and industry leader as being, quote, the deadliest nights. Further, plaintiff was also unaware that the president of Psy Inc. Upsilon at Cornell University, Wolfgang Ballinger was charged with first-degree attempted rape, first-degree criminal sex act with a helpless victim and sexual misconduct after raping a female student at his fraternity residence in 2016. Furthermore, in 2022, Cornell's campus police issued alerts that a female student was sexually assaulted and at least four other students were drugged at off-campus fraternity parties. During this period, a loose coalition of student activists began a movement known as the Ban Greek Life or Abolish Greek Life movement, which gained significant momentum in 2020 and continues to present. However, despite the abolished Greek life movement and all the bad press that fraternities and sororities have been receiving in the media since the early 2000s, Upon her arrival at Cornell, plaintiff immediately encountered a glorified yet materially false and misleading facade of

36 Cornell University Greek life. Alpha Beta Chapter, a regional member of Tri-Delta National's national sorority established at Cornell in 1913, operated and recruited new members and revenue through its Alpha Beta Chapter, which was housed in an all-brick mansion situated in a prominent location on campus. The university provided its facilities, staff, and resources to schedule and organize Rush, which encouraged students to join these organizations after reviewing and relying upon the promotional information it and the Greek organizations provided. Plaintiff followed that pathway, applied for, and accepted a bid to pledge Tri-Delta Nationals Alpha Beta Chapter. Alpha Beta Chapter quickly became her first choice after Rush began. She was drawn to the sorority and its promises of sisterhood and lifelong friendships.

29 The status it conferred on its members and the community it provided on campus when she was over a thousand miles away from home. By this date, Tri-Delta National's leadership had banned the presence and use of alcohol and drugs on its chapter houses. This is presumed based upon its knowledge that its mismanagement had resulted in numerous incidents of rapes and other injuries. And then it goes into the allegations specifically with this case. Plaintiff Jane Doe repeats and re-alleges the above allegations that the occurrence complained of herein took place within the Chi Pi Nationals fraternity house located upon Cornell's campus. And it gives the address. And it says, on the evening of October 19th, 2024, into the morning of October 20th of 2024, Plaintiff Doe was the victim of one or more criminal sex acts at the hands of defendants Ingalls, Noll, Lee, Lopez, Sarabia, Norris, and Kretzmeyer.

32 Plaintiff Doe was in a vulnerable position when she was sexually assaulted by the defendants. On October 19th of 2024, Tri-Delta National's Alpha Beta Chapter was hosting a social event at Mooney's Bar and Nightclub. On October 19th, 2024, prior to the event at Mooney's, plaintiffs consumed Tito's Vodka within Tri-Delta National's Alpha Beta Chapter sorority house until she was intoxicated. Thereafter, at 8.30 p.m., plaintiff took an Uber from Alpha Beta Chapter sorority house on Cornell's campus to Mooney's Bar and Nightclub accompanied by the chapter's house mother, Jade. When plaintiff arrived at Mooney's around 9 p.m., the bouncer placed an X on each of her hands to signify she was under 21 years old. Despite having underage marks on her hands, plaintiff was served and consumed at least one alcoholic beverage at Mooney's. Within Mooney's, Tri-Delta National's Alpha Beta Chapter had designated sober monitors tasked with ensuring the safety and well-being of attendees and monitoring their fellow sorority sisters for signs of excessive intoxication and or disruptive behavior. Around 10 p.m., plaintiff and other sorority sisters left the event at Mooney's and walked to another nearby bar known as Lot 10 Bar and Lounge. At Lot 10, plaintiff was given an under 21 wristband. Around 11 p.m., plaintiff decided to leave Lot 10 and stumbled alone to the Kai Pai National

05 Chapter Fraternity House on Cornell's campus. to hang out with her friend, defendant Ingalls. When Plaintiff arrived at the fraternity house, Plaintiff was visibly intoxicated as she has consumed more than 10 standard drinks within the past three hours. Yeah, I'd say she was really intoxicated. Plaintiff was let into the fraternity house by three or four members of the fraternity who had been standing by the front door. Therein, plaintiff saw defendant Ingalls, who greeted plaintiff and gave her a beer. Plaintiff and defendant Ingalls then danced together in the main room of the fraternity house. After dancing, defendant Ingalls pulled plaintiff off to a quieter area and propositioned her to have a threesome with her and another one of his fraternity brothers. In her drunken state, plaintiff was incapable of consenting to this proposition. Despite being incapable of consent, defendant Ingalls then led plaintiff to the upstairs of the fraternity house and left her with Alex Vega, another chapter member.

07 After speaking with Alex for some time, defendant Ingalls returned and led plaintiff to another room down the hall where defendant Newell was sitting on the couch. While on the couch, defendant Ingalls and Newell began passing around a plastic bag containing a white, powdery substance claimed to be ketamine, then pressured plaintiff into snorting the alleged ketamine with them, a drug she had never done before. During this time, Ingalls and Newell also plied plaintiff with marijuana and Jamaican liquor, believed to be some type of high-proof rum. Soon after, defendant Ingalls and Newell began engaging in sex acts with the plaintiff, all without her consent. During the assault, defendant Ingalls forced oral sex on plaintiff while defendant Newell forced vaginal intercourse on her from behind. During the assault, defendant Newell slapped plaintiff on the buttocks multiple times, resulting in bruising.

02 At one point, defendant Ingalls could no longer maintain an erection, so he stopped participating and told the other two he was going to take a nap and proceeded to get up, move to a bed, and go to sleep. Defendant Newell then began reaching for her vagina with his hand multiple times, and each time, the plaintiff pushed his hands away. Soon after, Defendant Lopez entered the room, grabbed plaintiff away from Defendant Newell, and began kissing her while Defendant Newell grabbed her from behind, specifically reaching for her vagina. Defendant Lopez and Newell then placed the plaintiff on the bed while the two men began having sex with the plaintiff, initiating another assault, all without the plaintiff's consent. At approximately 1.42 a.m., defendant Newell sent a message, get this, to the chapter member's Snapchat group in which active fraternity members are present, claiming there was, quote, free pussy upstairs, referring to the plaintiff they're at. Goes on to say, in doing so, defendant Newell organized and encouraged other chapter members to join in the gang rape of plaintiff in the chapter fraternity house. At this point, multiple other members of the chapter entered the room and plaintiff retreated under the covers of a bed to hide her naked body from the fraternity men. Soon after, defendant Sarabia approached plaintiff, grabbed her face, and started kissing her all without her consent and plaintiff pushed him away. At that point, plaintiff's phone was on the other side of

33 the room and she felt as if there were no way for her to escape this room full of predatory fraternity men. Defendant Newell then poured a line of ketamine onto his erect penis and commanded plaintiff to snort it off, which she did. Defendant Newell then got into bed with the plaintiff and began groping her and reaching for her vagina again. While Plaintiff was lying on her back in the bed, defendant Ingalls, Newell, Lee, Lopez, Sarabia, Norris, and Crutchmire began pouring lines of ketamine all over her body and snorting them. Eventually, defendants, and it names them again, decided to exit the room and plaintiff was removed by defendant Ingalls and Lee to a smaller room believed to be the fraternity president's office. Once inside, defendant Ingalls and Lee made more lines of ketamine and instructed the plaintiff to snort one, which she did. By this point, plaintiff was completely incapacitated. Thereafter, defendant Ingalls and Lee initiated another assault on the plaintiff, forcing oral and vaginal sex upon her simultaneously. At around 5.45 a.m., this assault concluded and plaintiff lost consciousness. When plaintiff awoke later that day, on October 20, 2024, plaintiff returned to her residence within the Alpha Beta Chapter sorority house. At this point, Plaintiff was in a state of shock. At her residence, Plaintiff noticed a large bruise that had formed on her buttocks and

05 took preemptive medication for a urinary tract infection. Later that day, Plaintiff became aware that what had happened to her at the chapter house that previous night was becoming public knowledge on Cornell's campus. With the encouragement of her friends, on or about November 8, 2024, Plaintiff reported the incident to Cornell's private police force. known as Cornell University Police Department. On or about November 8th, 2024, the chapter was placed on temporary suspension for alleged violations of the Student Code of Conduct. On or about November 8th of 2024, temporary suspensions were also issued for several students, including Ingalls, Newell, Lee, Lopez, Sarabia, Norris, and Crutchmer, who were all afforded the opportunity to mitigate their conduct by submitting essays to Cornell. On November 26, 2024, Cornell released a university statement entitled Update on Disturbing Allegations of Sexual Violence, providing an update on its ongoing investigation into the, quote, serious and deeply disturbing allegations of drug abuse and sexual violence at the Kai Pai Fraternity House, as further described on this complaint. On or about January 14, 2025, Cornell commenced a Title IX investigation into a response, to the plaintiff's formal complaint filed with Title IX coordinator. From May 2nd through May 29th, the Title IX office conducted numerous,

36 at least 12 hearings regarding plaintiff's allegations herein. On November 4th of 2025, Cornell released a university statement entitled 2025 Cornell Survey of Sexual Assault and Related Misconduct Results, noting an increased prevalence of sexual misconduct upon its campus, among other troubling results. Upon information and belief, Cornell's Title IX investigation is concluded. The matter is still being investigated by the police department. And then it kind of goes into... some stuff that really isn't related to what occurred. But how horrific is all of that? Now, there's a lot to unpack there. And first and foremost, I want to explain to you what Title IX is. This law, it was enacted, y'all, as part of an educational amendments package to the Constitution way back in 1972. And specifically, as it relates to sexual assault allegations like this, It requires the school to investigate allegations like this promptly and swiftly, whether it's sexual assault, domestic violence, stalking, a lot of those things get reported on campus, right? Now, I would say the reason that this even happens became a thing.

53 Title IX was prior to this. Even up to today, really, universities, they tend to protect themselves. And they tend to kind of sweep shit like this under the rug. Because think about it for a second. Would you want your daughter to attend a college where fraternities were doing stuff like what I just read you? Of course not. And universities, they know this. So Title IX is supposed to protect against that. So I gave you a lot there with that lawsuit that was filed. And again, I want to say this. These are allegations. None of these people have been convicted in a court of law of anything. These are allegations. It's important to note that. But concerning allegations, nonetheless.

41 And I gave you a lot with that lawsuit. Now, with regard to the time that has passed since these sexual allegations occurred, it kind of makes it hard to follow. So I want to break down the actual timeline because I think that'll help you follow what's going on here later. a little bit easier. In August of 2022, the Jane Doe, she starts her freshman year at Cornell. She joins a sorority, Tri-Delta. On October 19th and 20th of 2024, a couple years later, she drinks vodka at a residence at her sorority. And then she goes to that Mooney's Bar and Nightclub. And around 11 a.m., she walks to the fraternity house. She's intoxicated.

25 She's already drank about 10 standard drinks and everything I told you about happening there. happened, allegedly. Now, on October 21st of 2024, Jane Doe exchanged text messages with one of the men, later named in the lawsuit, who told her, quote, I just want to apologize for how things went down the other night. And she replied, quote, at the end of the day, none of the sexual stuff was illegal. And honestly, I really liked being with you and Matt. Now that's according to the New York Times. On October 22nd of 2024, Jane Doe makes an appointment at Cornell Health for a urinary tract infection and one to be tested for STDs, telling the doctor she contracted it in a traumatic way, per the New York Times. The doctor doesn't follow up and suggest, quote, she should go to therapy.

19 Can't believe that occurred. On October 23rd, in another text exchange, Jane Doe tells one of the fraternity members that, quote, my reputation is destroyed and I'm utterly ashamed, according to ABC News. In the same exchange, she also said, quote, everyone needs to grow up because sexuality and sex is changing and stuff like this. is going to become more common. I'm also really open-minded, though. I love you, King. On October 30th, Jane Doe sends a text message to the same fraternity member saying she was, quote, uninvited to an upcoming Chi Pi Halloween party, saying, quote, I knew this was going to happen. The women will always get the short end of the stick. Y'all aren't my friends. Y'all are covering your ass. Then on November 8th of 2024, that's when she reported the incident to campus police. So it was about three weeks later. On November 14th, 2024, Jane Doe gives an interview to campus police in which she states, I can say with 100% confidence I was raped.

24 On November 15th of 2024, Jane Doe gives a sworn statement to campus police in which she says that the incident felt like coercion. She recalled that at one point she said no to the foursome that one of the Fratt brothers had proposed. She also states, I remember being totally disgusted at this situation and I felt very tired and intoxicated. I would say my level of overall intoxication was about an 8 out of a 10. I would also say that it was the most intoxicated I've ever been in my life. I felt like I was unable to make any decision because of how drunk I was. On November 26th of 2024, Cornell president publishes an open letter to students with an update on the ongoing allegations.

11 I told you about that. On January 14th of 2025, Cornell finished its Title IX investigation. in response to Jane Doe's allegations. And Jane Doe tells the school investigators that she, quote, felt like bait on the night of the alleged assault. Quote, I felt like lions around me, she said during one of these hearings. So that's a timeline of what occurred with a little more information. And nothing else happens until this lawsuit drops just a few weeks ago. And within a week, this thing blows up and Cornell says, They release a statement of their own, and that statement reads, Cornell University is aware of a lawsuit concerning the deeply disturbing allegations of sexual assault involving members of the student community that occurred in 2024. The Cornell Office of Civil Rights and the Office of Student Conduct and Community Standards investigated and adjudicated the allegations consistent with university policy. The chapter of the Chi Pi... Fraternity remains barred from our campus.

16 Federal law prohibits Cornell from disclosing specific information regarding individual students, and we therefore are unable to make a public statement on any other disciplinary response. Violations of university policy can lead to sanctions up to including suspension and expulsion. We will respond in detail through the legal process. We take sexual violence seriously. The Presidential Task Force on Campus Sexual Assault was launched shortly after this incident and issued a report in March of 2026. Several of the recommendations have already been implemented, while others are in development with oversight by a university committee. So that was their statement. It's simple, short, to the point, but I think it also reflects the danger Cornell is seeing in the windshield if they don't get in front of this thing quickly. And while the statement they issued was short and sweet... The DA, just a few days later, his name is Matt Hewton, he releases a much more detailed statement saying this. On September 18th, 2026, I learned of a civil complaint filed in New York County alleging a series of heinous and despicable acts committed by members of the Chi Pi fraternity at Cornell University.

31 against a fellow Cornell student on October 19th, 2024. The lawsuit, which has been published and widely discussed online, set forth allegations of multiple sexual assaults committed by male fraternity members against a woman who is referred to as Jane Doe. Given the lawsuit's graphic allegations of criminal conduct, the question of why those individuals were not criminally prosecuted has been raised. That's a great freaking question. Over the past two weeks, many people have called my office, left voicemails, sent emails about this case. Some people have understandably sought answers. Others have simply insinuated and sometimes threatened my office and my staff. In each case, the comments and questions have been based solely on the allegations in the civil lawsuit and its characterization by news and social media sources. While I generally refrain from commenting publicly on criminal investigations, the community outrage stemming from the incomplete news and social media coverage requires that I provide an answer to why this investigation resulted in a lack of criminal charges. But before I discuss the specific facts and reasons that went into this decision, I want to provide the answer in the most basic and understandable form. Jane Doe's sworn statement in November of 2024 did not allege that she was drugged against her will or gang raped. On the contrary, Jane Doe's statement described her participation in drug use and sexual conduct as voluntary, conscious,

01 and consensual. My office obviously did not and could not have based our November 2024 decision on allegations in a civil lawsuit that would not be filed until nearly two years later. Furthermore, I have never been contacted by Jane Doe's attorneys not to inform me of the original statement being inaccurate and not to ask me to reconsider our decision. Rather, I reached out to Jane Doe's attorneys after the lawsuit was filed and to understand the discrepancy between the original statement and the lawsuit allegations and the proper path forward in light of the lawsuit allegations. And that is kind of a bombshell, isn't it? The primary obligation of the DA's office is to prosecute state criminal offenses by reviewing police evidence, presenting cases to the grand jury, and litigating cases in court. While the DA's office is often called upon to provide investigation support to police agencies, we do not conduct independent investigation of cases alongside police investigations. The police investigate crimes. The DA prosecutes crimes. In November of 2024, the Cornell Police Department informed the DA's office of their investigation in this case and asked us to review a statement provided by Jane Doe to determine if her allegations constituted a crime under New York law. Law enforcement agencies commonly consult with us on questions of evidence, matters of law, and potential charges, if any. This is not unusual. It is common practice for law enforcement agencies to consult with

33 the DA's office. In this case, Jane Doe provided a six-page, single-spaced, typewritten statement to the Cornell University Police Department. Jane Doe made more than 20 handwritten notations to this six-page document. The signature page of the statement contains the following language, quote, I've read this statement consisting of six pages and the facts are true and correct. As I explained further below, the statement, especially as it relates to the legal definition of lack of consent, provides a different narrative and set of facts than the events of October 2024 than those alleged in the lawsuit. But first... Let me explain more about the review process. In cases where a voluntary sworn statement is provided, the first step of a review is to determine whether the facts alleged in the statement constitute a crime or crimes. For purposes of this stage of review, the allegations are assumed to be true. If the allegations do not set forth elements of criminal conduct under New York state law, even if we assume them to be true, we obviously cannot advise the police that criminal charges are appropriate. Furthermore, we obviously do not advise the police to change the facts or get a witness to change his or her statement so that someone can be charged with a crime.

51 It goes without saying that doing so would be blatantly improper and unethical. In this case, multiple prosecutors and criminal investigators reviewed Jane Doe's statement and correctly determined the alleged facts as set forth do not constitute a crime. This decision was not because the case would have been difficult to prove in court. It was because the facts as set forth in the statement prevent the filing of criminal charges. To be clear, the credibility of the woman who described the facts in excruciating detail was never in question. Following our review, we confirmed with the police that criminal charges were not appropriate based on Jane Doe's statement, as is my longstanding policy in such cases like this. We also asked the police department to inform Jane Doe at her option that we will personally meet with her to explain our decision and and answer any of her questions. If such a request is made, the investigator facilitates a meeting with our office. The police thereafter explain the results of our review to Jane Doe. As I mentioned, in nearly two years since we were asked to review this case, neither Jane Doe nor her attorneys ever contacted the DA's office not to seek answers, not for reconsideration of her case and not to suggest her soaring statement was inaccurate. Rather, I reached out to Jane Doe's attorneys to understand and resolve the discrepancy. The above explanation addresses how we came to the decision that criminal charges in this case were

23 not applicable. It does not explain why. criminal charges are not applicable. For that reason, simply concluding my statement at this point would undoubtedly do little to clear up misconceptions of our decision. To address this problem, I have considered releasing a copy of Jane Doe's original statement. It very well may be the statement is publicly available through proper channels and ultimately will have to be released. I have considered this but decided against this at this stage for at least two reasons. First, my interest at this stage is to explain the decision in my office. This can be accomplished without exposing identifying information to the people involved. Second, a released copy of the statement would have to go through a privacy review and be heavily redacted. This would prevent me from releasing a timely statement and would ultimately result in the statement without context or clarity. For those reasons, I believe it's sufficient to provide the relevant facts that went into our decision, quoting directly from the statement where possible.

29 My office legal analysis of the facts will follow the factual summary. The following are facts from Jane Doe's statement that were relevant and determinative to the issues of sexual conduct and the legal definition of consent. To be clear, these are not conclusions made from our review of the statement. They are facts provided in Jane Doe's statement. Where words appear in quotes, they are exactly as they appear in the statement unless names or pronouns have been redacted or adjusted for clarity. And then he gets into her actual statement as told to him. On the evening of October 19th, 2024, Jane Doe walked the approximately one mile distance from Lot 10 to the Kai Pai fraternity to meet her male friend.

15 She had made plans to meet who they're referring to as male number one earlier in the week and had been texting male number one that she was on the way. Jane Doe described her level of intoxication as a five out of 10. when she arrived at the fraternity. While there, Jane Doe opened one previously unopened can of beer. She and male number one danced a little in a way that was definitely flirtatious in nature. Male number one brought Jane Doe to a quiet area and asked how Jane Doe would feel about having a threesome with two male partners. Jane Doe agreed due to how attracted she was to male number one, on top of her drunken curiousness. When she learned that male number two would be the third participant, Jane Doe remembered being excited because she thought that male number two and male number one wanting to have a threesome meant they were gay. And I can't explain that, y'all.

11 That's just what she said in her statement to the DA. She went on to say in her statement the three engaged in a threesome involving oral and vaginal sex in a room of the fraternity. At the start of the threesome, Jane Doe described her intoxication level as 5 or 6 out of 10 and that she was pretty okay. with having this threesome, quote unquote. The sexual conduct ended when Jane Doe noticed that male number one appeared really sleepy and was no longer fully erect. She told male number two they needed to stop having sex in order to make sure male number one was okay. Male number two then stopped having sex with Jane Doe. Male number one said, quote, he was going to take a nap and refresh himself and would eventually stumble his way from the couch to the bed. And while male number one slept, male number two began to dry heave as if he were going to vomit. Jane Doe, quote, began to take care of male number two by patting his back while also waking male number one every few minutes to make sure he was okay. Jane Doe was consoling male number two on the couch and telling him that it was okay if he needed to vomit. Male number two told Jane Doe he was pretty sure he wasn't going to vomit. Eventually, Jane Doe and male number two would start making out for a very short amount of time. While they were making out, male number two reached for the area near her vagina several times and And each time he did,

43 she would swat away his hand. Male number three then knocked on the door of the room. Jane Doe decided to let him in because it was his room. She, quote, opened the door and let male number three into the room. Male number three introduced himself to Jane Doe and reached out to shake her hand. When Jane Doe made contact with male number three's hand, male number three pulled Jane Doe into him and they began making out. While male number three was kissing her, male number two began groping her. Eventually, male number two, male number three, and Jane Doe would end up on the bed next to where male number one was sleeping. and they began having a threesome. Male number one would eventually wake up and said, quote, he wanted to take part and asked about making it a foursome, to which Jane Doe said, hell no. Jane Doe rejected this request because she knew that a foursome meant that she would have to take part in anal sex. Jane Doe remembered male number three then leaving the room. A group of other men, later determined to be male number four, five, six, and seven, then entered the room. Jane Doe hid under the covers of the bed. Male number two laid in the bed next to Jane Doe. Male number one sat on the corner of the bed. And male number one introduced the other males to Jane Doe. Jane Doe had difficulty remembering parts of what happened next. She remembered male number seven saying something very rude and mean to her.

12 Male number seven apologized, grabbed her face, and started kissing her. Jane Doe quickly backed away to stop male number seven. from kissing her. Male number two asked Jane Doe if she wanted to do more ketamine. At that, Jane Doe remembered that she had taken ketamine at some point on the couch with male number one and two during this night, but she could not remember where or when this took place. Jane Doe thought that she had already done ketamine once, so why not do it a second time? Quote, and this is her quote, at that point, male number two poured a line of ketamine on his erect penis and implying for her to snort the line, and Jane Doe snorted the line of ketamine, which was a heavy amount of ketamine. Jane Doe was under the covers of the bed at this point, and male number two got under the covers with her, where he again tried reaching for her vagina. The males complimented Jane and talked about how pretty she was. Male number four asked Jane Doe if they could all do drugs off her, quote, perfect body.

16 Jane Doe responded, sure. While the other men were doing drugs off her body, male number three and another male entered the room and said something like, quote, OK, we're shutting down whatever the fuck this is. Jane Doe felt dizzy due to preexisting medical condition causing dizziness combined with the effects of the ketamine use. Male five or six encouraged her to stay seated as long as she needed to. Eventually, male number one and male number four ushered Jane Doe out of the room, brought her upstairs to a small room. Male number one stated, let's do more ketamine. Jane Doe remembered snorting more ketamine and remembered feeling extremely high. Male number one said he wanted to have sex again because he wanted redemption for passing out earlier in the night.

01 Jane Doe initially stated she was tired and asked male number one, what happened to just you and me? Jane Doe could not remember how it started, but she then engaged in a threesome sex act with male number one and male number four involving oral sex and vaginal sex. She described her level of intoxication at this point as an eight out of 10. The threesome continued until at some point around 5.45 a.m., Jane Doe said she was tired and needed to turn in. At that point, both guys stopped the threesome with her, and that was as far as she could remember. The DA goes on to say, as I stated earlier, the facts are not conclusions made by our office. The facts were provided directly from Jane Doe's statement, and we assume them to be true for purposes of our legal analysis. So, y'all, that right there is a big fucking problem. Because what she told this district attorney, and I believe him that he's quoting from the actual statement she gave. What she told him and what her lawyers and her have now accused the university and these other people of is completely different than the initial allegations. That's just a fact. Not saying which is true and which is not true. But you've heard me say this on this show hundreds of thousands of times, it seems like. The truth never changes. In this case,

34 one of these two statements is not true. So this whole deal by this point had grown legs of its own, as you can imagine. It's everywhere on social media. And Cornell at this point, in my view, they have shifted to total damage control. On October 1st, they release a frequently asked questions guide regarding these sexual assault allegations. I want to review those quickly. The first one says, did Cornell investigate the allegations? Yes, the Office of Civil Rights and Office of Student Conduct and Community Standards investigated the allegations against the individuals in the fraternity consistent with policies and Title IX. The university Title IX investigation was conducted over several months and includes hearings where a panel of trained faculty and staff heard evidence over multiple days. The complainant and respondent have the opportunity to testify, present evidence in the investigation. At its conclusion, the hearing panel issued a range of sanctions, which included expulsions and suspensions from Cornell.

41 Cornell's process is distinct from the criminal justice system and applies university policies, not criminal law. This type of investigation and adjudication process is not unique to Cornell. Universities across the country maintain formal processes under Title IX to address allegations of sexual misconduct. This does not preclude or replace criminal justice functions. The next one, did the university take disciplinary action? Yes, temporary suspensions, and they kind of already answered that. The Chi Pi chapter was actually closed in 2024. remains barred from campus, et cetera. The next question, is it true that involved students only had to write essays as a disciplinary measure? Answer, no. Does Cornell believe its response was adequate? Of course they do. They didn't put yes.

35 They went into this big, long explanation, but of course they do. So I'm not going to read all of these because there's like 15 of them. There's no need to cover all of those. And I'm going to move on to one more bit of news today. And that is an article that was put out by NBC News after interviewing someone involved in this case. One of the seven fraternity brothers charged in this case. As a matter of fact, his name is Scott Kretschmar. And you've already heard me say his name several times. But this is also interesting news. And it reads, one of the seven Cornell University frat brothers named in a lawsuit alleging a gang rape in 2024 said he did not see the accuser in distress during his brief time in the room where she says she was sexually assaulted while she was under the influence of several substances. Scott Crutchmore, now 22, said that after he saw the fraternity Snapchat post advertising, quote, free pussy upstairs, he went up into the room already filled with several frat brothers, but that he never saw the woman naked, touched her, or used ketamine. Kretschmar's accounting of the evening was laid out in court documents that he filed anonymously in New York Supreme Court in March in a last-ditch effort to annul Cornell's decision to find him responsible for attempted sexual exploitation after its Title IX investigation.

04 In the failed petition... Kretschmar argued the school improperly found him responsible for an offense that was not on his original list of violations and then denied his appeal earlier this year. The court records, together with text messages separately obtained by NBC News between Jane Doe and another Chi Pi fraternity member she later accused of assault, provide further context for the October 2024 incident and its immediate aftermath. The incident has reignited a national conversation about sex assault and consent. My reputation is destroyed and I'm utterly ashamed. Jane Doe texted another fraternity member four days after she alleged she was raped while she was under the influence of ketamine, marijuana, and alcohol. I'm fucking pissed because so many people shouldn't know. And I feel like I know who some of the rats in the room were. If I ever find out, I swear to God, It's in sight.

01 During the day-long text exchange, Jane Doe fluctuated between anger over being the subject of campus gossip and sending friendly messages before she ultimately cut off communication the day before she reported her allegations to campus police. The report spurred a university investigation of seven Chi Pi members that culminated with a 12-day... Federal civil rights proceeding known as Title IX in May of 2025, 30 witnesses testified, 50 investigative interviews, and the investigation found that the night of the alleged assault, a photo of Jane Doe was shared among active Chi Pi members in a Snapchat group. The nature of the photo was not made clear in the court documents. Quote, are you guys at least naked? A Snapchat message from an unknown user said after the photo was leaked. The Snapchat message thread, which was provided to campus investigators anonymously, became a key exhibit in the resulting student conduct matter.

03 As for comment on Crutchmore's state litigation, Jane Doe's lawyer simply called it ridiculous. On Thursday, the lawyer also revealed that Jane Doe completed a rape kit collection weeks after the incident. Crutchmore's attorney stressed to NBC News that his client was not involved in any criminal conduct alleged in the case. Quote, rape allegations must be taken seriously and the young woman at the center of this case is entitled to be heard. Nothing in our response is meant to diminish that on her. However, Scott is not accused of rape and never has been. If Scott sees Doe in duress, he would have taken action and he was not present when her alleged victimization occurred. Jane Doe's attorney previously told NBC News that his client's messages with the accused man show how she was traumatized after the assaults and was trying to process what had occurred and get information about what happened. Quote, she was numb and in shock at the time. She was struggling to accept that somebody that she believed was her friend would violate and dehumanize her. It's also common survivors can't initially accept what happened to them. The text also seemed to show Jane Doe's demeanor shift as she realizes something was wrong. In one message, she tells a fraternity member, Y'all aren't my friends.

22 You are covering your asses. Days later, the fraternity member asked Jane Doe whether she had anything to do with his being labeled as an assaulter in the public eye, which she denies saying. Quote, I do know people are changing the narrative because like in any sexual scenario with one woman and many men, the woman is probably the victim. And I know there are rumors I was gangbanged. The next day, November 8th, Jane Doe reported her allegations to police, saying in a final message to the man, quote, I think I'm done talking to you. I know you lied. And there's some other, it goes on in the article, say some other things that I've already mentioned, and I don't want to repeat those. But as of now, that is where we are at in this case, at least as of this recording. I would love to hear your thoughts on it. Man, these conflicting statements that she gave is what bothers me the most. I mean, it didn't occur. But, you know, definitely a lot of questions with it. I'd love to hear your thoughts.
