She Won It, They Took It, Now Jordan Chiles Set to Get Disputed Olympic Medal Back

She Won It, They Took It, Now Jordan Chiles Set to Get Disputed Olympic Medal Back

A new court ruling has set the stage for Jordan Chiles to get her disputed 2024 Olympic bronze medal back. The drama became one of the biggest stories of the Paris Games and has continued in courts ever since. A Swiss court now says Chiles must be allowed to present her evidence, something she wasn't allowed to do previously -- which could settle this case and secure her bronze medal win once and for all.

Speaker 1: Hey there, folks.

00:00:10
Speaker 2: It is Friday, January thirtieth, twenty twenty six, and we still don't know who won the bronze medal on floor exercise at the Paris Olympics in twenty twenty four. And with that, welcome to this episode of Amy and DJ Robes. The fight over the Jordan Childs medal continues, and I kind of love it. I kind of love that she's still fighting for it and she just got some good news.

00:00:38
Speaker 3: Look, I am so excited.

00:00:41
Speaker 4: I thought it was only fair because look, this was something we covered extensively during the Olympics, and by all accounts, they have the proof. We'll get into the details, but the US Gymnastics Federation, they have the proof that her coach was able to appeal her score.

00:01:03
Speaker 3: Within that minute, and.

00:01:07
Speaker 4: Up until now, the appeals court refused to even see their evidence.

00:01:11
Speaker 3: Look at their evidence. Consider that evidence.

00:01:14
Speaker 1: Honest, did you even know this fight was still going on?

00:01:16
Speaker 3: I forgot about it.

00:01:17
Speaker 1: I forgot about it.

00:01:17
Speaker 3: I completely forgot about it.

00:01:19
Speaker 1: I thought it had been resolved.

00:01:20
Speaker 2: If you would have asked me two days ago, I said, yeah, I think they took care of all that. And it's with the Romanian right I thought that's how it was left.

00:01:27
Speaker 4: I knew that the record officially went to the third place when the bronze medal officially went to the Romanian, and.

00:01:34
Speaker 5: I believed the last I remember, Jordan Tiles refused to give back her medal, but she was frustrated because she couldn't even get the appeals court, the sports court that they have there to even consider her appeal.

00:01:48
Speaker 3: So I you know, that was frustrating.

00:01:50
Speaker 4: If you've got the proof and they're like, yeah, we don't care, and that's annoying.

00:01:54
Speaker 3: So to know that now she's at least going to be heard, that's phenomenal.

00:01:57
Speaker 2: All right, So let's tell you where we are right now, folks. Jordan taih the fight continues for that medal. Twenty twenty four. She won this metal third place at the Olympic Games in quite dramatic fashion. But she has now been granted an appeal. She has been fighting for this and now she has gotten a significant ruling from a Swiss federal Supreme Court, which has now sent the case back to the Court of Arbitration, telling them they now have to consider the evidence that they refuse to consider before, which essentially means robes. If you take it for what it is, Jordan Chiles is should get this metal back.

00:02:45
Speaker 4: Yes, because she originally finished fifth correct in the competition. But it was her coach that said that one of the elements that she performed in her floor routine wasn't given the correct scoring. So yes, the judge agreed they changed her score. That should be a done deal, period.

00:03:09
Speaker 2: Although argument there is whether or not the coach got the appeal request in in time they said it was supposed to be sixty seconds. There is actual audio video evidence that she got it in within the sixty seconds and that is the evidence that now is going to have to be It's been ordered to be considered, and if it is, she's going to get it back.

00:03:30
Speaker 4: Now.

00:03:30
Speaker 2: We don't know the timing of all this, but I saw one account at least that it takes about a year even to get a case heard and through this court, so this might still take a little while. But a reminder, we go back to twenty twenty four and we watch this every day very closely. But take us to the floor exercise ropes and the way it happened. Afterwards, your heart goes out to the young lady from Romania, I know. So they had made the announcements. We see the scores posted to who's first, second, and third and the young lady from Romania and I can't remember who was the one the famous gymnast from Romania.

00:04:03
Speaker 1: Oh NAUGHTI okay. They haven't won a metal since Nati a.

00:04:07
Speaker 4: Komen each pretty much. Yes, So this was a big deal for Romania. Was a big deal, a return to to greatness because the Romanians are so known for their gymnastics prowess, so this was just a pride there was It was a moment of pride for the country and for everyone who that's a huge, rich gymnastics culture there. So this was a big deal and it was so heartbreaking to see realized that the score change had been made. And we've also talked about one of the most iconic moments of that Olympics was seeing that podium and what it represented to see three girls of color standing at first, second, and third place and just how Jordan and Simone Biles.

00:04:57
Speaker 5: Were interacting with one another. It was just such a beautiful moment. So it was so unfortunate that after the fact it got muddied with all of this back and forth about who actually deserved the bronze medal.

00:05:08
Speaker 2: So some pretty some moments were created that now one of them is gonna have to go away because that moment with those three women of color, those three black women on that metal stand that we'd never seen before. Maybe it didn't happen because Jordan Giles didn't really get third place. That's what we are right now. However, if that ends up being the case, then that means that moment we saw that Romania girl jumping up and down.

00:05:42
Speaker 1: That didn't happen, I know.

00:05:44
Speaker 2: So those were two of the really so two of the best moments we've seen that we don't know if they have to stay in the history books as officially having happened. Was just a part of the story. It was the most fascinating I think, maybe the biggest story of the Olympics.

00:05:58
Speaker 4: Oh I think so too, because we were also just inspired by what we saw and then to see it go into controversy was troubling. But you mentioned that minute mark the video that they have as proof the evidence. It is showing that her coach filed that inquiry at forty seven seconds. So look, it seems like it's an open and shutcase. It seems like it's pretty obvious now or at least if they now agree to review this video.

00:06:29
Speaker 3: The video doesn't lie in.

00:06:32
Speaker 2: The argument before was something about jurisdiction, whether they could even hear such an appeal. So don't know why I was rejected in the first place, but now they have been ordered to consider it now. It was a statement coming from the Swiss court and it was pretty strongly worded about what's happening. But the statement lays out and makes clear what they want this other court now, Court of Obergeration, they're giving.

00:06:55
Speaker 1: It back to them and robes they are if this court.

00:06:59
Speaker 2: Sounds like if this court had the option, they would do it themselves and give the Metal back right to join Giles. But this was pretty clear to me.

00:07:05
Speaker 3: Yes, here was the statement from this court.

00:07:08
Speaker 4: In the highly exceptional circumstances of the case in question, it considers that there is a likelihood for the audio visual recording of the final on August fifth, twenty twenty four, to lead to a modification of the contested award in favor of the applicants. Since the CIS could consider, in the light of this audio visual sequence, that the verbal inquiry made on behalf of Jordan Chiles had been made before the expiry of the regulatory one minute time limit. The Federal Supreme Court therefore partially overturns the contested award and refers the case back to the CIS for a new ruling, taking into account the propative value of the audio visual.

00:07:59
Speaker 3: Recording in question. Sound like a done deal, period? Yes?

00:08:02
Speaker 4: I mean, and why wouldn't you look, No matter if you're the Romanian gymnast and Team Romania or Jordan Chiles and Team USA, don't you want the person who actually got the higher score to be given the proper medal?

00:08:19
Speaker 3: Do I want to meddle that.

00:08:21
Speaker 4: If there is audio and visual evidence of proofs, if and by all accounts they have it that the inquiry was made within the time limit, then the rules are the rules and it really shouldn't be up for debate. As heartbreaking as it is, I would still think that as an athlete, you would want the person the athlete who got the higher score to get the award.

00:08:45
Speaker 2: If if that athlete that got the higher score made the appeal in time, which is also a part of the rules, and if the young lady from Romania believes or maybe she hasn't even seen the evidence. Oh, she just has firmly that belief that the minute time was up. Then that's part of the rules. You didn't do it in time. That medal's mind. I could get that. You work your whole life, all of them busting the butts every day on the Olympic stage. Damn right, it's a fight over a third place medal. It has been going on for two years in court, that's how serious this is.

00:09:15
Speaker 4: Yeah, we're about to show the Winter Olympics beginning next week, so and we still haven't figured out who got the bronze medal in Paris twenty twenty six.

00:09:25
Speaker 1: You know what, this is possible.

00:09:28
Speaker 2: We could start knocking on the door of the next Summer Games with this thing. They said to take at least a year.

00:09:32
Speaker 4: There's no timetable, But that's so interesting to me if you're agreeing. Now, Okay, now we know we have this video evidence. We look at said video evidence. Why you need a year to decide what it is that you're seeing.

00:09:49
Speaker 2: So you've known court systems to move quickly. Okay, that just seems excessive.

00:09:54
Speaker 3: This seems like an open, had shut case.

00:09:57
Speaker 2: Oh wow, even those take years. But We also heard from USA Gymnastics certainly sticking by Jordan Chiles. Will let you hear what they had to say and see what's next for miss Jordan Giles there or continue here on Amy and TJ. Jordan Childs keeping the fight going for that bronze medal that she was awarded and was taken away and now she's trying to get that thing back at it looked like a new court ruling has worked out in her favor and another quart is now going to have to consider some new evidence showing that her coach in fact did get that appeal in in time ropes. I'm trying to think of a bigger story from the twenty twenty four Olympics in Paris. I'm trying to think. I'm trying the kangaroo lady, right, that.

00:10:54
Speaker 3: Was a big story.

00:10:55
Speaker 4: Also the boxer, the female boxer who is every day king was a man and wasn't biologically a woman. That came out as a huge story and certainly caused a lot of heartache.

00:11:08
Speaker 1: You know, you're right that those were the two.

00:11:10
Speaker 2: We were doing something on those three stories every day, it felt like, and even after the Olympics. You're right, that's right and suddenly the boxer.

00:11:16
Speaker 1: You're right.

00:11:17
Speaker 2: That was a huge story at the time, but this one continues. It's remarkable Robes a year and a half late over steel talking about it. But USA Gymnastics has been standing by Jordan the whole time and will continue to do so.

00:11:30
Speaker 4: Absolutely, and they have released a statement based on this big decision. This is a huge decision that they have agreed to consider her appeal and at least consider the video evidence that they refuse to look at up until now. So here is what Team USA had to say about that decision. We are pleased the Swiss Federal Supreme Court recognized the flaws in the initial process and that Jordan's case can now be heard inclusive of all relevant evidence. Gymnastics will continue to support the efforts of Jordan and her team to retain her bronze medal in the twenty twenty four Olympic Women's floor exercise. We look forward to a fair arbitration that includes the clear evidence proving the inquiry into Jordan's score was filed well within one minute as required by FIG rules. USA Gymnastics recognizes and thanks the Swiss based firm of Schellenberg Whitmer and the US firms of Generin Block and Rubinstein ADR for their work with USAG and our collective advocacy for Jordan.

00:12:37
Speaker 3: Always got to thank the lawyers.

00:12:38
Speaker 4: Don't know if that's going to get them a discount on the bill, but certainly thanking the lawyers. And I thought it was interesting they use the word retain her bronze medal. That may answer my question because I believe she refused to give her medal back.

00:12:53
Speaker 3: They physically send it back.

00:12:55
Speaker 2: Because they were requiring her to do. So, you know what, I don't know what happened to that sucker.

00:13:01
Speaker 3: Well, if they said retained, that means she kept it.

00:13:03
Speaker 4: They didn't say get it back or be reawarded. No, they said retain, So that means And I love that because from I never saw anything written or published that she in fact returned the medal.

00:13:17
Speaker 1: Remember if we were talking about it like she's gonna drop it.

00:13:20
Speaker 3: In overnight, it like they want it back? Are you serious?

00:13:24
Speaker 4: So I believe she kept it in her possession and good for her.

00:13:31
Speaker 2: Well, this was a again, it was an emotional story. You felt bad for both of these athletes, felt bad for both of these teams. Both of these countries. She left with a gold medal and the all was the team one. Right, Yes, she got a gold medal out of what this was a big deal of individual bronze for so with.

00:13:49
Speaker 3: The floor exercise.

00:13:50
Speaker 1: She shouldn't ever let this fight go.

00:13:52
Speaker 4: And her her statement and I appreciate this. This was her statement about the whole controversy. I followed the rule, and so that's incredibly frustrating. If a judge made a mistake, judge acknowledges mistake, judge had to be told he made a mistake by coach.

00:14:10
Speaker 3: Coach did it within the rules.

00:14:11
Speaker 4: Like everyone, they followed the rules, and so that's so frustrating to think you've been stripped of something you earned, even when you went by the correct process to make sure your score was fair.

00:14:24
Speaker 2: She might get a chance to get more metal. She's she hasn't declared and says she's going to keep going and go for the Olympics again. But she said that's something she still thinks about. She's in school, she's still a student UCLA. Do that young, isn't that crazy?

00:14:37
Speaker 4: I mean, gymnasts look at a certain point when you're over the age of I mean, honestly, even having some own biles. Be the age she is, you know, this is a young woman's sport. You have the flexibility and I actually the fear involved. I mean there's a mental aspect to this sport as well. And the younger you are, maybe the more foolish you are. You don't realize how her you could actually get. I know, I was a competitive gymnast until about thirteen, and then I started realizing, wow, I could do some serious harm to myself. So it is remarkable when you see women who mature, their bodies mature, they recognize what could happen, and they still fight and do these unbelievable feats with their bodies that I can't even get my head around.

00:15:19
Speaker 1: But they've been on the world stage for so long.

00:15:21
Speaker 2: I consider them so mature and such champions and go, oh, yeah, she's in college right now.

00:15:26
Speaker 4: Yeah, like a lot of the best athletes the gymnastics. Leffler sixteen, seventeen eighteen.

00:15:32
Speaker 1: That's amazing, So good for her.

00:15:34
Speaker 2: We are rooting, still rooting for, We were rooting for as she was performing, still rooting for now. So I just want to hop on that the update. We always appreciate you spending some time with us. For now, I'm TJ. Holmes On behalf of my dear Amy Robock. We will talk to Elson, yes,
