Racial Tensions Rise As Trial For Black Teen Accused Of Murdering White Teen Gets Underway

We’re following day one of the Karmelo Anthony trial, the teen accused of killing another teen after a scuffle before a track meet. There has been outrage that an all white jury was seated to decide Anthony’s fate. Anthony is black while the victim, 17-year-old Austin Metcalf is white. Today we heard opening arguments and the first witness, as protests erupt outside the courthouse.

00:00:02
Speaker 1: Hey, that folks did.

00:00:02
Speaker 2: Is Thursday, June fourth, and the trial for a black teen who killed a white teen is officially underway in Texas. Their demonstrations outside, there's increased security around the courthouse as people await the fate of Carmelo Anthony. With that welcome to this episode of Amy and TJ. Ropes story has been making national headlines. Everything to do about race. The jury got selected and oh boy, yeah.

00:00:40
Speaker 3: This was actually the absolute worst case scenario because we were even talking about this before jury selection. So we revisited the case and race was always a central division in this Dallas suburb of this community. And even though the actual crime itself, no one's actually saying overtly, I haven't heard it yet that there was any race fueled hatred or anything to do with race with the actual killing.

00:01:10
Speaker 1: The crime was not about race, correct.

00:01:13
Speaker 4: Okay, that's a good way to put it.

00:01:14
Speaker 3: But the debate about what happened and what should happen next has become incredibly racially divisive, to the point where the victim's family and the defendant's family have both had to get security. They both had to at least one of them have had to move their home addresses were published death threats to everyone. That's how difficult and awful this has become. And it's become a unbelievable racial powder keke.

00:01:44
Speaker 4: So to have a jury just seated.

00:01:48
Speaker 3: On Tuesday that has no black person on it is inexplicable to me.

00:01:56
Speaker 1: Not a one robes. Uh, how does this happen?

00:02:01
Speaker 2: I think the jury pool they started with six hundred potential and they went through and they talked, and they had conversations and looked some people were honest about they were biased. Some people were honest about many of those things. And yes, some black people like I see him as a kid, it'd be difficult for me. Fine, and they get scrapped. But they got down to the last few and they were three, in particular robes black potential jurors that.

00:02:25
Speaker 3: Were left female educators, correct, all three black female educators. And they were struck by the prosecution.

00:02:34
Speaker 2: And objection from the defense like saying you don't have the right, you don't have a justification, essentially saying, yeah, you just want them out because they're black. They made their arguments and the judge sided with the prosecution and allowed it, and those three were struck. And this kid nineteen now, but he was seventeen at the time. Is going to have his fate decided by a jury of his peace is none of which looked like him.

00:03:01
Speaker 3: And that is what is so remarkable to me in a case before jury selection even began that was so racially divisive.

00:03:09
Speaker 4: How in the hell in.

00:03:10
Speaker 3: The state of Texas, which is, I'm sorry, a diverse state, how is it that you can seat an entire jury without one black person on it? So civil rights organization Next Generation Action Network, Yeah, they've been speaking out. They are outraged, as many other organizations are, that none of the jurors are black. And this is what they said, and I thought this was really well put. The prosecution used its final strikes to remove the remaining qualified black jurors from the jury pool, raising serious concerns about fairness and equal justice. We respect the court, but we will not remain silent.

00:03:52
Speaker 2: I think that's the argument. Is he going to get a fair shake? That's the argument, Robes. He's even admitted to what he did. The argument should be in court over was he justified? Did he feel like it was self defense? So, okay, work that out. But the legal system, how is he going to treat him and one of the big steps in that robe. So the folks who are going to decide his fate and none of them look like him. Now, there will be plenty of people listening and say it shouldn't matter. Why are you suggesting that just because he's black and the juror is white, that he can't get a fair shake. Yeah, because there's some things that some of us don't even realize we have a bias about, and there are numbers to back it up. We'll get into that, but yes, there is evidence robes that black folks don't get a fair shake when it's an all white Jerry.

00:04:50
Speaker 3: Yes, we will get to that in just a bit, because those numbers don't lie. But I would actually just ask every listener. I don't know if you're white or whatever race you are, but say you're not black. Imagine you are accused of committing a crime against that other race, a black person, and now you are sitting there in a jury filled with people who just look like you're victim and you're a completely different race.

00:05:16
Speaker 4: Are you going to feel like you're getting a fair trial?

00:05:19
Speaker 2: Put this in any scenario, if it's a white man and you killed the Chinese woman, and everybody in the jury box is Chinese. Yes, how would you feel about that? You can mix this up and you can already.

00:05:31
Speaker 3: Feel your chest tightening because you would know that there's just no shot that it's going to be fair.

00:05:37
Speaker 1: And that's wrong. We have to acknowledge that.

00:05:40
Speaker 4: Yes, okay, just reverse it and imagine it's you.

00:05:43
Speaker 1: There's some bias in there. There just is.

00:05:47
Speaker 2: And it's not just a knock and it's not just we call anybody racist for it romes. But I see a seventeen year old black boy differently than someone outside of the race might see him as a seventeen year old threat.

00:06:01
Speaker 4: Correct. I think that's a really good way to put it. I totally.

00:06:05
Speaker 3: I think putting it in those terms and actually viewing this case through that lens, maybe there's a little bit more of an understanding. But it's just awful what's happening outside the courthouse as well.

00:06:15
Speaker 2: Oh my god, rhes and this was the worst way to get this thing started. So yes, you're going to have demonstrations and foe. You gave the update just a second ago that they had to actually get the authorities involved.

00:06:24
Speaker 4: So yes, so we right now as we're recording this.

00:06:28
Speaker 3: We've had opening statements and then we've had one witness on the stand. They just broke for lunch a short while ago, and during that lunch break, a reporter who stepped outside just reported from that area that protesters on both sides of the case seem to be getting rowdy. A Collin County counstable has given them a warning. So this is happening right now on the first day of testimony, during a lunch break, So I can't This is a trial that's expected to go two weeks, so it's certainly concerning.

00:07:00
Speaker 4: About what's ahead.

00:07:02
Speaker 3: But we did get to hear opening statements, and we got a little bit of insight into what the defense is going to be presenting.

00:07:08
Speaker 2: This is self defense and you know what Robes when they started talking, excuse me, wee get the notes, so I should say some of the things I'm reading through and I see this makes sense and he's in that space, Robes. The size differential was a little shocking to me.

00:07:25
Speaker 3: Yeah, So they made a point that Carmelo Anthony is five eight and I forgot what his weight was.

00:07:31
Speaker 1: One hundred and thirty.

00:07:34
Speaker 4: He's a little guy. That's a fair thing to say.

00:07:37
Speaker 1: Robes, that's a boy. He looks like a little.

00:07:39
Speaker 4: Boy, five eight one thirty. The Austin old.

00:07:43
Speaker 1: Yes he's seventeen.

00:07:44
Speaker 4: Yeah, he hasn't hit his stride yet.

00:07:47
Speaker 3: Maybe, but Austin and Hunter Metcalf, who are identical twins who were in this argument with him, is what we're hearing. So it was it was Carmelo Anthony going up, I guess, at least verbally initially against both of these guys who were six' one two fifteen and two.

00:08:06
Speaker 2: Fifteen or if that's an eighty five pound weight difference just with one of.

00:08:12
Speaker 1: Them bro's that's.

00:08:15
Speaker 2: Intimidating Now, no but he if he's presenting that to, me is the first TIME i heard something go oh?

00:08:23
Speaker 1: Hell he might have been, scared.

00:08:25
Speaker 3: Right so that was at least something that we had not heard. Yet so he said that his client was reacting to fear and. Chaos and, look this is where we were even talking about jury. Selection because if you have a small black man with two large and you could, say potentially intimidating identical twins who are white.

00:08:46
Speaker 4: Telling you to, leave.

00:08:49
Speaker 3: A black juror might understand or at least be more willing to put himself in the place Of Carmelo anthony than someone who isn't his.

00:08:58
Speaker 2: Race, yes that is absolutely, true and by the accounts at least it Was Austin. Metcalf, again this is me explaining the, story not assigning some. Blame but he was the one that Grabbed Carmelo anthony first and started at least the physical part of.

00:09:14
Speaker 1: This, now there's never an.

00:09:15
Speaker 2: Excuse why does he have a knife there, anyway certainly a question to be, asked but there's no excuse for what he, did, period point.

00:09:22
Speaker 1: Blank there is.

00:09:22
Speaker 2: Nothing, now how severe his punishment should, be an understanding what was in his mind at the, time that all that stuff's, Relevant but he did, it and he should not have done. It sometimes you got to take an ass whoop at five eight in one hundred and, thirty don't go poke a six one two fifteen, bear is WHAT i would, advise Right. Robes it's just this these, Things but just hearing that number was a, big a big part for.

00:09:51
Speaker 3: Me, yes and his defense attorney went on to, say AND i JUST i guess is the point that he wasn't intent on? MURDERING i guess this capital murder, charge this premeditated part of.

00:10:02
Speaker 4: It he, said After carmelo.

00:10:03
Speaker 3: Defended himself with that, knife he, ran he didn't stab, again he dropped the.

00:10:08
Speaker 4: Knife he didn't stab anyone.

00:10:10
Speaker 3: Else so you can see they're trying to set up this wasn't, premeditated and of course they're going for the self. Defense the prosecutor interestingly went right immediately to address maybe the elephant in the, room and he, said this case has nothing to do with, race he, said he, said this case is not self. Defense it's unjustified provoked, murder and that's why we are here this. Morning so he just kind of cut to the. Chase, yeah they think that's the.

00:10:38
Speaker 2: Case i'm really itching to hear from all the, witnesses, robes all the winners who were, there who can tell us what exactly, happened what the interaction, was and WHY i had to escalate to somebody pulling on a, knife stab and. Run what WAS i was so, just, oh it doesn't make any.

00:10:56
Speaker 3: Sense the prosecutors were describing it as a sneak, attack so to what you're.

00:11:01
Speaker 4: Saying that's how they're framing it to the, jurors.

00:11:04
Speaker 2: And they're certainly framing it differently on the other side in. Robes it seems like like we were talking about he recognized. Somebody he's not from the same high school as these. Kids he recognized somebody in their area in their. Tent there was a rain, delay of weather. Delay he went in there to get.

00:11:20
Speaker 4: Cover his high school didn't have a. Tent he, said for whatever.

00:11:23
Speaker 2: Reason, oh so we get a dude needs some rain and he murders a Guy.

00:11:29
Speaker 1: ROMs i know so awful how lives changed like.

00:11:32
Speaker 3: This it is, very very difficult to even understand how it got to that point so. Quickly but you said you want to hear from the. Witnesses, well the prosecution has.

00:11:43
Speaker 4: Put out its.

00:11:43
Speaker 3: Plan it's planning to call thirty five. Witnesses they think this trial is going to take about two. Weeks and when we come, back we'll tell you about the first witness who has already been called to. Testify welcome back to everyone to this episode Of amy AND. Tj we are following The Carmelo anthony. Trial, wow it has garnered national. Attention there are protests currently going on outside that. Courthouse this has all become a, racial racially divisive, trial even though everyone within the courtroom today is saying this actually didn't have anything to do with.

00:12:26
Speaker 2: Race the crime itself did no no suggestion of that at. All but one kid's, white one kid's.

00:12:33
Speaker 3: Black here we, go, yep and now we have a jury that is all. White so to add to all of that tension that was already, there now you've got it seems a verdict that will almost certainly be appealed just by virtue of who is seated at the.

00:12:50
Speaker 2: Jury you, know it's a high bar to get a to prove that the other side wanted to strike a juror for. Race that's a really high bar to, prove and they get. WHATEVER i don't, know bats AND i do too much study of. This it was the bats in case ye had the bats and rule or whatever they call, it but rose that the judge allowed.

00:13:09
Speaker 3: It you have to have written a note or like denoted that somebody's race was.

00:13:13
Speaker 2: It you know how we just look over at the during go you know, what, guys maybe we should mix it up a little.

00:13:19
Speaker 1: BIT i, mean JUST i don't.

00:13:21
Speaker 2: Know everybody's supposed to be able to give everybody else a fair, Shake BUT.

00:13:24
Speaker 3: I ACTUALLY i would personally be so okay with whatever the race of the defendant was that at least one person of that person's. Race beyond a jury like that only seems there needs to be some sort of A i don't, know but just some sort of guarantee that you're not going to be facing people who don't look anything like, you who know nothing about how you came up or where you're, from or what your values, are you know.

00:13:52
Speaker 1: What let me let me hit that.

00:13:53
Speaker 2: Now then that perfect segue we were talking about, earlier the like does it matter right it certain white to be able to give the same. Shake AND i was talking about this study out Of Duke. University it was a groundbreaking STUDY i think it was some ten or fifteen years, back where they studied the racial makeup of jurors and the outcomes for the. Defendants so take one, scenario all white, jury they convict black defendants eighty one percent of the, time convict white defendants sixty six percent of the.

00:14:25
Speaker 1: Time, Okay, now factor.

00:14:28
Speaker 2: In that same all white, jury but just add one black. Person, okay one black person on the. Jury when they have a black, defendant they convict seventy three percent of the. Time when they have a white, defendant they convict seventy one percent of the. Time, wow it's almost exactly the same as long as you get one black person on the.

00:14:51
Speaker 4: Jury and that makes a lot of.

00:14:53
Speaker 1: Sense that's a huge.

00:14:54
Speaker 3: Thing just now you've got somebody who gets, it and you can't just jump to conclusions stereotype somebody because of how they look or where they come. From when you have someone who looks like them sitting there deliberating with, YOU i think it should be like that if.

00:15:10
Speaker 1: It's group think and that whole group looks the, same and not like.

00:15:14
Speaker 3: That And i'm also, saying, yes we're not saying it's a malicious thing or it's a it's a. Decision, no it's. Subconscious and when you have somebody else there who represents at least another viewpoint or the viewpoint potentially of the, defendant that is only going to help star justice system be. Fairer and those numbers you decided prove.

00:15:37
Speaker 1: It that is, amazing, amazing that's.

00:15:41
Speaker 3: Crazy, well speaking to what they have seen at least so. Far in court, today we did talk about they've got one witness so far who's been called to the. Stand his Name's Mark. Porter he's a video expert and he's analyzing or he analyzed the surveillance footage where you See Carmelo anthony go into the tent and you can actually See it's very grainy, apparently but you can see it seems like a scuffle that takes, place and then you'll See anthony fleeing the stadium and falling and getting back up and just running.

00:16:13
Speaker 2: Out, YEAH i don't know what it's so, far at least robes there's you can't make everything out in these. VIDEO i don't know if more are, coming but so, far it's not like there's not a clear shot of exactly what happened in the, tent, correct.

00:16:27
Speaker 4: So you can.

00:16:28
Speaker 3: Tell the only THING i think that was of note from WHAT i gathered was that you can tell there was a scuffle. Beforehand BUT i actually felt like it seemed it was kind of remarkable how quickly things turned. South like it wasn't some prolonged verbal exchange or there was some back and forth or some. Posturing it kind of seemed like it all happened really really really. FAST i don't know if that's good or bad for either. Side not sure what that says about the.

00:16:56
Speaker 2: Moment this is, Awful, yeah awful awful for. Both you, know both of these were Not these weren't bad kids.

00:17:04
Speaker 3: Either, yeah they've even talked about both of their GPAs Where Austin metcalf was set to graduate with a four point zero he had all these, Dreams and then they talk About Carmelo anthony he.

00:17:14
Speaker 4: Graduated that he was still allowed to.

00:17:16
Speaker 3: Graduate he just didn't he couldn't, PARTICIPATE i believe in, person but he graduated with a three point SEVEN. Gpa these were bright kids who were track, athletes who had bright.

00:17:27
Speaker 1: Futures what was it His, Uh carlo's mom is a nurse and the dad is something, Else like you, go what the?

00:17:34
Speaker 3: Hell, yes these were good, people hard working. People they didn't come from, broken awful families and.

00:17:42
Speaker 4: Looks they really. WERE i don't, know but it just well it's not the stereotype you might.

00:17:47
Speaker 2: Think okay, broke that's worth. Saying that is worth. Saying why in this split second did he make the decision he. MADE i don't, know but it was awful and it's ruining. Lives, so, yes this one's. Happening, yeah we'll keep an eye on because they're still going to come. Back as of this recording and more information going to come out right this.

00:18:05
Speaker 1: Afternoon, yes we'll.

00:18:06
Speaker 3: HAVE i believe the video expert is still on the, stand so he'll continue to explain what he's seeing in those. Videos in the video was played for jurors as. Well but, again this is expected to take two. Weeks god at least so far it looks like three dozen or so more experts or more witnesses to testify for the. Prosecution but we will certainly keep our eye there In. Texas for, you we always appreciate you listening to us On Made Me roboc ALONGSIDE.

00:18:33
Speaker 4: Tj. Holmes we'll talk to you. Soon
