JUST IN: Defense Rests In Karmelo Anthony Murder Trial

RSS Feed The fate of Texas teen Karmelo Anthony will soon be in the hands of a jury, as he stands accused of murdering 17-year-old Austin Metcalf at a high school track meet last year. Anthony’s defense team rested earlier today after calling just 5 witnesses. There was an unexplained two hour delay leading up to the announcement, many legal experts believe Anthony may have been weighing whether or not to testify in his own defense.

With that, welcome to this episode of Amy and TJ. This trial is moving really really quickly, a lot at stake, high profile trial, but the defense did not put on much of one.

Speaker 3: Correct that he was up against and he was seventeen at the time, as was Carmelo Anthony. And this has certainly caused a tremendous amount of racial tension in the Dallas suburb area there in Texas. And there's a lot of steak and there was some drama in the courtroom today.

Speaker 1: This was look, we are only on this trial started the last week. Jury selection on Monday, Jury in place by Wednesday, opening arguments on Thursday, and the state put on its case and rested its case by Saturday afternoon. They had a Saturday session robes. They put on five witnesses. By our account, the defense has yes, five witnesses. So today the trial resumes and we think we're just getting going on. The day they go to lunch, then they're supposed to come back at a certain time. Half hour goes by, the not back, hour goes by, the not back, an hour and a half goes by. What's going on in this delay and no one was being allowed in the courtroom, so nobody could figure out what in the world was going on. But then people noticed that they took Carmelo's Anthony carmerl Anthony's parents into the courtroom. So only a couple of things were being discussed, as far as speculation robes about him either testifying or maybe cutting a deal.

Speaker 3: Yes, so look, before you decide whether or not you're going to testify, the judge outside the presence of the jury, we'll ask the defendant if he knows his rights and whether or not he is willingly choosing not to speak on his own behalf. And sometimes he actually gives We've seen the judge give the defendant like, hey, take thirty minutes, think about it. Maybe he said that talk to your parents. Really think this thing through make sure you don't want to get up there and testify on your own behalf. So we don't know exactly what was going on. So that was one theory, and then the other theory was that perhaps the defense had put everything it could and the prosecution might have felt like there was an opportunity to one side or the other could have been asking for a plea deal, some sort of a deal.

Speaker 3: We don't know if that was going on, but it's possible that could have been happening as well.

Speaker 1: But that speculation came, I guess Robes when some one there at the courthouse noticed that the victim's parents were then taken into the courtroom. So why would they need to be in there? What would they need to be talked to about? And that is probably and we've seen that plenty of times. Yes, prosecutors do consult with the victims' families before they make decisions sometimes, so that was a part of the discussion. We haven't gotten those reports, at least as of this recording, of exactly what happened, but they finally came back after lunch break, and it was possible Robes we're going to hear that Carmelo Anthony was going to testify. I was standing by because Robes, the case that they put on we'll get into the witnesses at least today didn't seem like much of once. So it seemed like maybe maybe he needs to get up there to save himself.

Speaker 3: Yeah, I did think that that was a distinct possibility because to your point, it didn't seem like there was any moment where the defense scored any major victory in terms of establishing the fact that Carmelo Anthony felt like his life was at risk. In fact, the prosecution put on a pretty good case, witness testimony after witness testimony describing Anthony as the aggressor, describing Anthony as the one who was the provoker. So, yes, the defense needed to have some folks stand up there and say something very different. Didn't really hear anything that was earth shattering on that point.

Speaker 1: No, they lost points, perhaps Robes and one particular witness that we will also get into. But yeah, so the parents were in there and all the speculation, they finally come back and sure enough, the defense has rested its case. The way this thing is going to go now is that they will be back tomorrow. There will be uh I think the judge is already give him my heads up. It's going to be a long jury instruction. There will be closing arguments and robes. He told them to pack a bag.

Speaker 3: So yes, they begin deliberations, will assume they'll get the case officially tomorrow on Tuesday. And then they said, yes, you will be sequestered because that is just how volatile the tensions are in the area, in the community, and they just don't want to put either the jurors lives at risk or certainly happen be in any way tainted, or just be singled out. So yes, they're all going to be staying in a hotel, motel, holiday inn, not sure which one it is until they reach their verdict.

Speaker 1: Hell yeah, you know it's going to be one that shows up with no bag. Say nah, we'll get this knocked out, not a problem. I always was fascinated by these stories that athletes tell about going to playoff games. Sometimes say yeah, I'm just packing one suit because we're going to win this game. And in the series. I'm not even going to pack a second like, Wow, that's really bold. I always wanted to be like that. I wonder if there's gonna be one knucklehead on this jury, right, No, we're going.

Speaker 1: So that was something they hear. But Robes, that goes too, Like you said, just how explosive, just how heated this all has been again the crime. No one is suggesting that the crime is about race ever, was about race. No suggestion that race played a role in the two boys having the confrontation in the first place. Race only got involved afterwards. Robes, with all that was going on online, where one community is attacking the black kid, and then the other community is trying to at least take up for and even find some fault with the other kid, the white kid who was killed. So what do they do? They go after families? These folks, didn't somebody move in this again.

Speaker 3: Actually they have a they've raised a lot of money, which is that whole concept that they've I believe raised over a million dollars for the Legal Defense Fund and to help them move because their address was yes put out online and their safety they felt like their safety was at risk and they had to move and flee to a gated community so they can feel Safe's that's how bad and how ugly and how scary this has all.

Speaker 1: Gotten so and it hasn't stopped. It continues. We can see at Robes and some of the coverage of this story that we have been seeing on a daily basis, and how some outlets choose to portray one side or the other, and it's it's not fair to either side quite frankly. But these were to seventeen year old boys at the time, and these two their lives certainly, I mean hard to say ruined, but one is gone Robes. But these two families are shattered.

Speaker 3: Yeah, I mean we have gone over and they've talked about what Both of these boys were headed to college. Both of these young men had very like excellent GPAs I believe Carmelo Anthony had a three point seven, Austin Metcalf had a four point zero. So these were kids who were on the track team, on the football team, they were leaders, they were really just actual superb students who were contributing members of their community. These weren't guys out there just not doing well and didn't have much to live for. That's what makes this exceptionally tragic, just because these were kids who had truly bright futures.

Speaker 1: And here we go. One of them could spend quite possibly the next significant chunk of his life in prison for this. So today, like we said, there was a rare Saturday session, but they were in court on Saturday this weekend. The judge went to keep things going. The defense put up two witnesses I believe, on Saturday, a coach and a student. But then they started today and what we had was three witnesses, two of them students, one of them a police officer. I'll talk about the officer first, which what was it they were trying to offer? With the officer being up there, they essentially got out of him. Is it illegal to carry a knife the size of the one that Carmelo Anthony had? No? He said, but some schools have policy against it, And that was the gist of it. I guess they're just trying to establish that he wasn't committing a crime by having it on him.

Speaker 3: Yeah know, what that got them with the juror or with any of the significant charges that Carmelo Anthony is facing. So we know that the stab wound actually because of the autopsy report that the juror saw concerning Austin Metcalf, it was a two inch stab wound, and so I would assume, yes, the blade was probably two.

Speaker 3: So, yes, the police officer testified that it is not illegal to carry a knife, a pocket knife less than five and a half inches, I believe, so, yes, he was well within his legal.

Speaker 3: But he pointed out, and I think it's very clear that it's still against the school policy for any student to have any type of weapon, regardless of how legal it may be anywhere else, or how long the blade may be. So I don't know what the defense accomplished with that, but yes, they established he wasn't breaking the law when he had the knife with him.

Speaker 1: They had another kid that show up, another seventeen year old. I didn't didn't offer much necessarily by way of supporting the self defense arguments. I'm not sure what they got out of it, but there was one witness in particular that might have been the star witness, but not for their side. This afternoon, very short defense put on in the Carmelo Anthony murder trial. But the defense has rested its case. The jury will be deliberating tomorrow. That is the plan. That is the schedule.

Speaker 1: They wrapped today with testimony from robes not necessarily witnesses that knocked it out of the park. They didn't necessarily end with the bang of any kind necessarily and certainly not the kind they hoped for. But once to and got up and I spent This is one that was spending time with Carmelo Anthony apparently that day and was telling his story and what he saw and rose. The cross examination didn't go.

Speaker 3: Great, Uh yes, because he was saying that he actually was making his way towards Carmelo Anthony because he had heard things get loud and he knew that his teammate was over in that direction, so he thought he might need his help. So he said when he was heading towards the group, he said, everybody was all around surrounding, and he saw someone getting pushed or punched or something like that. And so he said that the kid that got hit came back with a swing motion.

Speaker 3: So when the cross examination came around and he started asking him, aren't you just kind of guessing and when you actually saw the video, he basically had to admit that once he saw the actual surveillance video, it didn't match his memory and so he might have gotten some of what he thought happened wrong.

Speaker 1: This is the one kid, and this was the one story that had been out there a little bit any suggestion that Carmelo Anthony got jumped, right, was surrounded, So he's surrounded. This is the kid who says he saw him surrounded. Mind you, nobody else has reported that or testify to that up on the stand. So this was the one thing robes the one possibility that he got scared because he was being surrounded. Even if he wasn't being jumped, he at least he was intimidated something. And this is the one kid who then said, nah, he had to take that back.

Speaker 1: This was a very short defense, and I don't know how. And again no cameras in the courtroom, so we obviously don't have a great handle robes on all the testimony, but from all the reports coming out, and there's some good reporters in there who are giving us good play by play. We pieced it together from several reporters who are in there and robes. It's hard to understand how a good defense, this was a good defense that in any way would sway a jury that this kid is so scared that he had to stab somebody.

Speaker 3: Even the first witness they had today, another student, it was basically to establish as far as I could tell that Carmelo Anthony was in a decent mood that he wasn't in he wasn't angry, he wasn't upset, He wasn't in some you know, violent seeming mood. He just was a normal, regular guy.

Speaker 3: The only thing that everybody was talking about was the weather, and it seemed like a normal day, and that Carmelo Anthony seemed like he was in a normal mood. So I don't again, I don't know what that gets the defense.

He made a split second, bad, bad decision that cost somebody his life, and it's going to cost him, maybe his in going to prison. Roades. This is just what lesson can be learned.

Speaker 3: And then yes, just to note today during that time that we're not really sure what happened, whether there was a potential plead deal in the works, or if he was weighing whether or not to testify in his own defense, but just to see both sets of parents being called to that courtroom, and we've heard reports from reporters there in the courtroom that Austin's parents have been wiping away tears and crying throughout much of this. This is just and I'm sure Carmelo Anthony's parents feel the exact same horror because both families are set to lose their sons. One certainly has forever and the other one's fate is about to be in the hands of a jury that will be sequestered. That's just how high the stakes.

Speaker 3: Even the first witness they had today, another student, it was basically to establish as far as I could tell that Carmelo Anthony was in a decent mood that he wasn't in he wasn't angry, he wasn't upset, He wasn't in some you know, violent seeming mood. He just was a normal, regular guy.

Speaker 3: And then yes, just to note today during that time that we're not really sure what happened, whether there was a potential plead deal in the works, or if he was weighing whether or not to testify in his own defense, but just to see both sets of parents being called to that courtroom, and we've heard reports from reporters there in the courtroom that Austin's parents have been wiping away tears and crying throughout much of this. This is just and I'm sure Carmelo Anthony's parents feel the exact same horror because both families are set to lose their sons. One certainly has forever and the other one's fate is about to be in the hands of a jury that will be sequestered. That's just how high the stakes.

And we do think all the Dallas reporters need to get their names give them some love. But they've been great. They've been in the courtroom covering this for a lot of outlets.
