BREAKING: Singer D4vd Charged w/Murder; Death Penalty on The Table

The LA District Attorney just announced first degree murder charges against singer D4vd for the killing of 14-year-old Celeste Rivas Hernandez. Authorities say David Anthony Burke invited Celeste to his Hollywood Hills home on April 23rd last year and that was the last time she was seen alive. Burke is also charged with lewd and lascivious acts with a minor and mutilating human remains. Police say there is enough physical and digital forensic evidence to prove Burke murdered the teen, beyond a reasonable doubt. Burke’s attorneys maintain their client’s innocence.

And I'm thinking, and I think a lot of people were thinking, maybe something happened accidentally, Maybe something tragic happened and he panicked and he had to get rid of her body, and you know, you're just trying to think about all the what could have happened.

So yeah, we had all sorts of ideas of what could have happened. But when we heard the LA District Attorney say that David Anthony Burke was being charged with first degree murder with special circumstances, and those special circumstances are lying in wait, committing the crime for financial gain and murdering a witness in an investigation, and that investigation was into lude and lascivious acts with a minor.

Speaker 1: So you start piecing this together, and what authorities are suggesting is that he was having an inappropriate sexual relationship with a child. He was going to get caught, he was going to lose his career, and he decided to kill her to save it all. And he didn't just have an accident. He did this on purpose. He intentionally brought this child to his home so he could kill her. Robes, This story was horrific before I did not know it could get worse. These details for what they are suggesting he did, for why he did it, how he behaved afterwards, and Robes even you come up short of the short of her dying, of her death robes even some of the stuff they're describing. Now he is a grown man. I don't care how young he is. This a thirteen year old child. He's in a sexual relationship with This story is it's horrific.

We September eighth, she was found wrote that was five months That was one of the questions. We always do this, like we were in that press conference, what do you want them to ask? I wanted to know where was she? Where do you think she was? Where was her body? And if she was seen the last time in April robes, does that mean she was she died on that day or she wasn't not out to leave? Was she kept out of public in some way? I don't know what. The suggestion seemed to be that she died on that.

But when we heard him say special circumstances, that immediately piques our interest because we know what that means and rogues. After that, he said that determination is going to be made at a later time. That was the part that was the most jaw dropping for me, is just that moment to hear him say they are considering it. But there's a lot we still don't know that we're waiting for information on. We heard from the district attorney saying that they will release that corner's report. We've been waiting for that. The medical Examiner's office. We journalists have been trying to get their hands on that for months now. They put a court order sealing it. Well, it is now going to be unsealed. It is going to be released shortly, is what they said. We don't know exactly the timing on that, but we did get confirmation when a reporter asked a question in the press conference, did the corner was the corner able to make a determination as to how Celestrievus died? And the answer is yes. They do have a manner of death. And that's significant because if her body had been decomposing for as much as many as five months, that is difficult. It makes, certainly forensics much more difficult to determine cause of death and manner of death. But it seems like they do have that and we should be getting that information shortly.

Just getting word a short time ago that singer David has been arrested charge with first degree murder in the death of fourteen year old Celeste Rebus Hernandez, was found in his vehicle in the trunk of his Tesla last September. Robes. We hear a lot of attorney statements, right, and this is one of them. On the stronger side. After he was arrested, his attorneys did come out and say, absolutely, this is pretty unequivocal to me. He had nothing to do with this.

Speaker 2: Yes, they said, let us be clear, the actual evidence in this case will show that David Burke did not murder Celest Reeves Hernandez, and he was not the cause of her death. There has been no indictment returned by any grand jury in this case, and no criminal complaint filed. That was at the time of his arrest. That obviously has changed. The criminal complaint has now been filed. They went on to say David has only been detained under suspicion we will vigorously defend David's innocence. I am wondering, and this is often a tactic by the district attorney's office. By having these special circumstances, by announcing to all of us that the death penalty is on the table, that can provide a negotiating leverage for the district attorney's office, meaning that someone who might be charged with something this significant, who is potentially facing the death penalty, might be more willing to plead guilty if you could take the death penalty off the table.

I don't think his attorneys what Traditionally we have seen most attorneys in a high profile case like this don't stay quiet until the trial. They come out and we'll hear something, but they have to mount some kind of a defense of this guy, and maybe in the public but right now this all looks awful.

Well, the district attorney said there is physical evidence and forensic digital evidence linking David to murder charges, not just because he's also being charged with lud and lascivious acts. He's also being charged with mutilating a body. So there are plenty of other charges beyond the first degree murder charge. But they say that the totality of the evidence is there smoking gun, and they feel confident that it will be proven beyond a reasonable doubt in court.

Speaker 1: Look, give them credit for where they've got an investigation. This was high profile and they knew a lot of people were waiting on answers of some kind. There's been plenty of I wouldn't say leaks, there's been plenty of speculation because a lot of folks have popped on the internet and trying to piece it together, and it was it looks like a lot of folks on the internet were correct and trying to go through and piece together the relationship between David and this fourteen year old girl, and pictures were coming up and folks started making the connection. So with all of that going on, rogues, we didn't know what to believe and which of that stuff was true, And there's plenty of tabloid stuff. And the police chief spoke on that. That was almost one of the first things. He started in a defense almost of how they did it, and this is why we did it, because we wanted to get this right.

Speaker 2: He Look, they're very well aware of all of the speculation and certainly some news reports out there that the district's attorney's office was at odds with the police department, who was at odds with the medical examiner's office, and that nobody was working together. There was a lot of infighting. They tried to put that all to bed and say, wasn't true. We've been working in tandem this entire time. A case like this requires that we keep things close to the best, that we make sure leaks aren't happening, and that's what we did because we want to present this case in a court room at trial, not for public opinions. So yes, they all got up and said we're all getting along. We've always been working together. Everything's good. They wanted to make sure they tried to put some of that or those rumors to bed.

Speaker 1: Well, it was clear that it got to them, and it was important enough for them to say that today. And that's fine. That's the kept it quiet, and there were very few weeks of official information, so I give them credit for that. But what a turn, what a story, and what right now has been at least the conclusion to this point that after a body of a fourteen year old girl was found in the trunk of a car, you know what? This is the other you know what? Rubes again, he is not guilty, but that added element they're talking about now that he could actually have done this, left the body on the street in the car, and then went out and performed in front of people, went out on tour. And I don't understand that at all, just from a trying to get away with the crime part, but just how do you get in front of a crowd and perform with this on your brain?

Speaker 2: And they were asked specifically if there were accomplices, if they believe that he had help, and as it stands right now, the answer was no, there is no one right now being considered for charges. They did also ask anyone, hey, if you have information about this crime, please we want to hear The investigation continues, so they didn't say that it isn't possible going forward that someone else could be arrested, but they certainly didn't seem like there was anyone else they were looking into to charge at this point. Right now, it seems as though he acted alone, which is also pretty remarkable given what we know the outcome was, so we will, of course stay on top of this. We're also expecting to potentially hear from Celeste's family members. They had said that they wanted to speak out once charges were filed, if charges were filed, so we will stay tuned for that, and certainly this Corners report that we are anticipating as well, so please stay tuned to our feed because we will keep you updated with any of the new information that comes out today or in the days that follow, but.
