3.8 - New Regulations and Misrepresentations

Terance Gonsalves is a partner and chair of the education practice at the law firm of Alston and Bird.   1. Gainful employment regulations require career programs to meet metrics showing graduates find jobs and repay loans. They protect students and were reinstated, effective July 1, 2023.

  2. Programs may be cut if they don't meet metrics. But enrollment may stay stable as schools change programs.

  3. Regulations mandate reporting, like telling students if they didn't meet metrics. Students must acknowledge this. Some programs like culinary schools may struggle as grads often start in low-paying jobs.

  4. Training and empowering admissions advisors is key. Advisors need tools and knowledge for effective, compliant talks with students. They monitor call quality and build rapport to understand needs and guide students.

  5. Advisors are essential to a school's success. Resources and support help them guide students to good outcomes, benefitting both.
