“The Trial Of Sean Combs” Episode Eleven | “The Punisher” Testifies

This is the Trial of Shawn Combs. Let's get started, and this is the eleventh episode in the Trial of Sean Combs. And today May twentieth, we're going to pick up where we left off yesterday, and that was with the testimony of David James, who was a former personal assistant to Shawn Combe's and he is back on that witness stand and right out of the gate, the prosecution asked about the drugs that Diddy traveled with, and David James he testifies that Shawn Combs traveled with a large supply of prescription and illegal drugs, including pills that were stamped with President Barack Obama's face on them, which I didn't see that one coming, y'all. And if you'll remember, David James testified yesterday about preparing writers for Diddy, for hotels and for dream rooms, et cetera. And in today's testimony he got a little more specific with that, as I had hoped that he would. He testified that he

2:56 would primarily prep the hotel rooms that Combs stay in, and he went on to say that there were personal items, fresh underwear, socks, slides, iPads, various snacks including apple sauce, jello, and Fiji water. There was a toiletry bag also with forty different forty different cosmetic products, which James would set up on the bathroom counter for combs. There was also a medicine bag stocked with quote thirty five to forty different pill bottles, some of those unmarked. He were called seeing tailinol, advil, water pills to lose weight, viagra, and meds to increase his sperm count, as well as percocet and ecstasy. There was also a personal Louis Viton bag that James said Comb security would carry and depending on the date, James said it sometimes would hold ten thousand or more in cash inside of that Louis Vauton bag.

4:03 And of course, on yesterday's episode we talked about that a little bit. Remember they pulled that Louis Vauton bag out and fanned out nine thousand dollars in front of the jury yesterday. He also testified that he was reimbursed by Bad Boy Entertainment for expenses such as medicine and snacks, but for certain supplies such as baby oil, astrogloide, and condoms, he was told to be reimbursed by Combe's security staff, who would pay him cash out of that Louis Vauton bag. And that's for obvious reasons, right, did. He didn't want this paper trail of freak off items that he was purchasing at local drug stores. Right and after he was done discussing that, the topic of sug Knight came up again in this testimony. Now, now, if you will remember, Cassie Ventura testified about them being in a freak off.

5:06 At one point when they were in California, someone came in the room, I think it was one of the security and they said sug Knight was spotted at a diner in the area and she was real freaked out about it because his entorage was going after sug Knight, who was a big time rival of Seawan Comb's. Well. According to David James, who was also there, he testified about the exact situation, and he said Shawan Combs had three handguns on his lap when he ordered members of his entorage to go to Mels Diner in Los Angeles. This was early one morning to confront sug Knight. He said Combs demanded that James drive to the restaurant at around four o'clock am and then circle the block. After they failed to bot Knight's Cadillac Escalade in the parking lot, James said on the stand that quote, I remember thinking there's three guns and three people in this car. He went on to say that he recalled having a weird sense of calm during this ride with Combes and a security guard in the vehicle. And y'all, why is this relevant. Well, it speaks to the prosecution's theory that Comes had an army of enforcers, if you will, who enabled his violent and illegal conduct. It's as simple as that. It pretty

6:36 much transforms the case from a single person causing all this mayhem to an enterprise of people, if you will, And that's what you need when you have RICO charges against you. They have to prove this was a criminal enterprise. David James then describes a knight in two thousand and nine when Comes entered his La home in a rage over a blog post on a gossip site. James said he had the day off, but he was at Comb's estate and he was working on a research product which consisted of looking up possible tattoos online for Combs. James were called on the stand that Combs arrived at that home early in the morning, hours after a night clubbing, and he was upset over that blog post. Combs basically blined it straight towards James and looked up the assistant's search history on his computer. James said that Combs wanted to see whether James may have written that blog post that pissed him off so much. A few days later, James was given an assignment to deliver a meal from Roscoe's, which is a chicken franchise, and he was supposed to deliver that meal to Cassie Ventura at the London Hotel. Now, Vin Tara had been there about a week. When he arrived at the hotel, he was surprised to see that one of Comb's staff answered the door and not Cassie.

8:10 He even said on the stand, I was expecting to see Cassie. Now, why is this important because if you'll remember, in Cassie Venturi's testimony, she testified that comes beat the shit out of her at that London hotel, and the prosecution here is trying to paint a picture that while Cassie typically would answer that door, and that's what he was expecting because she was beat the shit out of, someone else answered the door. And at this point the prosecution they didn't have any further questions for David James, and it was the defense turn to cross examine him.

8:51 And at that point, Mark Agnofilio gets up and he approaches the witness box and he brings up Suge Knight and the incident that James just testified to and as you would expect, Agniphilo of course suggests that shud Knight and that whole incident didn't even happen, at least not in the way that Sean Combe's assistant David James remembered it. He asked James if he objected to going with Combs to look for Knight while Combs was holding those three hand guns. He actually said, quote, you didn't see a thing, and James responded with, quote respectively, sir, you have someone with three guns that close in proximity. I didn't think I had the option to say anything, which was a great answer in my opinion. He did agree with Agnaphillo that the incident was a radical departure from normal events during his time employeed by Combs and look. Agnaphillo was very aggressive as he cross examined David James about his account of the incident. Was shook Knight as a matter of fact, His demeanor with James was significantly different than his treatment of Carrie Morgan in her testimony yesterday. Actually, in that testimony, he periodically would apologize for having to ask her questions that many would deem disturbing. And I

10:22 think that's a little bit of what you can see as a difference between cross examining a female about those and cross examining a male about those instances. Remember, you start bullying a female on the stand and you're a male prosecutor, and it looks really bad to a journy. So some more details emerged regarding what it's like to be an assistant to Diddy during this testimony, and some examples of what James testified to while being cross examined include James admitting that he was prepped by prosecutors for the defence examination and that's totally normal, and of course did his defense knows this is totally normal. But it's a tactic that you present to a jury as a defense attorney to make it look like something shady's going on, even though that is normal in every case in the world.

11:20 He also gave more detail about how Combs ran his companies. He said he was involved with everything a micro manager James also said he wants worked twenty one day straight, and he credited that work ethic to being raised in Flint, Michigan. Another assistant, he said, once went to the hospital for dehydration after working a twenty four hour shift, and James said that Comb's security detail used to have a saying, quote, do you know what rhyme's with? Tired? And the answer was fired And we now know, thanks to ag a Fillo, that that apple sauce I mentioned earlier on Combe's hotel Riders.

12:05 The defense clarified that he liked apple sauce on his cheeseburgers, which yuck in my opinion. Does anybody out there listening actually eat apple sauce on their cheeseburgers? Am I'm missing out on something here. The defense also threw a major curve ball to James when out of the blue, they ask James if he ever choked Combe's personal chef, who the defense referred to as Chef Jordan, and James answered that he hadn't. The government at that point objected to that line of questioning, and after a brief sidebar, the defense was allowed to continue. So James said at that point that he was annoyed with the chef seeming to tell him what to do. He said, I grabbed the chef's wrist and told her to stay in her fucking lane, which totally in the defense then asked what consequences James faced as a result of the encounter, and James said that Combs asked him what happened. James told him his side of the story, and he said Combs them responded, you can't be putting your hands on women. Wow. If that ain't the pot calling the kettle black quote, you do it again and I'm gonna have to let you go.

13:25 James were called Combs telling him. He said Combs told him to write the chef a note and to get her a gift, so he did that. When he was asked what the gift was, James said, I rolled her a blunt Holy smokes. The defense then asked James about an encounter he had with Roger Bonds into female sex workers. Now Roger Bonds was a security guard for Combs. James said he was not aware at the time that the women were sex workers. He said he and Bonds met these women for drinks and dinner at a hotel and they were having good conversation, he said. They brought them back to Combs' home, which Comebs was not there at the time, and after they had what he called relations, James said, Bonds told him to pay one of the women two hundred dollars. However, James did not part with that money for long. Prompted by the defense, he explained that the night ended with the woman he was with wanting to take a shower, which he said he charged her two hundred dollars for the shower and that actually made agna Fhillo laugh and he responded with so you got your money back, And with that the defense was done and it was time for some reduract with the prosecution of David James. They wanted to clarify this chef situation, and the prosecution asked if Sean Comes himself ever got

14:57 violent with that personal and James replied that there was an incident at Combe's New Jersey home. James said that Combs instructed him to file a police report, saying that the chef was the aggressor in hit Comb's first He went on to say that he did not want to make a false police report, so he drove around New Jersey for an hour before returning to Combe's home where he lied and told Combs that he went and filed that police report. And with that, the prosecution released the witness and the next person called to the stand was Regina Ventura, who is the mother of Cassie Ventura. And Regina Ventur testified that she took out a home equity loan in twenty eleven for twenty thousand dollars to satisfy what she called a shakedown demand from Shawn Combe's because she believed he was going to harm her daughter, Cassie if she didn't pay that money. Now, this was after Cassie visited her mother home in Connecticut for the holidays with visible bruises on her body. Regina Ventura took photographs of all these injuries that were shown to the jury during her testimony, and she was quoted as saying during that testimony that she was very scared for her daughter's safety.

16:19 When pressed about what that twenty thousand dollars was for, she testified she wired it after that whole shit show with Kid Cutty went down when his car blew up. She testified that Sean Comb's at that point threatened to release sexually explicit videos of Cassie Ventura, and he sent that threat to Regina Ventura's email. She went on to say that that email about the sex tape release threats made her feel quote physically sick, and I mean, that's pretty damn low, in my opinion, to email someone's mother that threat about a sex tape. I mean, how much of an asshole do you have to be to do something like that. Regina Ventura also testified that her daughter first told her that Seawan Combs was physically abusive in December of twenty eleven. She said that Cassie emailed her and disclosed that as she was traveling home to Connecticut for Christmas that year. And incidentally, that twenty thousand dollars was like a penance that did he wanted Cassie's mother to pay to not release those sex tapes. He sent that money back a week later, according to Regina Ventura.

17:42 So at this point that was all the questions that the prosecution had for Regina Ventura, so it was the defense's turn to cross examine her. However, surprisingly the lawyer declined to cross examiner and she left the stand. And I can only surmise that they didn't want to paint a picture to the jury that they're beating up, for lack of a better term, Cassie Ventura's mother and putting her through hell on the stand, So they just chose not to even question her. And at that point, the prosecutors called the witness of the day in my opinion, and his name is Charie Haynes, fifty one year old.

18:24 He is a male exotic dancer from Harlem, which is where Diddy is from. And his stage name is The Punisher. And if you'll remember, I mentioned that name in a previous episode during Cassie Ventura's testimony. Now, Schari Haynes is bald, muscular guy. He's wearing a black suit and tie. He explained on the stand that his nickname was Punisher. Now. He said that nickname was given to him as a teen and was inspired by his style of play on the basketball court. He even has a website for his exotic dancing services, which is get Punished dot com. And there will be no doubt that that website's going to get millions of hits in the upcoming days. So he goes on to testify that his first freak off with Cassie Ventura and Shawan Combs took place in twoenty and twelve, and he initially thought he had been hired to perform a striptease in front of a group of friends. He said he was greeted at the door by Cassie Ventura, who he didn't know at the time, and was asked to perform a quote sexy scene for her and her husband, which he said was a man he now understands was Comb's.

19:48 He said Combs sat at a table and he was naked except for a veil, and he described what comes looked like, and he said it was like a muzzl a woman would wear Combs frigging. He said he was instructed to have no communication at all with the man. He then testified that Seawan Combs would periodically give instructions during the freak off. He would tell Cassie Ventura to position her body a certain way or to move the lights. Hayes said he was given eight hundred dollars upon arrival, then was asked if he wanted to quote finish. He said he declined, saying he wanted to keep things professional, and he was given an additional twelve hundred dollars and He testified that at that time he didn't recognize Sean Comb's or Cassie Venture during that first encounter, but he learned of their identities when he was booked for another freak off session. This time it was at the Essex House hotel in New York. He said that when he turned on the TV in the hotel room while waiting for the session to start, a welcome screen appeared, and on that welcome screen it said, quote the Essex House would like to welcome mister Seawan Comb's. He said later he looked at Combe's Instagram account and he recognized Ventura in the photos as the woman he's been having relations with.

21:20 And it was at this point that the court broke for lunch, so they pick up after lunch in Charree Hayes' returns to the witness stand and he testified that he estimated he had participated in eight to ten of these freak offs, and he said they took place exclusively in New York when he was involved. He added that they could sometimes take multiple days and typically began around two or three am. So this testimony so far that the punishers is giving us is exactly what Cassie Ventura said, even how they approached these people when they first knock on the door, right, that's what you want to see consistency.

22:04 He also testified the freak offfs were fairly predictable affairs, saying the rooms were always dimly lit with electric candlelight in sheets covering all the furniture. He said participants would start seated on the couch and create a look by rubbing baby oil on each other. He said this would sometimes be followed by oral or penetrative sex. He said Shawan Combs would give Hayes and Cassie Venturre direction, adding that Ventura seemed to seek cues from Combs and sometimes would WinCE or sigh in response to the instructions. He did recall a time on the stand when Combs through condoms on the couch and said he was quote ready to see them fuck. Another time, Combs dropped a stack of money on the bed as Hayes and Van Terror had sex and expressed his approval. So at that point the prosecution they had no further questions, and defense attorney Xavier Donaldson he approachased the witness stand to perform his cross examination of the punisher, so he asked the punisher when he first got into his career, and Hayes testified that he began exotic dancing on Labor Day weekend in nineteen ninety five, and it was at that point that he noted that he was coming up on a big anniversary.

23:36 So you're talking thirty years. This guy's been an exotic dancer ever since he was twenty one years old. He said he had danced for hundreds of thousands of ladies over the past thirty years, including light dances, rubbing in what he called quote professional dry humps. Donaldson appeared to not understand the latter terms, so Hayes repeated it several times. Now, come on, Xavier Donaldson, you know what dry humping is. Hayes also testified that he wrote a self help book. I'm sorry, y'all, a lot of this trial is not funny, but this guy's testimony just is so off the rails.

24:23 He testified that he wrote a self help book about his experiences with a rectile dysfunction, and the name of the book was In Search of Freezer Meat. Hey said the book detailed his journey trying to cure his condition and that he tried to make light of the issue to make it relatable, saying on the stand, what's harder than I'm sorry, I'm not even going to cut this out, what's harder than freezer meat, explained the book's titled during crossing, I mean, you can't met that shit up, y'all. I'm sorry.

25:07 Hayes then said under cross examination that he would not have had sex with inter during the sessions if he thought she was uncomfortable. So we're gonna get back serious now because that serious comment. Donaldson asked, quote, there were no clues about any discomfort. Correct. He went on to say, that's based on your twenty five years of experience doing dry humping on hundreds of thousands of women, and Hayes responded back correct. And obviously the route Donaldson is going here is to refute Cassie Ventura's comments on how she hated free calls. He's basically asking this guy, did she appear uncomfortable? Was she having a good time? That sort of thing? And the guy said she did not appear uncomfortable.

25:58 So with that, the defense releases the witness. However, of course, the prosecution they're definitely going to redirect because honestly, they have a problem now because this guy is saying Cassie didn't mind any of us, and this is their witness, mind you. So they approach the witness box for redirect and they asked, quote, what made you think miss Ventura was enjoying herself? So Hayes describes performing oral sex on Ventura, after which he said she scooted towards him as if she were ready for intercourse. He said, Ventura also looked back at Combs as if to get his consent, and that's important, and Combs responded with quote, go ahead, enjoy yourself, and hay said, I assumed it was an enjoyable moment, but the fact that she turned around to look at Combs to get him to say go for it is important.

26:55 The prosecutor then asked if there were any other indications Ventura enjoyed herselves, such as noises, or if Hayes had ever had interactions with Ventura outside of the freakalls, and Hayes said he had not had any interactions with her. He didn't really comment about noises. He was quoted as saying, I had no reason to believe she was not engaged in what we were doing. So at this point the prosecution releases Donaldson, he leaves the witness box and they call their next wetness, which is Gerard Gannon. Now he's a special agent with Homeland Security, and he testified that he was tasked with planning the federal raid on Shawn Combe's mansion on Star Island in Miami, and he testified that the raid involved many more agents than usual due to the size of the twenty thousand square foot property and possibly armed security being there. They didn't really know what they were going to walk in on, he said, comes home with search at three or four PM, which he said isn't typical for such raids. He said the reasoning behind that was they found out Comes and his family were scheduled to take a trip out of the country that day, and if you'll remember, Combs was on a boat like in the middle of the ocean during this raid. But they found out about this information and they thought it was best to wait for him and his family to leave before they conducted that raid on

The prosecutor then asked to give some specific details regarding the raid, and Ganning testified that they used a tank to push open the gate to the home, and he also noted that using a tank was not unusual, nor was breaking the gate to get into the home. It seemed like the prosecutor here is trying to head off the defense because you know they're going to get up and they're going to start asking about all these things that appeared to be above and beyond what you would normally do at a raid. But he described what they did with that game as standard practice in the interest of gaining quick access to the property. Ganning was also asked by prosecutors to walk through some of the items that they found on the raid of Shawn Combe's Star Island home, and he testified that in the main bedroom's closets, federal agents found parts of an AR fifteen rifle and corresponding accessories, including red dot optic plates, which he said make the shooter more accurate, and then they presented some photos of the bedroom. It showed a column of shells with AR fifteen components, as well as platform high heels, sex toys, baby oil, lubricant, and lingerie. He also testified the gun parts with serial numbers that had been defaced were also recovered from Shawncombe's bedroom, and he went on to say the defacement typically occurs when the

29:56 gun holder wants to prevent law enforcement from being a able to trace the weapon to an owner. Gannon also reviewed two gun magazines that he said contained nineteen rounds in one and ten rounds in the other. And it was at this point that court recessed for the day.
