Seven Felonies: The Arrest of KJ Biermann

0:21 Hey everyone, and welcome back to Exposed Scandalous Files of the Elite. I'm your host, Jim Chapman. And today I am bringing you a story definitely from the elite in society. And I came across a story that I really did a deep dive into where in Fulton County, Georgia, a 15 year old is sitting in a regional youth detention center. He has a famous last name. His mother is Kim Zolciak, one of the originals on The Real Housewives of Atlanta, the E! Entertainment show. His father is Croy Beerman, who lined up for the Atlanta Falcons. The boy's name is Croy Jagger Beerman Jr., and most of the internet calls him KJ. And if you have any familiarity with who Kim Zolciak is, You're familiar with this kid. Now, I'm going to tell you what happened to him in just a second and what led me to do this podcast.

1:26 But before I do, for those maybe not familiar with Kim Zolciak, she was born on May 19th, 1978 in Pensacola, Florida, to a military family. She grew up in Connecticut. with her parents, Joseph and Karen, and an older brother, Michael. She attended East Catholic High School. This is in Manchester, Connecticut. She graduated in 1996. She studied nursing at the University of Connecticut and worked as a licensed practical nurse in Connecticut and later Georgia. Now at 21, she moved to the Atlanta area after her parents relocated there. She settled in what is known as the Roswell suburbs. and she became a young single mother. Now, Zolciak joined the original Real Housewives of Atlanta cast in 2008. She was 30 years old at that time, and she was a main cast member for five seasons. Very popular. Even after she left the show, she would return in a recurring role in season 10, and viewers wouldn't know her for her blonde hair, She had some aspirations to be a country singer and pop singer, and she had some pretty popular one-liners, if you will. Tardy for the Party was one of those, and that would lead to a spinoff called Don't Be Tardy for the Wedding, in which she was marrying a

3:02 football star by the name of Croy Bierman. Now, since then, she has done a lot. She has a fragrance line, a cosmetics line, a swimwear line that she has with her daughters, and she has pretty much been everywhere. Now, Kim had her first daughter, Brielle, at 18 years old. She got married in 2001, had a daughter named Ariana. And then she got divorced to her first husband in 2003. And the identity of Brielle's biological father has never been publicly confirmed by Kim. So she met and married Croy Bierman, a linebacker, in 2010 at a charity event. It was a big deal. It was, you know, they launched a freaking TV series together. So very popular. That was kind of her run was between 2010 and 2016. In September of 2015, she actually appeared on Dancing with the Stars. However, she had a mini stroke while on that show, and she seems to have been recovered from that for a long time now. But It was a big deal at the time. So there's a lot more that went on in her life that I'm not going to get into now because a lot of people have been asking me to do a series on her divorce from Corey Bierman because there's a lot involved in that. And I may do that. So I don't want to get too far

4:33 into that yet. But we'll get into what has happened as of late. As I told you, there's a 15 year old that happens to be her son sitting in jail right now. And we're going to get into everything that happened on September 3rd of 2026. A Fulton County jury, grand jury, returned a seven-count felony indictment. The charges include aggravated child molestation, aggravated sodomy, aggravated sexual battery, three counts of sexual battery against a child under 16, and false imprisonment. And the state says the alleged incident happened April 23rd, 2026.

5:15 At a Lifetime Fitness, this is in Alpharetta, Georgia, the complaining witness is also a teenager. KJ was 14 on the date that this incident was alleged. He was arrested August 17th, and he has been held responsible. without bond. So today I'm going to walk you through what we know. So you got two children, one gem, seven felonies, a famous family, and a statute written where the country was in a panic about super predators at the time. And that is causing a lot of debate currently. Now, Before we get into it, it's important to mention this is a pending case. KJ Bierman has not been convicted of anything yet. Second, the complaining witness is a minor, so I'm not going to name her throughout this podcast. And third, fame is not evidence, y'all. And that's very important. Kim Zolciak's Bravo history is not a fact in this indictment.

6:19 Corey Bierman's NFL career, not a fact in this indictment, has nothing to do with these charges that are pending. The divorce is not a fact in the indictment that I mentioned I may cover. I will talk about how celebrity kind of distorts a case because it does, but the family here is not a subplot of what occurred. Fourth, a grand jury indictment is not a trial. Now in Georgia, as it is in the rest of the country, a grand jury hears the state's story. The defense does not get to put on a case for a grand jury. Only the prosecution does. They basically get to show all their evidence that they have and that's it. There's no retort.

7:05 to that evidence like you have in a real trial. So that's important. A grand jury indictment doesn't necessarily mean someone is guilty. It just means probable cause is sufficient enough to believe you could get a guilty verdict if you took this to trial. So let me give you the complete background I have on this case. According to reports, Croy KJ Bierman Jr., the son of Kim Zolciak and former linebacker Croy Bierman, is the one at the center of this thing. And the complaining witness is a 15-year-old female classmate. Now, in the police account, She describes herself as his then girlfriend's best friend. She did tell police at one point they had been friends for some time and they had kissed consensually once before. Now, that prior kiss detail only matters in the context that the girl told police that and was honest about it. Of course, it doesn't mean what she alleges going forward that I'm going to tell you about is any less worse because they had a consensual kiss at one point in time.

8:21 So let's go back to the afternoon of April 23rd, 2026 at the Lifetime Fitness in Alpharetta, Georgia. Now the complainant said she ran into KJ at the gym cafe after a workout. He asked if she wanted to go to the co-ed sauna. That path to the co-ed sauna goes through what's known as a family locker room And that is where she claims the assault occurred. Not a random stranger attack, y'all. This is a friend of hers that she went to school with. According to this complaint, she said he started touching her. She said she said no repeatedly. She said he restrained her so she could not leave and he forced sexual contact anyway. Now, the later indictment treats it as non-consensual sexual acts, and they also add false imprisonment. And we'll talk about that later.

9:22 But the charge specifically are aggravated child molestation, aggravated sodomy, aggravated sexual battery, three counts of sexual battery against a child under 16, and false imprisonment. Now, child in the terms that we're talking about it in, is a statute word that Georgia uses. So I don't want people to think this is a six-year-old. She was a 15-year-old, but still a child under the statute of Georgia law. And the reason I make any sort of deal whatsoever about that doesn't make what happened any less horrific if it indeed happened. But I make a big deal of it because when you read a headline and it says child, where does all our brains go? Six year old, seven year old kid. She was 15 years old. Again, doesn't make it any less horrific if he forced himself on her.

10:19 So she made all these claims and things happened according to her and she left. She said the next day she skipped school and she started having a panic attack and she told her family about it and her family did what they should have done. They said, we're going to the hospital to get a forensic exam. This is on April 24th of this year. So when you go get these exams, there's nothing fun about this. She had to do a rape kit, very invasive to women, just horrible thing to have to go through. But a rape kit is performed and collected, and she also spoke with officers there. Now, I'm going to fast forward just for a second and say the kit was checked for male DNA in the areas she identified, which she reported as the mouth and genitals. And the results were no male DNA.

11:17 DNA was found. Now, some of the things she told police at the hospital, I've already told you about the consensual kiss that she told them about. She said she did not consent to sexual contact on April 23rd. She said she did not want a first sexual experience to be with her best friend's boyfriend. So apparently she was a virgin before this. And she also said that KJ Bierman had previously dated other friends of hers. So they knew each other pretty good, it sounds like to me. Now, you may be thinking, well, no DNA was found anywhere that this girl said He violated her, so that must mean the case is closed. But it's not really that simple, y'all.

12:05 Absence of male DNA could mean that there was no contact that leaves DNA, but it can also mean the contact did not leave enough to detect. It's possible. Now, what we also do not have from the press reports was whether any injury was documented. Did she have scratches on her from trying to fend him off and get him off of her? Whether any clothing was collected. I would be interested in knowing that. Was there any torn clothing? The full toxicology report. reports if anything was done there. The notes from the SANE nurse, which is the nurse that does those rape kits. How long after the alleged contact had she waited before she showered, changed, ate, or drank anything? And we don't even have a signed lab report.

12:57 And before everybody freaks out and says, well, somebody's hiding something here. Not necessarily. These are juveniles. Now he's being charged as an adult. We'll get into more of that, but these are still 50. This is still a 15 year old victim. And it's really hard to get any information on cases like that when it involves minors. So police get all this information and they start investigating things. And they learned that KJ had not scanned into the club that day, but they still put him inside that building, which, Their surveillance video inside of the building is what proved that.

13:38 Some other notable things that they see on the video that they have released, the surveillance from inside the gym. They see the two of them enter the family locker room together. So she's telling the truth about that for sure. They say they were in there about 30 minutes. A lot can happen in 30. That's a long time, y'all. 30 minutes of time inside of a locker room. They say at some point she comes out toward the lobby, apparently 30 minutes later, and that he goes toward the sauna and he's alone 30 minutes later. So certainly something happened in there. I think there's no debate about that at this point. I think the debate is, was it consensual or not? So They're investigating this case for the next four months, and you may say, why? Why are they taking four months? Well, they know they're dealing with people with means, meaning they can afford great attorneys, and they don't want to screw any of this up knowing that. Plus, this is a very high-profile case, right? People are watching, so they don't want to make any mistakes relative to this investigation. crossing all the T's, dotting all the I's.

14:55 Now we do have some of the investigative timeline that the police used when they were investigating this case. And on May 14th, that was their first attempt to reach Croy Beerman Sr., which is KJ's dad. On May 18th, an officer actually speaks with Croy Beerman, and he says he and Kim will discuss whether their son will talk to police. So the police reached out. Hey, we want to interview him. Someone saying that he did some horrible things to them in a gym, and we want to get his side of it. uh, Croy does the right thing. Okay. You don't go to the police station, even if you're innocent, it's not a good idea to go to the police station and just talk to police. Of course, he calls his attorney and he talks to his estranged wife and says, what do you want to do here? And so that's what he did. Then a long time passes June 24th, Jason Sheffield, the attorney that they hired calls the officer and says, I'm representing KJ. So after June 24th, this investigation is no longer a can we interview this kid type of investigation. It's become a lawyered up case. Anything else police wanted from KJ Bierman would have to go through Sheffield. Now, there is no public record that any there's no release whatsoever that I can find or that exist out there that says KJ ever gave a police interview.

16:28 You may say, well, why wouldn't he at least talk to police and put this thing to rest if he didn't do anything wrong? Trust me, any lawyer worth his salt is going to say you're not talking to police. You know, police use tricks sometimes, and you can talk yourself into a suspicion if you're not careful. Any lawyer, whether you're innocent or guilty, is going to say, you're not talking to police. So Sheffield would later say that the defense tried to put its own package, if you will, in front of the arresting officer. They claimed that KJ passed a polygraph and they said they had evidence of false accusations in the past by the same girl. And he said that he was certain there would have been no arrest if the detective had sat down with him.

17:19 That's the defense version of the last pre-arrest contact, if you will, between the parties at hand here. The police report excerpts in the press don't confirm, however, that these meetings happened. So you're going off of the word of the defense. And you got to be careful about doing that. Now, Sheffield later came up with a theory of motive. He said that this was a desperate cry for attention driven by KJ's past rejection of the alleged victim. So the whole motive there in his mind was KJ wouldn't date this girl. And she was so butthurt about this that she made this whole thing up. Of course, This is the defense saying this, and there's nobody else out there saying it that I could find. So after all of this, KJ Bierman Jr. is arrested. He's taken into custody on Monday, August 17th, 2026 in Alpharetta, Georgia. Now he's 15 years old at this time, but 14 at the time of the incident. Now the girl, remember, she's actually a year older than than KJ. She's 15. Of course, it's worth noting, but it doesn't play any bearing on this case. Doesn't matter who's older and younger if you were to force yourself on someone, but certainly worth mentioning. Now, the police did say upon arrest that KJ was charged as an adult,

18:51 and that is a big freaking deal that we're going to get into in just a little bit. Now, he was booked into the Fulton jail, and he was held without bond. Now, you may wonder, why was no bond or bail required? amount set. And the short answer is Georgia law treats both alleged offenses that he is accused of differently from most charges. Only a superior court judge may grant bail for aggravated sodomy and aggravated sexual battery, not a magistrate and not a juvenile court judge. And because KJ is between 13 and 17 and is accused of offenses listed in Georgia's juvenile code, The Superior Court has jurisdiction over those charges, the adult court. Now remember, being held without bond is not the same as having bail denied after a full court hearing. Based on court documents, it appears no bond was set, but that does not necessarily mean a Superior Court judge reviewed all the factors that go into that bail decision and formally denied bail.

20:04 What I mean by all that is it doesn't necessarily mean a judge has denied him bail at this point. It just means a judge has not reviewed it yet as of this point. So August 21st comes around and Kim Zolciak speaks out for the first time on this. And I'm going to quote a short article from USA Today about that. It reads, Kim Zolciak is speaking out for the first time after her son, Croy KJ Bierman Jr., was arrested for aggravated sodomy and aggravated sexual assault. The allegations being made against my son are nothing short of reckless and deeply troubling. He categorically denied ever being involved with this woman or engaging in that conduct that she has alleged. Zolciak, 48, said this in a statement to U.S.

20:58 on Friday, August 21st. My son voluntarily took a polygraph examination regarding these allegations and passed. Additionally, an examination was conducted and no DNA belonging to my son was found. The former Real Housewives of Atlanta star continued, false accusations can have devastating consequences not only for the person being accused, but also for genuine survivors of sexual assault and abuse. Every legitimate allegation deserves to be taken seriously and investigated based on facts and evidence. At the same time, no one should be publicly condemned for based solely on an accusation.

21:40 Zolciak then added, we remain confident the facts and evidence will establish the truth and we ask that people allow the proper process to take its course rather than spreading unproven allegations. According to a police report, the alleged incident took place on April 23rd in Alpharetta, Georgia. The minor victim, who has not been identified, reported an aggravated sexual battery and aggravated sodomy and was taken to the hospital. The police report notes the alleged victim was examined and test results found no evidence of male DNA involved. and her mouth or vagina. At press time, KJ is currently being held at the Metro Regional Youth Detention Center. KJ is one of the son's Zolciak shares with estranged husband, Croy Beerman, the Don't Be Tardy alum, and Beerman got married in 2011, and I'm not going to go through all of that.

22:37 She wrapped up that statement, y'all, with, no matter how old you get, you will always be my baby, my greatest blessing, and one of my proudest accomplishments. I'm grateful every day that I get to be your mom. So she's doing what families do, right? She's standing beside her son. And there are some questionable things here. Doesn't mean it didn't happen, but there are some questionable things. Now, one of the issues that I do have just looking at this from the outside, looking in is what were they doing in there for 30 minutes? If he hasn't, because he's claiming that he has done nothing with this girl, no sex, no nothing. What were they doing in there for 30 minutes? How come anybody hasn't come out and said that except for the victim? That would be good to clear up if you're innocent. So at this point, he's sitting in jail, and on September 3rd, a Fulton County grand jury indicts him. And Sheffield, remember, Beerman's attorney, he loses his shit on this, and he files a motion to have this whole deal moved to juvenile court, saying KJ should not be charged as an adult. Now, at the start of this, I told you there were seven felony charges. I've really focused on two of them, but I want to review KJ. The seven felonies. One is aggravated child molestation. Two, aggravated sodomy. Three, aggravated sexual battery. Four, five, and six are three counts of sexual battery against a

24:08 child under 16. And seven is false imprisonment. Now bring that up because the aggravated sodomy, aggravated child molestation, aggravated sexual battery, they are all counts that can land a 13 to 17 year old in adult court. And it's why KJ is being charged as an adult under Georgia law. So I'm going to cover another article quickly. This is by People Magazine. They put this out on September 9th that really breaks down this juvenile transfer request in an understandable way. And it reads, Kim Zolciak and Croy Bierman's son KJ Bierman is asking to be transferred to juvenile court after he was indicted on seven felony charges. The 15-year-old's legal team filed the motion to transfer his case to juvenile court for confidential proceedings on Tuesday, September 8th.

25:05 By asking the Superior Court, the adult court, y'all, to transfer his case, KJ, whose felony counts include aggravated sexual battery and sodomy, would no longer be tried as an adult and could potentially face a less severe sentence if he was found guilty. KJ's lawyer, Jason Sheffield, said that they plan to enter a not guilty plea to all of the charges at the arraignment, which is set for October 14th. And that's a long time to have an arraignment, y'all. Sheffield also said he planned to file a motion so his client can be tried as a juvenile. Quote, it's difficult to comprehend a 14 or 15 year old child can be held in detention for a month or longer simply waiting for a bond hearing. But that detention is a direct consequence of the detective's decision to arrest him on charges of this magnitude. On September 3rd, a Georgia grand jury indicted KJ on seven felony counts. The Real Housewives of Atlanta alum and retired NFL player's teenage son is facing charges. And I've already went through all that, so I won't do that again. After KJ was arrested, his mother issued a statement, which I read that statement first.

26:21 For You, where he categorically denied everything. And it finishes up saying KJ is one of six children Zolciak and Bierman share. The former couple, who are in the middle of a contentious divorce, also share sons Cash, twins Kaya and Kane. And Bierman also adopted Zolciak's daughter, Ariana and Brielle from a previous relationship. So that is the up to date information on that. So after reviewing all this, I got real curious about, okay, what can happen here to this kid in a worst case scenario and a best case scenario. Now in a worst case scenario, if KJ is convicted as an adult, Of these charges, according to Georgia law, well, the core aggravated sex offenses carry, get ready for this, life in prison, or a split sentence of not less than 25 years and not more than life, followed by probation for life. Y'all, these are treated as serious violent felonies as they should be. The 25-year prison floor cannot be suspended, stayed, probated, deferred, or withheld.

27:38 He would not be eligible for first-time offender treatment either. His own attorney said the court cannot probate any portion of the 25 years and that he would not be eligible for parole. So he would have to serve every day of each 25-year sentence. if the sentences ran consecutive. Now, false imprisonment is a separate felony. It's generally one to 10 years. If he were convicted on those multiple counts, a judge could run the sentences concurrently or consecutively. So concurrently means you're serving them at the same time. Consecutive means they're stacked. If you get two 10-year sentences and they run consecutive, that means you're doing 20 years. Concurrent means you're doing 10 years each sentence. but they're running at the same time, so 10 years total. A conviction would also trigger lifetime sex offender registration and the associated residency, employment, and contact restrictions. Now, Georgia does have a narrow exception that can reduce certain what they call close in age range charges for the sodomy slash child molestation. It can actually plead them down to a misdemeanor. when the victim is 13 to 15 and the defendant is 18 or younger, or no more than four years older than the victim.

29:00 And the charge is based here on the sodomy charge. KJ was 14, the alleged victim was 15, as you may remember me saying earlier. However, the exception does not apply when the state alleges force, lack of consent, physical injury, or false imprisonment. which are the facts charged in this indictment. So it ain't going to work for him. So to sum all that up, technically, K.J. Bierman, if he is charged as an adult, could, in a worst case scenario, get life in prison. In a best case scenario, 25 years in prison. if those sentences for those two serious felonies are ran concurrently. and not consecutively. If they're ran consecutively, he could get 50 years in prison, 25 years each on those. So to sum all that up, he is in a world of shit right now. Now, just before I was to wrap this one up, a shocking update came in on this case. And I do mean shocking.

30:08 You're not going to believe this. So just this past Friday, September 11th, A hearing on this case was held. During the hearing, Deputy District Attorney Kaitlyn McGillicuddy shocked everyone when she mentioned that investigators previously found videos on KJ's cell phone that allegedly depicted him having penetrative sex with a family member. under the age of 12. McGillicuddy said there were multiple encounters on video that were discovered on the device and that they allegedly showed KJ using predatory derogatory language toward the victim. So basically this revelation in court is accusing KJ of already having on video Proof that he had sex with an underage relative multiple times. The prosecutor went on to say, quote, this would now mark the second time he has been charged with an offense of a sexual nature of a very serious kind, which involves female victims. She added that KJ was previously charged with sexual battery of a victim under the age of 16.

31:24 And she's talking about that family member. Nobody knew this ever happened. which this has not been publicly reported until now, obviously, because it was a case involving juveniles. McGillicuddy went on to say that KJ had been under court supervision for that since October of 2025, following the alleged incident with that family member, which she said was reported to police in April of 2023. So after that hearing, KJ's defense attorney, Jason Sheffield says, quote, characterizations made in court regarding the prior juvenile matter involving KJ Bierman are grossly misrepresenting both the facts and the ultimate resolution of that case. Sheffield went on to say the matter arose from inappropriate crew behavior and involving two middle schoolers. It did not result in adjudication for statutory rape, sexual intercourse, or any comparable offense.

32:24 He argued that any suggestion otherwise is inaccurate and creates a materially misleading impression of how juvenile matter was ultimately resolved. Sheffield asked that his client be released on this case on $ 65, 000. 00 and insisted that Zolciak, who is 48 incidentally, would monitor him as she is at home and not employed at the moment. McGillicuddy, however, noted that the victim in the sexual battery and sodomy case had suffered documented physical injury as a result of the incident, which she described as predatory. And they're talking about the health club incident. McGillicuddy added that if granted, bond be set at $ 190, 000.

33:06 So the prosecution wanted a $ 190, 000 bond. The defense wanted a $ 65, 000 bond. Big difference there, right? A statement from the victim in this case, the health club incident, then it was read aloud. She begged the judge to consider her safety before deciding whether to release KJ on bond. The victim said she had been living in fear over alleged threats that KJ would come after her were he to be released. Quote, no matter who these threats came from directly, I cannot just ignore them or assume that nothing will happen. I am not only scared for myself anymore, I am scared for my family too. Members of my family have received emails and phone calls because of this situation.

33:53 She added, the thought of him being released scares me more than I can put into words. KJ, who remained emotionless throughout the hearing, had the support of his parents and 29-year-old sister Brielle Bierman as they sat in the courtroom gallery. Zolciak, who looked stone-faced, and Brielle arrived and sat together. while a stressed-looking Croy, according to reports, arrived solo and sat a row in front of them. Now, the judge did rule on this case on September 11th and set a bond of $ 200, 000. But it has a lot of special conditions. First, 24-hour action. house arrest and GPS monitoring. That means he's got to stay at his mom's Alpharetta home and wear a GPS ankle monitor. He is only permitted to leave the home for pre-approved medical appointments and scheduled court appearances. Also, virtual schooling only. He has to complete his education entirely online from home. There can be no minors in the home. Anyone under the age of 16 is completely barred from staying at or visiting the residence. And this restriction means his younger siblings cannot reside in the home while he's living there. There's also a device and social media ban. He's basically prohibited from using cell phones or accessing social media platforms of any kind. And of course, he's got to surrender his passport for obvious reasons. They don't want him leaving the country.

35:21 So some shocking stuff coming out just a few days ago. Who knew this kid already had a prior with a family member? Allegedly, according to what was said in court, which, you know, it's not really alleged when it's said in court. It's said as fact at that point. We don't know the details of that, but that sure paints a different picture to me anyway on whether it's possible this girl could be telling the truth when you've already got an offense saying you did the same thing or similar thing. We'll see. And that is where we're at in that case. I'll keep you posted, of course, as things come out. Now, I have had a few people message me wanting an update on the Nolan Wells case, and there's not been much on that. Most recent thing I have seen. was Nancy Grace doing what Nancy does, right? Sensationalizing everything in this particular case and making a huge deal out of the fact that in the last six years, no one has drowned on Horn Island, which means seven years ago, someone drowned. She's like, why? What's going on? I can't mimic her voice. I was almost going to try to do that, but nobody can do that with Nancy Grace.

36:40 But she wants to know why No one's drowned in the last six years. Well, someone drowned seven years ago, Nancy. So that tells me that you can drown on Horn Island, but it really means nothing. Her question was why now? My answer to that is who knows, but to act like it couldn't happen just because it doesn't happen every year. That's just dumb to me.
