Understanding the role
In most FCA-regulated firms, the Chief Compliance Officer or Head of Compliance holds SMF16 – Compliance Oversight.
What should a CCO be responsible for?
A strong compliance leader will typically:
- Develop the firm's compliance strategy and risk framework.
- Lead and develop the compliance team.
- Oversee compliance monitoring and regulatory change.
- Report significant risks and findings to the board.
- Manage FCA relationships, supervisory requests and notifications.
- Oversee Consumer Duty obligations and relevant board reporting.
- Advise senior management on regulatory risks, new products and business growth.
The individual must be able to challenge senior colleagues while understanding the commercial realities of the business.
Should the CCO also be the MLRO?
In smaller firms, it can be appropriate for one person to hold both SMF16 Compliance Oversight and SMF17 Money Laundering Reporting Officer.
However, the individual needs genuine financial crime experience and sufficient capacity to fulfil both responsibilities.
In larger firms, or businesses with higher financial crime risks, such as payments, crypto and wealth management, the roles are often separated.
Getting this structure right is an important part of defining the recruitment brief.
Permanent, interim or fractional recruitment
Not every business needs the same employment arrangement.
A permanent CCO is appropriate when a firm needs an established compliance leader to build and manage its function.
An interim appointment can provide immediate cover following a departure, during a remediation programme, or while a permanent search is underway.
A fractional SMF16 can suit a smaller business that needs experienced compliance leadership for one to three days a week.
The FCA's temporary cover arrangements also need careful attention. Since 24 April 2026, firms have 12 weeks to submit an application for an individual providing qualifying temporary cover. The recruitment and approval process should therefore start promptly.
What makes a good compliance leader?
Technical knowledge is essential, but successful candidates also need:
- Experience in the firm's particular regulatory sector.
- Confidence presenting to boards and challenging executives.
- Strong leadership and team-building skills.
- Practical experience dealing with the FCA.
- Commercial judgement and an understanding of business risk.
- A suitable regulatory approval history, or evidence of readiness for their first SMF appointment.
The best candidate is not necessarily the person with the longest CV. It is the person who can take responsibility for the firm's compliance function and work effectively with its senior leadership.
How SMF Capital supports your appointment
We begin by understanding the firm's permissions, regulatory structure, reporting lines and requirements.
We then identify experienced compliance leaders, assess their technical and leadership capabilities, and present a focused shortlist.
We also consider the SMF16 responsibilities, any SMF17 requirements and the FCA approval process. The regulator can take up to three months to determine a complete application, so preparation matters.
SMF Capital recruits permanent, interim and fractional compliance professionals across payments, fintech, insurance, wealth management, investment management, consumer credit, lending and other regulated sectors.
Every search is overseen by Adrian Lawrence FCA, founder of SMF Capital.
