Norway Trial: Woman Tells Court She Woke to Sex as Høiby Denies Assault

In testimony given behind closed doors at Oslo District Court, a woman from Loeferton described the night she spent with Marius Boorghebi in October twenty twenty three, alleging that she woke to him having sex with her while she was asleep. According to the indictment, police believe a rape occurred in Hennings Fire during the night of Sunday, October eighth, twenty twenty three. Prosecutors alleged the woman was subjected to intercourse while unable to resist because she was not awake. Hoiby denies the charge, as well as three additional counts of rape without intercourse involving other women. The woman told the court that earlier in the nights, she and Hoeby had consensual sex several times. She says she was very tired and eventually fell asleep. The defense challenged inconsistencies between her earlier police interviews and her courtroom testimony, questioning whether the final act was involuntary and noting that she did not verbally object at the time. The woman responded that she did not say she wanted sex either, and that a sleeping person gives no indication of consent. Prosecutors also presented a five second video found on Hoybe's phone, allegedly filmed without the woman's knowledge, and pulse data from a smart watch she was wearing. The video was shown to the court but not to the press. The woman said she recognized herself in the footage but found it distressing to see. Prosecutors further presented data from the woman's fitness watch, arguing it supports their claim that she was asleep at the time of the alleged assault. According to the prosecution, the change in heart rate is the most decisive factor, said the state prosecutor. During the proceedings, the defenses rejected all rape allegations, maintaining that the encounters in question were perfectly normal and consensual sexual relations more in just a moment.

He described the situation as extremely uncomfortable and said the atmosphere in the court room was nerve racking, asking for understanding if his answers occasionally became disjointed. Oiby also gave new contacts for the Loferton trip itself, telling the courty came after a period of heavy party and substance use. He said Crown Prince Harken wanted to get him out of Oslo and suggested the trip, citing there shared interest in surfing. According to Hoibe, the invitation was direct, now we're going on a trip. Describing his first interactions with the woman he met via tinder, Weiby said she was very sweet and that the tone between them was pleasant. He told the court that she was, in his view, more sexually forward than he was accustomed to, though he stressed that this did not make him uncomfortable.

During questioning, Hoyby appeared increasingly irritated as the prosecution pressed him on the distinction between memory and assumption, particularly concerning whether the woman was awake during the final encounter. He repeated that he has never had sex with someone who was sleeping and said this is not something he has ever done. At several points he sought eye contact with his defense team as the questioning became more detailed. The court also heard further discussions of messages Hoiby sent to three friends in the early hours of the morning, shortly before the filming alleged in the indictment. While the existence and timing of the messages were already known, they were described in court as having a notably hard tone. After several hours in the witness box, Hoyeby asked for a pause, telling the court he was becoming very tired. With prosecutors indicating they would need additional time, the judge adjourned proceedings at three point thirty seven pm. Hoiby is scheduled to return to the witness box when the trial resumes earlier. Hoiby responded that while he does not believe it is acceptable to wake someone by having sex with them, he does not see a problem with waking someone through physical affection after consensual sex has already occurred. He denied the alleged victims claim that he had already penetrated her when she woke during the final encounter, stating that he had received no indication that the situation was anything other than positive. The prosecutor pressed further on this point, asking whether Hoybe believed it was acceptable to wake the woman by touching her breasts and genitals. Hoibi replied that he assumed she would wake as he touched her, and denied touching her while she was sleeping. He also stated that on another occasion, he had woken her by touching her shoulder. During this line of questioning, Hoybe was observed placing a small, pre packed pouch of moist tobacco in his mouth while continuing to answer questions. The prosecutor then turned to the five second video recorded on Hoibe's phone showing the woman's genital area. Weiby confirmed that the hand seen in the video was his, but said he could not remember when the recording was made or what its purpose was. He told the court it was impossible to determine from the video whether the woman was asleep, but maintained that she was awake and repeated that he did not engage in any sexual activity while she was sleeping.
