New Complainant Testifies in Oslo: Hotel Videos, Alleged Filming While Asleep, and Høiby Delays His Account

She told the court she felt herself becoming more passive as this situation continued. He would never finish, he wouldn't stop, she said. She described pretending to remain asleep as he got dressed to leave, waiting until the door closed before reacting, and then experiencing what she called panic. The court was told that investigators have recovered twenty seven videos and four still images connected to the hotel incident. According to the prosecution, some show her apparently awake and participating while others show her lying motionless. The recordings were made during two separate periods, between five seventeen and six thirty nine, and again around eleven eighteen. Several hours later. The woman told the court she had believed at most a couple of recordings existed and went into the shock when she saw how many there were during her police interview. The timeline around the hotel incident is also becoming a key issue for the prosecution.

The court heard that the woman had come to Oslo on a girl's trip and was invited to an after party by a well known reality television personality via Snapchat. She told the court that when she arrived only two people were there, the TV personality and Hoiby. During drinking games, she said, Hoyby asked to see photos of her to assess whether she had potential to earn money on only fans, and at one point began pulling down her top. She said she did not explicitly agree, but also did not stop him because she wanted to take part in the game.

3:18 She also described behavior she found striking throughout the night, that he repeatedly checked her mobile phone to make sure she had not taken pictures or video of him, and when asked how she believed he had taken cocaine at the party, she gave a very specific answer because he had a Louis Vuitton wallat with a small spoon inside that he used. Back in court, the digital evidence was again laid out in precise time blocks. The prosecutor said there are fourteen videos and three images recorded over one hour and twenty one minutes, followed by a gap, and then a further thirteen videos and one image just after eleven eighteen in the morning. The woman repeated that she had consensual sex at first, but that she never agreed to being filmed and never consented to any set to activity while she was asleep. She also described the moment he left the room. She told the court she pretended to stay asleep because she did not want to speak to him, and then when the door closed, she jumped up in panic. Because she was afraid he had taken her phone. She later found it hidden under a pillow behind the curtain. In a detail that would now become important for the defense case, she said a man who had been in custody with Hoyby told her he had boasted about filming her while she slept. Unlike other complainants, she was not initially identified by investigators. She told the court she came forward herself after reading in the media that image and video material had been found in the case.

She said seeing the recordings left her disoriented and described the period afterward as completely hellish. She also told the court she later met a man who said he had been in custody with her Hoyby, and claimed Toeby had boasted about filming her while she slapped. The man has not testified, and, according to her, did not want to get involved because he was afraid both of the police and of Hoibi. She told the court she believed that fear was connected to his status he is a certain type of power because of who he is. During cross examination, the defense focused on the timeline of her own understanding of events. She said she did not fully define it as an assault until she was in the police interview and saw the recordings.

Both sides agree there was consensual sex at the beginning of the encounter. The dispute is over what happened after she said she wanted to sleep, and whether she was capable of consenting more crown and controversy in just a moment. Hoibi had been expected to begin his own explanation of the hotel incident today, but when the judge asked whether he was ready to start, he applied, I am very tired and would like to wait until tomorrow. His full version of events now becomes one of the key moments for today's session.

6:08 In the meantime, the cross examination of the complainant moved into new territory, with the defense focusing heavily on what happened the day after the alleged assault. The court heard that she went on a Tinder date that same evening and confirmed under questioning that the meeting ended in consensual sex. She also later met the friend she had been with at the after party the night before. The defense then read from her original police interview where she had described the night with Hoybi as quote the adventure I was on last night. Hah asked in court whether it was correct that she had not yet taken in what had happened, she answered, I had not taken it in no. Pressed on why she did not react more strongly at the time, she told the court that when she woke up to him touching her, she froze and remained lying still. Why because they were scared, trunk and tired, she said. She also made clear that the fear was not because he had threatened her. The defense suggested that one of the videos showed her touching herself and asked whether that could be interpreted as an invitation to continue. Her answer was immediate no, After everything that had happened, that is not an invitation. She added that she does not remember doing it, and in one of the clearest consent lines of the day, she told the court we had no agreement that he could film me or touch me while I was sleeping.
