SUMMER OF FEAR, Part 5: Son of Sam at 73 — the Parole Hearing He Skipped, the Demon Dog He Admitted He Invented, and the Man He Blinded

The finale of the five-part series Summer of Fear. In May, David Berkowitz declined to attend his own parole hearing — his thirteenth since becoming eligible in 2002 — and emailed the New York Post to say he is already free, and that his home is in heaven, not in the Bronx. Robert Violante, who was twenty when Berkowitz shot him in the head and who has almost no sight left, was asked what he made of that, and he answered. Garret Fisher closes the week with the demon dog Berkowitz later admitted he invented, the Carr brothers who both died young, the reporter who spent his life chasing a cult through this case and what he got right about the cowardice of the men who closed it, and the fifteen young people whose names are the only reason any of this is worth saying out loud. Fifty years ago next Wednesday, Donna Lauria was killed in a parked car in the Bronx. Everybody remembers the killer. So on Wednesday, don't.Part 5 of 5. The complete series:

1
00:00:03.200 --> 00:00:13.599
Kalaroga Shark Media. Good morning. I'm Garrett Fisher, and this

2
00:00:13.640 --> 00:00:17.359
is Daily Crime Injustice for Friday, July twenty fourth, twenty

3
00:00:17.440 --> 00:00:21.039
twenty six, Part five of five. This is the last

4
00:00:21.120 --> 00:00:23.839
day of Summer of Fear. All week, I've been putting

5
00:00:23.879 --> 00:00:25.760
you on a street in a city that does not

6
00:00:25.879 --> 00:00:30.120
exist anymore, a bankrupt New York, a burning New York.

7
00:00:30.760 --> 00:00:34.439
Five thousand police officers laid off garbage in the street,

8
00:00:34.479 --> 00:00:37.159
sixteen hundred and twenty two murders in a single year,

9
00:00:37.479 --> 00:00:39.920
and a pamphlet with a skull on the cover that

10
00:00:39.960 --> 00:00:43.560
the cops handed to tourists at the airport. Today, I'm not

11
00:00:43.719 --> 00:00:48.119
taking you anywhere today. It is the present tense for real.

12
00:00:48.520 --> 00:00:51.159
And we are going to Ulster County, New York, about

13
00:00:51.240 --> 00:00:54.399
sixty miles north of the city, to a maximum security

14
00:00:54.439 --> 00:00:58.119
prison called Shaowan Gung. There is a room in there

15
00:00:58.159 --> 00:01:02.200
where the parole board meets. This past May, that board

16
00:01:02.280 --> 00:01:04.760
was scheduled to consider the case of an inmate named

17
00:01:04.879 --> 00:01:09.000
David Berkowitz for the thirteenth time since he became eligible

18
00:01:09.079 --> 00:01:12.120
in two thousand and two, and on the day of

19
00:01:12.159 --> 00:01:15.400
the hearing he did not come. He sent an email

20
00:01:15.400 --> 00:01:18.120
to a reporter at the New York Post. Instead, he

21
00:01:18.200 --> 00:01:20.840
said he had opted not to attend. He said he

22
00:01:20.920 --> 00:01:23.920
had other things to do that he considered more meaningful.

23
00:01:24.439 --> 00:01:27.280
He said that he is already free, and that Jesus

24
00:01:27.319 --> 00:01:29.799
set him free, and that the only place he is

25
00:01:29.840 --> 00:01:33.840
looking forward to going is heaven. Here is the sentence.

26
00:01:34.239 --> 00:01:37.159
My home is in Heaven, not in the bronx. He

27
00:01:37.280 --> 00:01:39.920
is seventy three years old. He has been in prison

28
00:01:40.000 --> 00:01:42.640
for forty nine years. And one of the people he

29
00:01:42.680 --> 00:01:45.719
shot in the head read that in the newspaper the

30
00:01:45.840 --> 00:01:49.760
dog was a lie. Let's deal with the dog when

31
00:01:49.799 --> 00:01:52.120
they took him into the precinct in Coney Island on

32
00:01:52.159 --> 00:01:54.760
the night of the tenth of August nineteen seventy seven,

33
00:01:55.079 --> 00:01:57.560
and he sat down and confessed to everything inside of

34
00:01:57.560 --> 00:01:59.920
half an hour. What he told them was that his

35
00:02:00.000 --> 00:02:03.760
his neighbour's black Labrador retriever, was inhabited by a demon

36
00:02:03.879 --> 00:02:06.760
six thousand years old, and that the demon spoke to

37
00:02:06.840 --> 00:02:09.479
him through the dog, and that it demanded the blood

38
00:02:09.479 --> 00:02:12.439
of pretty young women, and that the neighbor, a man

39
00:02:12.520 --> 00:02:17.159
named Sam Carr, was the vessel for it. Son of Sam.

40
00:02:17.520 --> 00:02:20.120
That is what the name meant. A man in yonkers

41
00:02:20.120 --> 00:02:23.599
who owned a dog, and the world went completely insane

42
00:02:23.639 --> 00:02:26.280
over it. It is the reason this case is a

43
00:02:26.400 --> 00:02:30.800
legend and not just a tragedy. A demon dog. It

44
00:02:30.879 --> 00:02:34.719
went into every newspaper on earth. It went into books

45
00:02:34.719 --> 00:02:39.360
and movies and one hundred cheap paperbacks. Court appointed psychiatrists

46
00:02:39.400 --> 00:02:41.719
fought about it. Some of them thought he was a

47
00:02:41.840 --> 00:02:45.919
paranoid schizophrenic. Some of them thought he was faking. He

48
00:02:46.080 --> 00:02:49.159
was ruled competent, and he pleaded guilty, and it never

49
00:02:49.199 --> 00:02:51.759
got tested in front of a jury because there was

50
00:02:52.000 --> 00:02:55.159
never a trial. And then a couple of years later

51
00:02:55.240 --> 00:02:57.599
he told a psychiatrist that he had made the whole

52
00:02:57.599 --> 00:03:01.000
thing up. He has said it many time since, in

53
00:03:01.159 --> 00:03:04.800
many rooms, to many people. He has set it on tape.

54
00:03:05.240 --> 00:03:08.520
The demon was an invention. The dog was an invention.

55
00:03:09.159 --> 00:03:12.000
He constructed it because he wanted to confuse the police,

56
00:03:12.240 --> 00:03:14.000
and because he thought it might get him into a

57
00:03:14.080 --> 00:03:17.960
hospital instead of a prison, and because I think some

58
00:03:18.159 --> 00:03:21.520
part of a deeply unremarkable young man understood that a

59
00:03:21.560 --> 00:03:25.319
demon is a much better story than the truth, because

60
00:03:25.360 --> 00:03:28.960
the truth, by his own eventual account, is boring. He

61
00:03:29.159 --> 00:03:33.560
was rejected by everyone he ever approached. He was full

62
00:03:33.599 --> 00:03:36.599
of a rage he could not aim. He set fires,

63
00:03:36.960 --> 00:03:39.759
hundreds of them, more than fourteen hundred by the count

64
00:03:39.800 --> 00:03:42.240
in his own notebooks, because a fire is what you

65
00:03:42.360 --> 00:03:44.919
do when you want to be enormous and you are nothing.

66
00:03:45.759 --> 00:03:48.599
And then he bought a revolver and started shooting girls

67
00:03:48.639 --> 00:03:51.520
who did not know he existed. And he wrote it

68
00:03:51.560 --> 00:03:54.520
all down, and he waited for the newspapers to tell

69
00:03:54.599 --> 00:03:57.759
him he was real. There is no demon, there is

70
00:03:57.800 --> 00:03:59.800
no dog. There is a man who could not get

71
00:03:59.840 --> 00:04:02.479
a woman to look at him and decided the correct

72
00:04:02.560 --> 00:04:05.960
response was to kill six of them. Look, I'm gonna

73
00:04:06.000 --> 00:04:08.159
be honest with you. This is the part of every

74
00:04:08.199 --> 00:04:11.240
one of these stories that people do not want. They

75
00:04:11.280 --> 00:04:14.800
want the six thousand year old demon. They want the possession,

76
00:04:15.120 --> 00:04:19.360
the coven, the sign, the pattern, the thing behind the thing,

77
00:04:19.879 --> 00:04:22.199
because if there is a demon in it, then this

78
00:04:22.360 --> 00:04:25.800
is a story about evil, and evil is at least interesting,

79
00:04:26.360 --> 00:04:28.639
And if there is no demon in it, then it

80
00:04:28.720 --> 00:04:31.439
is a story about a lonely postal worker with a

81
00:04:31.519 --> 00:04:34.519
gun and about a city so worn down that it

82
00:04:34.519 --> 00:04:38.199
could not connect four shootings across two boroughs for eight months.

83
00:04:38.720 --> 00:04:42.720
And nobody wants that story because that story implicates the

84
00:04:42.759 --> 00:04:46.199
rest of us. In nineteen eighty seven, ten years in

85
00:04:46.480 --> 00:04:49.720
he became a born again Christian. He calls himself the

86
00:04:49.720 --> 00:04:53.199
Son of Hope. Now he runs a congregation inside that prison.

87
00:04:53.600 --> 00:04:56.560
He counsels inmates, He has written books and does not

88
00:04:56.639 --> 00:05:00.160
take a dollar from them, partly out of conviction and

89
00:05:00.199 --> 00:05:02.639
partly because the law they named after him would not

90
00:05:02.759 --> 00:05:05.680
let him anyway. And I want to be careful here,

91
00:05:05.959 --> 00:05:08.199
and I am going to be because this is the

92
00:05:08.240 --> 00:05:10.519
part where I am supposed to tell you what to think,

93
00:05:10.639 --> 00:05:13.199
and I am not going to I don't know if

94
00:05:13.199 --> 00:05:16.800
he means it. Neither do you. Nobody alive knows what

95
00:05:16.920 --> 00:05:19.279
is happening inside that man, and the people who are

96
00:05:19.319 --> 00:05:22.360
most certain about it in both directions are the ones

97
00:05:22.480 --> 00:05:25.319
I trust the least. What I know is that a

98
00:05:25.399 --> 00:05:28.519
conversion does not undo anything. It does not give Joanne

99
00:05:28.560 --> 00:05:32.240
Lomino her legs back, It does not give Robert Violante

100
00:05:32.279 --> 00:05:36.360
his eyes. Forgiveness, if it is coming, is not mine

101
00:05:36.360 --> 00:05:39.319
to hand out, and it is not yours. There is

102
00:05:39.439 --> 00:05:42.240
exactly one category of person on this earth who has

103
00:05:42.279 --> 00:05:45.879
standing to forgive David Berkowitz, and every one of them

104
00:05:45.920 --> 00:05:50.319
earned that standing in the worst way. There is coming up,

105
00:05:50.519 --> 00:05:53.800
two brothers named Carr, both dead inside of two years,

106
00:05:54.160 --> 00:05:56.199
and a reporter who spent the rest of his life

107
00:05:56.279 --> 00:06:13.160
on it. I have to tell you about the other

108
00:06:13.199 --> 00:06:15.720
theory because it has been alive for almost fifty years,

109
00:06:15.839 --> 00:06:18.160
and because you will go looking for it the moment

110
00:06:18.199 --> 00:06:22.959
this episode ends. Start with what is actually strange, because

111
00:06:23.120 --> 00:06:26.720
some of it genuinely is. The composite sketches from the

112
00:06:26.720 --> 00:06:29.600
different shootings did not look like each other, and several

113
00:06:29.639 --> 00:06:33.040
of them do not look much like David Berkowitz. Witnesses

114
00:06:33.079 --> 00:06:36.920
described a fair haired man on the night Stacey Moskowitz

115
00:06:37.000 --> 00:06:40.519
was killed. More than one person reported a yellow Volkswagen

116
00:06:40.560 --> 00:06:43.399
tearing out of the neighborhood with its lights off, driven

117
00:06:43.439 --> 00:06:45.240
by a man who did not match the person the

118
00:06:45.279 --> 00:06:49.439
police arrested. Ten days later. Casilia Davis told the Brooklyn

119
00:06:49.480 --> 00:06:53.160
District Attorney what she saw. The Volkswagen was in the file.

120
00:06:53.560 --> 00:06:56.560
It was all in the file, and the Brooklyn District

121
00:06:56.600 --> 00:06:59.560
Attorney took a guilty plea in about eight months and

122
00:06:59.600 --> 00:07:02.279
closed the biggest case in the history of that office

123
00:07:02.639 --> 00:07:07.000
without asking a single one of those questions in open court. Then,

124
00:07:07.120 --> 00:07:10.480
in February of nineteen seventy eight, six months after the arrest,

125
00:07:10.800 --> 00:07:13.600
a young man named John Carr was found shot dead

126
00:07:13.759 --> 00:07:16.480
in an apartment in mine at North Dakota. He was

127
00:07:16.519 --> 00:07:19.639
one of Sam Carr's sons. It was ruled a suicide,

128
00:07:19.720 --> 00:07:23.079
and people have argued about that ruling ever since. Twenty

129
00:07:23.120 --> 00:07:25.720
months later, his brother Michael Carr died when his car

130
00:07:25.759 --> 00:07:28.120
went into a street light on the West Side Highway.

131
00:07:28.680 --> 00:07:32.199
Both sons of the man Berkowitz named himself after both

132
00:07:32.319 --> 00:07:35.079
dead inside of two years of his arrest, both young.

133
00:07:35.680 --> 00:07:38.600
An investigative reporter named Mary Terry looked at all of

134
00:07:38.600 --> 00:07:40.680
that and could not let go of it, and he

135
00:07:40.759 --> 00:07:43.000
spent the next four decades of his life on it.

136
00:07:43.680 --> 00:07:47.160
He published a book called The Ultimate Evil. His theory

137
00:07:47.279 --> 00:07:50.120
was that Berkowitz was one member of a satanic cult

138
00:07:50.160 --> 00:07:53.079
that carried out the shootings together, that the car brothers

139
00:07:53.120 --> 00:07:55.480
were in it, that different people pulled the trigger on

140
00:07:55.560 --> 00:07:58.399
different nights, and that the thing ran far wider than

141
00:07:58.439 --> 00:08:02.120
New York. And starting in the nineteen nineties, Berkowitz himself

142
00:08:02.160 --> 00:08:05.920
began saying, yes, yes there was a cult, Yes he

143
00:08:06.040 --> 00:08:09.360
was there, but somebody else fired at Christine Freund. Yes,

144
00:08:09.439 --> 00:08:12.439
a man came in from North Dakota to shoot Stacy Moskowitz.

145
00:08:12.720 --> 00:08:15.759
He named the car brothers. He gave nicknames for the others.

146
00:08:16.519 --> 00:08:19.639
Now Here is where I put my cards on the table,

147
00:08:19.879 --> 00:08:23.079
and I want you to notice exactly what I am doing,

148
00:08:23.399 --> 00:08:26.000
because I'm going to give you both halves, and i

149
00:08:26.040 --> 00:08:28.639
am not going to pretend the second half is smaller

150
00:08:28.639 --> 00:08:32.720
than it is. In fifty years, not one other person

151
00:08:32.759 --> 00:08:35.679
has ever been charging connection with any of these shootings,

152
00:08:36.320 --> 00:08:40.279
not one. No physical evidence has ever tied another human

153
00:08:40.320 --> 00:08:43.399
being to a single one of them. Nobody has ever

154
00:08:43.440 --> 00:08:46.559
produced a body of proof, only a body of coincidence,

155
00:08:47.000 --> 00:08:50.200
and the sole source for the cult, the single well

156
00:08:50.279 --> 00:08:53.320
spring of the entire theory, is the testimony of a

157
00:08:53.320 --> 00:08:56.360
man who confessed to all eight shootings in half an hour,

158
00:08:56.879 --> 00:08:59.759
and who then told the world a demon dog made

159
00:08:59.799 --> 00:09:02.919
him do it, and who then admitted he invented the

160
00:09:02.919 --> 00:09:06.600
demon dogs specifically in order to manipulate the police and

161
00:09:06.639 --> 00:09:09.679
the press, and who then, once that was no longer

162
00:09:09.759 --> 00:09:13.799
useful to him, produced a cult. That's not a witness.

163
00:09:14.320 --> 00:09:16.519
That is a man who has learned that the story

164
00:09:16.639 --> 00:09:19.360
is the only power he has left, and who has

165
00:09:19.399 --> 00:09:22.360
now changed it three times, and who gets a visitor

166
00:09:22.399 --> 00:09:26.080
and a headline every time he does. Two young men

167
00:09:26.120 --> 00:09:28.960
with drug problems dying young in nineteen seventy eight and

168
00:09:29.120 --> 00:09:32.120
nineteen seventy nine in this country is not evidence of

169
00:09:32.159 --> 00:09:36.600
a conspiracy. It is a Tuesday eye witness. Composites that

170
00:09:36.679 --> 00:09:40.679
contradict each other are not evidence of multiple shooters. They

171
00:09:40.720 --> 00:09:44.240
are evidenced that terrified people at night are bad at faces,

172
00:09:44.440 --> 00:09:47.399
which is the single most replicated finding in the study

173
00:09:47.399 --> 00:09:50.639
of criminal evidence, and which has put more innocent men

174
00:09:50.639 --> 00:09:54.279
in prison than any lay a defendant ever told. So, no,

175
00:09:54.879 --> 00:09:57.720
I don't believe it. I have read Terry's book, and

176
00:09:57.759 --> 00:10:00.679
I have watched the documentaries, and I understand and exactly

177
00:10:00.720 --> 00:10:03.759
why it grips people. And I don't believe it. But

178
00:10:03.840 --> 00:10:06.360
I will tell you what I do believe, and it

179
00:10:06.440 --> 00:10:09.480
is worse, and it is the reason I have never

180
00:10:09.519 --> 00:10:12.559
been able to dismiss Morey Terry the way people expect

181
00:10:12.600 --> 00:10:17.000
me to. The Brooklyn District Attorney had Casilia Davis's statement,

182
00:10:17.279 --> 00:10:20.159
He had the Volkswagen, he had John Carr's name on

183
00:10:20.200 --> 00:10:23.720
his desk before Berkowitz ever pleaded, and he did not

184
00:10:24.120 --> 00:10:27.440
chase any of it, not because a cult got to him.

185
00:10:27.919 --> 00:10:29.799
Because the city of New York had been on its

186
00:10:29.879 --> 00:10:32.679
knees for a year, and a man was in custody,

187
00:10:32.840 --> 00:10:36.639
and he had confessed, and every question anybody asked from

188
00:10:36.639 --> 00:10:40.039
that point forward was a question that might unmake the answer.

189
00:10:40.720 --> 00:10:43.879
Nobody wanted more questions. They wanted the summer to end.

190
00:10:44.440 --> 00:10:47.919
That's not a mistake. That's a choice. And it is

191
00:10:47.960 --> 00:10:50.840
the same choice this city made in nineteen seventy five

192
00:10:51.159 --> 00:10:54.440
when it decided it could do without five thousand police officers,

193
00:10:54.840 --> 00:10:56.720
and the same one it made every time it told

194
00:10:56.759 --> 00:10:58.559
a nineteen year old girl to go cut her hair.

195
00:10:59.080 --> 00:11:01.799
You do the cheap thing that lets everybody feel finished.

196
00:11:02.360 --> 00:11:05.840
Mary Terry died in twenty fifteen. He was sixty nine

197
00:11:05.919 --> 00:11:09.039
years old. He spent his life on this and he was,

198
00:11:09.159 --> 00:11:12.000
in my judgment, wrong about the cult and right about

199
00:11:12.000 --> 00:11:14.840
the cowardice. And that is a terrible thing to be

200
00:11:15.159 --> 00:11:17.919
and I would not wish it on anyone. Two things

201
00:11:17.919 --> 00:11:20.519
did change, and I'll give the city both of them.

202
00:11:20.919 --> 00:11:23.720
James Justice, the detective who sat down with a stack

203
00:11:23.759 --> 00:11:26.559
of parking tickets, said years later that after this case,

204
00:11:26.840 --> 00:11:30.440
the precincts started talking to each other. The Burrows started

205
00:11:30.440 --> 00:11:33.519
talking to each other, the thing that let a man

206
00:11:33.600 --> 00:11:37.000
shoot five people in three attacks across two burrows without

207
00:11:37.039 --> 00:11:42.200
anybody noticing, got fixed slowly because of him. That is real,

208
00:11:42.399 --> 00:11:45.240
and it is the only good thing in this entire week.

209
00:11:45.840 --> 00:11:50.399
And that November Abraham Beam lost the mayor of the

210
00:11:50.440 --> 00:11:53.039
broke city. The man who stood in the wreckage of

211
00:11:53.039 --> 00:11:56.679
the blackout was finished, and a congressman named Ed Coch

212
00:11:56.840 --> 00:11:59.720
became Mayor of New York, having run like every single

213
00:11:59.720 --> 00:12:03.000
person in that race, on fear. And the murder rate

214
00:12:03.039 --> 00:12:05.679
did not go down. It went up. It kept going

215
00:12:05.720 --> 00:12:08.600
up for another thirteen years after they put David Berkowitz

216
00:12:08.639 --> 00:12:11.320
in a cell, and it peaked in nineteen ninety at

217
00:12:11.320 --> 00:12:14.120
more than twoy two hundred human beings in a single

218
00:12:14.200 --> 00:12:18.080
year in one American city, twenty two hundred. None of

219
00:12:18.120 --> 00:12:21.000
them got a nickname, none of them got three hundred detectives,

220
00:12:21.440 --> 00:12:24.559
none of them got a week of anybody's podcast. There's

221
00:12:24.600 --> 00:12:27.600
a playbook for this. We give a monster a name

222
00:12:27.639 --> 00:12:30.480
and a task force, and we let the ordinary dying

223
00:12:30.519 --> 00:12:33.000
go on in the dark, because the ordinary dying does

224
00:12:33.120 --> 00:12:38.279
not sell a newspaper coming up. A man who is

225
00:12:38.399 --> 00:12:59.240
already free and a man who cannot see David Berkowitz

226
00:12:59.240 --> 00:13:01.559
has been eligible for paroles since two thousand and two.

227
00:13:02.279 --> 00:13:04.360
He has gone in front of that board twelve times

228
00:13:04.440 --> 00:13:07.480
and been refused twelve times, and for most of those

229
00:13:07.559 --> 00:13:09.919
years he has told them plainly that he does not

230
00:13:10.159 --> 00:13:13.240
want it and does not deserve it, which the board

231
00:13:13.240 --> 00:13:17.159
has always found sincere and has never found relevant. This

232
00:13:17.360 --> 00:13:20.679
May would have been the thirteenth he didn't go. He

233
00:13:20.720 --> 00:13:23.559
wrote to a newspaper instead on the sixteenth of May

234
00:13:23.960 --> 00:13:27.000
and said his work is inside the prison with the

235
00:13:27.039 --> 00:13:30.679
men God has confined there, that they need guidance, that

236
00:13:30.720 --> 00:13:33.399
he is an elder and this is his calling. He

237
00:13:33.399 --> 00:13:36.000
said he was already free. My home is in heaven,

238
00:13:36.399 --> 00:13:39.600
not in the bronx. On the nineteenth of May. Three

239
00:13:39.679 --> 00:13:42.840
days later, a reporter went and asked Robert Violante what

240
00:13:42.919 --> 00:13:47.039
he thought of that. Robert Violante is sixty eight years old.

241
00:13:47.360 --> 00:13:49.399
He worked most of his life at a post office

242
00:13:49.399 --> 00:13:52.720
in Brooklyn, and he has retired now and about ninety

243
00:13:52.759 --> 00:13:54.840
percent of his sight is gone and has been gone

244
00:13:54.919 --> 00:13:58.000
since he was twenty. He lost the left eye entirely.

245
00:13:58.360 --> 00:14:01.159
He has spent forty nine years. Asked how he feels

246
00:14:01.159 --> 00:14:05.039
about David Berkowitz and what he said in substance is

247
00:14:05.080 --> 00:14:07.039
that it took some nerve for that man to say

248
00:14:07.039 --> 00:14:10.759
a thing like that, that he sincerely doubts David Berkowitz

249
00:14:10.799 --> 00:14:14.200
is going anywhere near Heaven, that there is exactly one

250
00:14:14.279 --> 00:14:17.440
destination waiting for him, and that he should count himself

251
00:14:17.519 --> 00:14:20.440
lucky he has not arrived there yet. I'm not going

252
00:14:20.440 --> 00:14:24.080
to editorialize on top of that. He earned every word

253
00:14:24.080 --> 00:14:26.240
of it in a parked car in Bath Beach at

254
00:14:26.279 --> 00:14:28.600
two thirty five in the morning, while a girl he

255
00:14:28.639 --> 00:14:31.600
had known for one evening died beside him. But I

256
00:14:31.639 --> 00:14:33.679
want to sit with the shape of it, because that

257
00:14:33.799 --> 00:14:36.799
is what this whole week has been about. One man

258
00:14:36.919 --> 00:14:39.799
is in a prison in Ulster County, at peace by

259
00:14:39.799 --> 00:14:43.000
his own account, with a congregation, telling reporters he is

260
00:14:43.039 --> 00:14:47.320
already free. The other man is in Brooklyn. He cannot see.

261
00:14:47.360 --> 00:14:50.080
He has never had one day off from this. He

262
00:14:50.120 --> 00:14:52.039
did not choose to be part of this story, and

263
00:14:52.080 --> 00:14:54.600
he cannot leave it. And every couple of years a

264
00:14:54.600 --> 00:14:56.960
newspaper calls him up to ask him how he feels

265
00:14:57.000 --> 00:14:59.799
about the man who blinded him, and he answers every

266
00:14:59.840 --> 00:15:03.080
time time, because if he stops answering, then the only

267
00:15:03.200 --> 00:15:05.399
voice left in the story is the one that fired

268
00:15:05.440 --> 00:15:08.919
the gun. Robert Violante has said that he carries the

269
00:15:08.960 --> 00:15:11.279
guilt of it, that if he had left the park

270
00:15:11.360 --> 00:15:16.080
five minutes earlier, Stacy might be alive fifty years. And

271
00:15:16.159 --> 00:15:18.080
the man who did it is the one who says

272
00:15:18.080 --> 00:15:21.279
he is free. So let's finish the way we should

273
00:15:21.320 --> 00:15:24.919
have started. Donna Lauria was eighteen years old. She was

274
00:15:24.960 --> 00:15:28.039
an emergency medical technician. She was killed on the twenty

275
00:15:28.120 --> 00:15:31.399
ninth of July nineteen seventy six in a car parked

276
00:15:31.399 --> 00:15:34.440
outside her own building while her father was upstairs waiting

277
00:15:34.440 --> 00:15:37.679
for her to come in. Christine Freud was twenty six.

278
00:15:37.960 --> 00:15:40.240
She had been engaged for a matter of weeks. She

279
00:15:40.360 --> 00:15:43.240
was killed on the thirtieth of January nineteen seventy seven,

280
00:15:43.399 --> 00:15:46.799
on her way to a dance. Virginia was nineteen. She

281
00:15:46.960 --> 00:15:49.320
was born in Bulgaria and her family got out with

282
00:15:49.320 --> 00:15:52.919
almost nothing. She was an honor student. She was killed

283
00:15:52.960 --> 00:15:56.000
on the eighth of March nineteen seventy seven, four hundred

284
00:15:56.039 --> 00:15:58.720
yards from her mother's kitchen, holding her school books up

285
00:15:58.720 --> 00:16:02.399
in front of her face. Valentina Seriani was eighteen. She

286
00:16:02.480 --> 00:16:05.960
wanted to be an actress Alexander Esau was twenty. He

287
00:16:06.039 --> 00:16:08.679
drove a tow truck. They were killed together on the

288
00:16:08.720 --> 00:16:11.919
seventeenth of April nineteen seventy seven, two blocks from her

289
00:16:11.960 --> 00:16:16.320
house on Easter weekend. Stacey Moskowitz was twenty years old

290
00:16:16.360 --> 00:16:18.240
and she was on a first date and she was

291
00:16:18.360 --> 00:16:21.679
killed on the thirty first of July nineteen seventy seven.

292
00:16:22.120 --> 00:16:24.960
And she was the last. And they are not all

293
00:16:25.000 --> 00:16:29.480
of it. Michelle Foreman was fifteen, Jody Valenti was nineteen,

294
00:16:29.960 --> 00:16:33.000
Carl Denaro was twenty and carries a plate in his skull.

295
00:16:33.759 --> 00:16:37.879
Rosemary Keenan was eighteen and drove the car. Donna Demasi

296
00:16:38.000 --> 00:16:41.519
was sixteen. Joanne Lomino was eighteen and has not walked

297
00:16:41.559 --> 00:16:46.120
since nineteen seventy six. Judy Placido was seventeen and said

298
00:16:46.159 --> 00:16:51.639
nothing for twenty two years. Salvatore Lupo was twenty, Robert

299
00:16:51.720 --> 00:16:55.440
Violante was twenty and cannot see. That is the whole

300
00:16:55.480 --> 00:16:58.600
of it. That is what a summer of fear costs.

301
00:16:58.919 --> 00:17:01.080
And it is not a move, and it is not

302
00:17:01.200 --> 00:17:04.240
a decade, and it is not a city. It is

303
00:17:04.359 --> 00:17:07.400
fifteen young people and the fifty years that came after

304
00:17:08.279 --> 00:17:11.599
next Wednesday is the twenty ninth of July. On that morning,

305
00:17:11.640 --> 00:17:14.279
it will be exactly fifty years since a man walked

306
00:17:14.319 --> 00:17:16.759
across a street in Pelham Bay with a paper bag

307
00:17:16.799 --> 00:17:20.000
in his hand, and since Donna Lourie's father came down

308
00:17:20.039 --> 00:17:24.400
the stairs. Everybody remembers the killer. That is the thing

309
00:17:24.440 --> 00:17:26.279
I said to you on Monday, and it is the

310
00:17:26.319 --> 00:17:28.200
thing I will say to you on the way out.

311
00:17:28.799 --> 00:17:34.680
Everybody remembers the killer. So on Wednesday, don't before we go.

312
00:17:35.599 --> 00:17:38.839
That's Summer of Fear, five days, one story. Thank you

313
00:17:38.880 --> 00:17:40.599
for staying with me on all of it. And if

314
00:17:40.599 --> 00:17:44.000
it did something for you, tell one person, not a post,

315
00:17:44.279 --> 00:17:47.759
a person, send them Monday's episode and let them start

316
00:17:47.799 --> 00:17:50.559
where you started in an airport in nineteen seventy five

317
00:17:50.920 --> 00:17:54.000
with a pamphlet and a skull on the cover. That

318
00:17:54.119 --> 00:17:56.279
is how a show like this one grows. And I

319
00:17:56.279 --> 00:17:59.519
would rather earn you than by you. If you're listening

320
00:17:59.519 --> 00:18:02.960
on spot, drop a comment, say one of their names.

321
00:18:03.319 --> 00:18:06.200
That's all. Pick one and write it down where other

322
00:18:06.240 --> 00:18:09.039
people can see it, because it cost you nothing and

323
00:18:09.079 --> 00:18:11.119
it is the only thing any of us can still

324
00:18:11.160 --> 00:18:14.079
do for them. Follow Daily Crime and Justice wherever you're

325
00:18:14.079 --> 00:18:18.319
listening and turn notifications on. Production is back from vacation,

326
00:18:18.640 --> 00:18:21.079
and we are back to the courts and the trials

327
00:18:21.160 --> 00:18:24.640
and the people of the system forgets. I'm Garrett Fisher.

328
00:18:24.839 --> 00:18:28.559
Wednesday is the twenty ninth Say Her Name until Tomorrow,

329
00:18:28.759 --> 00:18:32.839
Do Better. Daily Crime and Justice is an independent podcast

330
00:18:32.880 --> 00:18:37.200
produced by Calaroga Shark Media. This episode covers David Berkowitz,

331
00:18:37.279 --> 00:18:40.000
known as Son of Sam, who pleaded guilty in nineteen

332
00:18:40.079 --> 00:18:42.759
seventy eight to six counts of second degree murder and

333
00:18:42.839 --> 00:18:46.640
seven counts of attempted murder and is incarcerated at SHAWANNGNK

334
00:18:46.680 --> 00:18:50.200
Correctional Facility in Ulster County, New York. It draws on

335
00:18:50.240 --> 00:18:53.400
contemporaneous reporting from The New York Times, The New York

336
00:18:53.440 --> 00:18:56.400
Daily News, and The New York Post, New York State

337
00:18:56.440 --> 00:19:00.039
Board of Parole records, published accounts by David Abrahamson and

338
00:19:00.119 --> 00:19:04.240
Mary Terry, later documentary interviews with Berkowitz and with surviving

339
00:19:04.359 --> 00:19:08.400
victims an AI assisted research. We do our best to

340
00:19:08.440 --> 00:19:11.559
get it right, but we are a podcast, not a

341
00:19:11.599 --> 00:19:16.920
court room. Notes on accuracy, Berkowitz's statements about declining his

342
00:19:17.000 --> 00:19:20.920
May twenty twenty six parole hearing, and Robert Violante's response

343
00:19:20.960 --> 00:19:24.119
to them were reported by The New York Post following

344
00:19:24.160 --> 00:19:28.079
an email exchange dated May sixteenth, twenty twenty six, and

345
00:19:28.160 --> 00:19:32.880
an interview on May nineteenth, twenty twenty six, and have not,

346
00:19:33.079 --> 00:19:36.839
to our knowledge, been independently confirmed by a wire service.

347
00:19:37.680 --> 00:19:40.319
It is not clear from that reporting whether the board

348
00:19:40.400 --> 00:19:44.920
issued a formal determination in his absence. Ages given for

349
00:19:45.000 --> 00:19:49.759
Berkowitz and for mister Violante follow that reporting and Berkowitz's

350
00:19:49.799 --> 00:19:53.559
stated date of birth. Sources differ on the number of

351
00:19:53.599 --> 00:19:57.079
people wounded across the full series of attacks, with counts

352
00:19:57.160 --> 00:20:01.160
ranging from seven to eleven, and on whether Berkowitz's six

353
00:20:01.240 --> 00:20:06.599
sentences run concurrently or consecutively. Regarding the claim that Berkowitz

354
00:20:06.640 --> 00:20:10.160
did not act alone, no person other than David Berkowitz

355
00:20:10.200 --> 00:20:13.079
has ever been charged in connection with any of these shootings,

356
00:20:13.440 --> 00:20:16.559
and no physical evidence has ever linked another person to

357
00:20:16.680 --> 00:20:20.559
any of them. Berkowitz confessed to all eight shootings, later

358
00:20:20.599 --> 00:20:23.960
stated that his account of demonic possession was fabricated, and

359
00:20:24.039 --> 00:20:28.279
later still asserted the involvement of others. Those accounts contradict

360
00:20:28.319 --> 00:20:32.200
one another. John Carr's nineteen seventy eight death was ruled

361
00:20:32.200 --> 00:20:35.359
a suicide and Michael Carr's nineteen seventy nine death was

362
00:20:35.440 --> 00:20:39.240
ruled a traffic accident. The theories advanced by the late

363
00:20:39.319 --> 00:20:42.680
Maury Terry are described in this episode for context and

364
00:20:42.799 --> 00:20:46.839
are not endorsed by this program. Our criticism is directed

365
00:20:46.880 --> 00:20:50.039
at the conduct of the prosecution, not at any individual

366
00:20:50.039 --> 00:20:54.359
defendant beyond the one who pleaded guilty. This series discusses

367
00:20:54.400 --> 00:20:57.079
gun violence and the deaths of young people. If you

368
00:20:57.160 --> 00:21:00.000
are struggling, you can reach the Suicide and Crisis Lifeline

369
00:21:00.119 --> 00:21:02.799
in the United States by calling or texting nine eight
