Lindsay Clancy's Psychiatrist Cross-Examined, 14 Telemedicine Visits and Never in the Same Room, Sarah Boone's 13th Lawyer Won't File

Lindsay Clancy's Psychiatrist Cross-Examined, 14 Telemedicine Visits and Never in the Same Room, Sarah Boone's 13th Lawyer Won't File

Kevin Reddington cross-examined Dr. Jennifer Tufts on Monday, day ten of Lindsay Clancy's murder trial in Plymouth Superior Court. Tufts, the psychiatrist who treated Clancy from September 2022 through the day before the killings, testified that all fourteen of their appointments were by telemedicine and that she had never met Clancy in person until the trial. Reddington questioned her experience level, her online biography, her medication decisions, and what she knew of Clancy's care elsewhere. Tufts also confirmed she is a defendant in the medical malpractice suits Lindsay and Patrick Clancy have filed. Clancy has pleaded not guilty to three counts of first-degree murder in the January 2023 deaths of Cora, 5, Dawson, 3, and Callan; she does not dispute causing their deaths and argues she was not criminally responsible due to postpartum psychosis. Also: in Florida, Sarah Boone is serving life without parole for the second-degree murder of Jorge Torres Jr., who died inside a zipped suitcase in 2020. Her appeal, docketed in Florida's Sixth District Court of Appeal, is now with her thirteenth attorney, who has written that he will not file a reply brief or request oral argument.

1
00:00:03.200 --> 00:00:13.599
Caalaroga Shark Media. Good morning. This is daily crime and

2
00:00:13.800 --> 00:00:19.920
Justice from Calaroga Shark Media powered by AI. I'm Garrett Fisher. Tuesday,

3
00:00:20.079 --> 00:00:23.920
August eleventh, twenty twenty six. There is a question that

4
00:00:23.960 --> 00:00:27.000
got asked in a Plymouth, Massachusetts courtroom yesterday morning that

5
00:00:27.120 --> 00:00:29.879
I have not been able to stop thinking about. A

6
00:00:29.920 --> 00:00:32.719
defense attorney named Kevin Reddington was standing in front of

7
00:00:32.759 --> 00:00:37.119
a psychiatrist named doctor Jennifer Tuffs. Doctor Tufts treated Lindsay

8
00:00:37.119 --> 00:00:40.320
Clancy for four months. She was the last doctor to

9
00:00:40.320 --> 00:00:44.000
see her before three children died, and Reddington asked her

10
00:00:44.039 --> 00:00:48.000
about an advertisement a professional bio posted online in which

11
00:00:48.039 --> 00:00:50.799
doctor Tuft's described an interest in women's mental health and

12
00:00:50.840 --> 00:00:55.600
paranatal psychiatry from pregnancy through two years postpartum, and then

13
00:00:55.640 --> 00:00:58.280
he asked her how long she had been practicing independently

14
00:00:58.320 --> 00:01:02.880
when that bio went up. So he asked the obvious question,

15
00:01:03.479 --> 00:01:07.599
You advertise expertise in postpartum care with a month of experience,

16
00:01:08.040 --> 00:01:11.120
isn't that negligence? She said she did not believe she

17
00:01:11.120 --> 00:01:14.159
had been negligent. Look, I'm gonna be honest with you.

18
00:01:14.480 --> 00:01:17.040
I don't know what a jury does with that doctor

19
00:01:17.079 --> 00:01:20.239
Tuff's is not on trial in Plymouth. Lindsey Clancy is.

20
00:01:20.840 --> 00:01:23.319
The question in front of those jurors is not whether

21
00:01:23.359 --> 00:01:27.079
Lindsay Clancy's doctors were good enough. It's whether Lindsay Clancy

22
00:01:27.200 --> 00:01:31.040
was criminally responsible on January twenty fourth, twenty twenty three,

23
00:01:31.480 --> 00:01:34.640
when she took Cora, Dawson and Callen into the basement

24
00:01:34.719 --> 00:01:38.439
of their Duxbury home and strangled them with exercise bands.

25
00:01:39.079 --> 00:01:42.040
But you cannot separate those two questions cleanly, and the

26
00:01:42.040 --> 00:01:44.920
defense knows it, and yesterday the defense spent the whole

27
00:01:44.920 --> 00:01:49.040
morning proving it. Today, week three of the Lindsay Clancy trial,

28
00:01:49.120 --> 00:01:53.000
and the cross examination that packed a courtroom. Then down

29
00:01:53.040 --> 00:01:55.920
in Florida, a woman named Sarah Boone is serving life

30
00:01:55.959 --> 00:01:58.480
for a killing that was recorded on her own phone,

31
00:01:58.640 --> 00:02:01.120
and her appeal has been sitting in limbo for two

32
00:02:01.200 --> 00:02:05.560
years across thirteen different lawyers. The current one has told

33
00:02:05.599 --> 00:02:08.680
her in writing that he is not filing anything else.

34
00:02:09.000 --> 00:02:17.240
I'm Garrett Fisher. This is daily crime and justice. Before

35
00:02:17.240 --> 00:02:20.560
we get to yesterday, you need Friday because the cross

36
00:02:20.560 --> 00:02:23.479
examination only makes sense if you understand what the state

37
00:02:23.520 --> 00:02:26.240
put on the record first, and before any of that,

38
00:02:26.680 --> 00:02:30.840
the names. Cora Clancy was five years old, Dawson Clancy

39
00:02:30.960 --> 00:02:35.000
was three, Callen Clancy was an infant. They were healthy kids.

40
00:02:35.560 --> 00:02:38.639
Their pediatrician told the jury that Callen had no health

41
00:02:38.680 --> 00:02:41.919
issues at all, that Dawson had a peanut allergy and

42
00:02:42.000 --> 00:02:45.159
Cora had asthma, and that was the extent of it.

43
00:02:45.879 --> 00:02:49.319
Cora's preschool teachers described her as a sweet little girl

44
00:02:49.360 --> 00:02:52.400
who loved her little brother and liked to play with barbies.

45
00:02:53.439 --> 00:02:56.400
Dawson had started having harder drop offs at school in

46
00:02:56.439 --> 00:02:59.479
the fall of twenty twenty two, but nobody saw a

47
00:02:59.520 --> 00:03:03.560
reason for concern. Their mother has admitted that she killed them.

48
00:03:03.840 --> 00:03:07.080
What she has pleaded not guilty to is criminal responsibility.

49
00:03:07.719 --> 00:03:10.840
She faces three counts of first degree murder, and under

50
00:03:10.879 --> 00:03:13.759
Massachusetts law and under the law of every state in

51
00:03:13.800 --> 00:03:17.800
this country, she is presumed innocent until a jury says otherwise.

52
00:03:18.120 --> 00:03:20.960
That has not happened. Nothing you hear in the next

53
00:03:20.960 --> 00:03:26.080
twenty minutes changes that. On Friday, the Commonwealth called two psychiatrists.

54
00:03:26.639 --> 00:03:29.360
Both of them had treated Lindsay Clancy in the weeks

55
00:03:29.360 --> 00:03:32.680
and months before her children died. Both of them are

56
00:03:32.719 --> 00:03:36.439
also named defendants in the civil malpractice lawsuits that Clancy

57
00:03:36.479 --> 00:03:39.680
and her former husband Patrick have filed hold on to

58
00:03:39.800 --> 00:03:44.080
that because it matters. The first was doctor Aliah Goodhart

59
00:03:44.199 --> 00:03:48.120
from McLain Hospital, where Clancy admitted herself in early January

60
00:03:48.120 --> 00:03:52.000
of twenty twenty three for about five days. Goodheart testified

61
00:03:52.039 --> 00:03:55.000
that Clancy wanted to be weaned off an antipsychotic because

62
00:03:55.000 --> 00:03:57.800
it was interfering with her sleep, and that nobody at

63
00:03:57.879 --> 00:04:02.639
McLain observed signs of psychosis on cross Reddington pushed hard

64
00:04:02.639 --> 00:04:05.879
on what happened when Clancy walked out the door. Goodheart

65
00:04:05.919 --> 00:04:09.360
said the discharge was not against medical advice, that Clancy

66
00:04:09.439 --> 00:04:12.120
was urged to follow up with outside providers, and that

67
00:04:12.280 --> 00:04:16.160
she did exactly that. She made an appointment with doctor Tuffs.

68
00:04:16.600 --> 00:04:19.360
Reddington also asked Goodheart a question that is going to

69
00:04:19.439 --> 00:04:22.160
keep coming up in this trial, whether you are supposed

70
00:04:22.160 --> 00:04:27.360
to prescribe an SSRII, specifically sertraline to a patient who

71
00:04:27.439 --> 00:04:31.800
has bipolar disorder. Goodheart's answer was that it depends on

72
00:04:31.879 --> 00:04:35.040
what you're seeing when you see the patient. That's a

73
00:04:35.079 --> 00:04:38.120
real answer, and it's also exactly what a defense attorney

74
00:04:38.160 --> 00:04:41.240
wants to hear, because the theory in this case is

75
00:04:41.319 --> 00:04:45.720
that Clancy had an underlying bipolar illness nobody caught, and

76
00:04:45.759 --> 00:04:48.759
that the medication she got for depression made her worse

77
00:04:48.879 --> 00:04:52.639
instead of better. Then the state called doctor Jennifer Tuffs.

78
00:04:53.160 --> 00:04:56.480
Tuffs began treating Clancy in September of twenty twenty two.

79
00:04:57.319 --> 00:05:00.639
Clancy found her through an online search. She came in

80
00:05:00.680 --> 00:05:03.560
for anxiety about going back to work after Callen was born.

81
00:05:03.959 --> 00:05:06.920
That's how this started. A labor and delivery nurse at

82
00:05:06.959 --> 00:05:10.279
mass General for years, scared about returning to a job

83
00:05:10.360 --> 00:05:13.360
she was good at. What follows is four months of

84
00:05:13.360 --> 00:05:15.920
treatment record and the state walk the jury through all

85
00:05:15.959 --> 00:05:21.800
of it. September Zoloff prescribed therapy recommended a week later,

86
00:05:21.879 --> 00:05:24.600
she reports she hasn't taken it, but feels better anyway.

87
00:05:25.240 --> 00:05:30.920
October still significant symptoms. Tufts documents that she's depressed. Adavan

88
00:05:30.959 --> 00:05:34.240
added as needed. Later that month, a switch is proposed

89
00:05:34.319 --> 00:05:38.079
to boost par and hydroxyzine because those are considered safer

90
00:05:38.160 --> 00:05:43.279
and better tolerated. Clancy is apprehensive, but agrees November she's

91
00:05:43.319 --> 00:05:46.079
too afraid to start the bus par. Still on the adavan,

92
00:05:46.399 --> 00:05:51.439
mood documented as neutral and calm, no suicidal ideation, no psychosis.

93
00:05:52.240 --> 00:05:53.920
By the end of the month. She's enrolled at a

94
00:05:53.920 --> 00:05:57.160
perinatal health clinic on the South Shore. She's starting prozac

95
00:05:57.439 --> 00:06:01.439
and she's taking adavan and benadryl to sleep. Tuffs doesn't

96
00:06:01.439 --> 00:06:04.560
know whether the auta antaper they discussed is actually happening.

97
00:06:05.360 --> 00:06:08.759
December first, she's not doing better. The taper isn't working.

98
00:06:09.240 --> 00:06:13.360
She's now taking medications prescribed by the other clinic, transidone.

99
00:06:13.439 --> 00:06:16.240
She's tried remaran and been given sarah Quell, but hasn't

100
00:06:16.279 --> 00:06:20.120
started it. On the remarund she reports intrusive thoughts, a

101
00:06:20.160 --> 00:06:23.240
feeling that she was going to die. She denies active

102
00:06:23.279 --> 00:06:26.240
suicidal ideation, but she says she is close to it

103
00:06:26.319 --> 00:06:29.160
and that she feels very hopeless. And this is the

104
00:06:29.199 --> 00:06:31.399
part of the Friday testimony that I want you to hear,

105
00:06:31.560 --> 00:06:34.120
because Tuffs wrote it in her notes as a direct

106
00:06:34.199 --> 00:06:38.360
quote from her patient. Clancy said, I think it's my problem.

107
00:06:38.600 --> 00:06:42.240
I keep reaching out to different people. She was apologizing

108
00:06:42.480 --> 00:06:47.279
she was sitting in a psychiatric appointment, medicated, hopeless, describing

109
00:06:47.279 --> 00:06:50.800
intrusive thoughts, and she was apologizing for asking too many

110
00:06:50.800 --> 00:06:54.319
people for help. Tuffs suggested that one person should be

111
00:06:54.360 --> 00:06:58.639
managing her medications, which is the correct clinical instinct. Whether

112
00:06:58.680 --> 00:07:02.519
it happened is a different question Uestionin mid December, she's worse.

113
00:07:03.079 --> 00:07:07.920
Tuffs suggests a partial hospitalization program. On the sixteenth, Clancy

114
00:07:08.000 --> 00:07:10.600
reports she's very depressed during the day and has started

115
00:07:10.639 --> 00:07:14.560
having suicidal ideation. She goes to the emergency room at

116
00:07:14.560 --> 00:07:18.480
Mass General and declines impatient treatment. She tells Tough she

117
00:07:18.560 --> 00:07:21.079
has no plan to hurt herself, that what she has

118
00:07:21.160 --> 00:07:25.879
is a fear of never getting better. Lamc Tall is added. January,

119
00:07:26.000 --> 00:07:28.240
she goes to mclin to get off the Saraquell safely

120
00:07:28.439 --> 00:07:31.079
because she has become convinced the Saraquell is what's making

121
00:07:31.079 --> 00:07:35.399
her worse. She comes out on trazodone, adavan, and melatonin.

122
00:07:35.759 --> 00:07:40.120
No suicidal thoughts, no homicidal thoughts, no psychosis, but she

123
00:07:40.199 --> 00:07:43.600
says she feels numb and Tufft's testified that concerned her.

124
00:07:44.079 --> 00:07:47.120
She was still very depressed. The plan was to raise

125
00:07:47.160 --> 00:07:53.199
the trazodone and watch. January sixteenth, Clancy tells her doctor

126
00:07:53.279 --> 00:07:57.480
that bonding with her baby feels forced. January twenty third,

127
00:07:57.800 --> 00:08:02.319
the last appointment testified that Clancy's speech and dress and

128
00:08:02.360 --> 00:08:06.000
behavior were all appropriate. No deficits in her thinking, no

129
00:08:06.120 --> 00:08:10.800
suicidal statements, no homicidal statements, no psychosis, nothing that would

130
00:08:10.800 --> 00:08:15.720
have justified an emergency hospitalization under Massachusetts law. Tuffs also

131
00:08:15.800 --> 00:08:18.639
testified that Clancy's mood and effect had been documented the

132
00:08:18.639 --> 00:08:23.120
week before as depressed and flat. The next day, Cora, Dawson,

133
00:08:23.160 --> 00:08:26.279
and Callen were dead. That is the record the Commonwealth

134
00:08:26.319 --> 00:08:28.600
put in front of the jury, and you can read

135
00:08:28.639 --> 00:08:32.320
it two completely different ways, which is exactly why this

136
00:08:32.480 --> 00:08:36.440
trial is going to run another month. The prosecution reads

137
00:08:36.440 --> 00:08:38.559
it as here is a woman who was seen by

138
00:08:38.600 --> 00:08:42.200
a psychiatrist fourteen times over four months, who was asked

139
00:08:42.240 --> 00:08:44.919
at every single appointment whether she had thoughts of hurting

140
00:08:44.919 --> 00:08:48.360
herself or anyone else, who said no every single time,

141
00:08:48.679 --> 00:08:50.879
and who, on the day before she killed her children,

142
00:08:50.919 --> 00:08:56.960
presented as depressed but organized, coherent and appropriate, not psychotic depressed.

143
00:08:57.559 --> 00:08:59.919
The defense reads it as here is a woman who

144
00:09:00.080 --> 00:09:02.720
spent four months telling everybody who would listen that she

145
00:09:02.840 --> 00:09:06.240
was drowning, who was cycled through ten or more medications,

146
00:09:06.480 --> 00:09:08.639
who was so worried about being a burden that she

147
00:09:08.759 --> 00:09:11.679
apologized for asking for help, and who was still not

148
00:09:11.840 --> 00:09:14.279
better on the day she walked out of her last appointment.

149
00:09:15.240 --> 00:09:17.519
Both of those readings are supported by the same set

150
00:09:17.519 --> 00:09:21.559
of notes. That's the whole problem. One more thing from Friday,

151
00:09:21.639 --> 00:09:25.279
and it's not testimony. Before the afternoon session, with the

152
00:09:25.360 --> 00:09:27.639
jury out of the room, Reddington told the judge he

153
00:09:27.679 --> 00:09:30.159
had heard a prosecutor picked up on a hot microphone

154
00:09:30.159 --> 00:09:33.799
the day before, saying, in reference to his client, shut

155
00:09:33.840 --> 00:09:38.120
her up. That was Thursday, the day the medical examiner

156
00:09:38.159 --> 00:09:41.919
testified about Callen's autopsy, the day a court officer wheeled

157
00:09:41.960 --> 00:09:45.559
Lindsey Clancy out of the room while she sobbed. The

158
00:09:45.759 --> 00:09:49.039
judge wanted to handle it at sidebar. Reddington did not.

159
00:09:49.759 --> 00:09:53.600
He said so out loud in open court. Emotions in

160
00:09:53.679 --> 00:09:56.440
that room are running high, and they are running high

161
00:09:56.480 --> 00:10:09.559
in both directions. We'll be right back Monday morning, Plymouth

162
00:10:09.639 --> 00:10:13.399
Superior Court, Day ten. The line to get into that

163
00:10:13.440 --> 00:10:16.200
courtroom was longer than it had been on any day

164
00:10:16.240 --> 00:10:19.960
since Patrick Clancy testified. And Patrick Clancy is the father

165
00:10:20.039 --> 00:10:22.840
of the three children who died. That tells you what

166
00:10:22.879 --> 00:10:26.600
people understood was about to happen. Kevin Reddington got up

167
00:10:26.639 --> 00:10:29.240
to cross examine doctor Jennifer Tuffs, and he did not

168
00:10:29.360 --> 00:10:32.320
start with January twenty third, He did not start with

169
00:10:32.360 --> 00:10:36.080
the medications. He started with her resume. When did you

170
00:10:36.120 --> 00:10:39.039
become a doctor? When was your residency? When did you

171
00:10:39.039 --> 00:10:43.399
get board certified? Here's what came out. Tufts completed a

172
00:10:43.440 --> 00:10:46.960
four year residency at Boston Medical Center twenty eighteen to

173
00:10:47.000 --> 00:10:50.600
twenty twenty two. She was board certified in September of

174
00:10:50.639 --> 00:10:54.039
twenty twenty two. She started at a practice called Astor

175
00:10:54.080 --> 00:10:58.600
Mental Health that August. Lindsey Clancy became her patient in September.

176
00:10:59.120 --> 00:11:02.799
So Reddington asked the arithmetic question, you had been practicing

177
00:11:02.799 --> 00:11:04.919
as a psychiatrist for a little more than a month,

178
00:11:05.519 --> 00:11:08.960
and Tuffs corrected him carefully. She said she had been

179
00:11:09.000 --> 00:11:12.559
practicing independently with her full credentials for about a month,

180
00:11:13.159 --> 00:11:16.240
and she added that the training before that in residency

181
00:11:16.480 --> 00:11:19.840
was immense. That is a fair correction. By the way,

182
00:11:20.320 --> 00:11:24.519
a physician finishing a four year residency is not a rookie.

183
00:11:25.080 --> 00:11:28.480
She had been treating patients for years. What she had

184
00:11:28.600 --> 00:11:32.159
not been doing for years was making the call by herself.

185
00:11:32.759 --> 00:11:36.720
Reddington kept going, how many patients with postpartum depression had

186
00:11:36.759 --> 00:11:39.159
she treated in that month and a half at Astor

187
00:11:39.360 --> 00:11:44.120
Before Lindsey Clancy walked in answer, maybe a couple, but

188
00:11:44.320 --> 00:11:47.879
many during the residency. He pressed on that number. She

189
00:11:47.960 --> 00:11:50.639
said about fifty to four years at Boston Medical Center,

190
00:11:51.080 --> 00:11:54.399
and then he brought up the advertisement. Doctor Tuffs has

191
00:11:54.399 --> 00:11:57.799
a professional bio describing a particular interest in women's mental

192
00:11:57.840 --> 00:12:02.919
health and paranatal psychiatry, pregnancy through two years postpartum. That's

193
00:12:02.960 --> 00:12:07.120
how patients find a specialist. That's how Lindsey Clancy found

194
00:12:07.120 --> 00:12:12.360
her online search matching bio appointment made so. Reddington asked

195
00:12:12.360 --> 00:12:15.639
whether advertising yourself is an expert in postpartum care with

196
00:12:15.679 --> 00:12:19.679
a month of independent experience was negligence. She said she

197
00:12:19.799 --> 00:12:23.480
did not believe she was negligent. Then he moved to

198
00:12:23.519 --> 00:12:25.600
the thing that I think may actually stick with this

199
00:12:25.679 --> 00:12:31.200
jury longer than the credentials. Fourteen appointments four months. Every

200
00:12:31.240 --> 00:12:35.440
single one of them was telemedicine. Reddington put it to her, plainly,

201
00:12:36.279 --> 00:12:39.480
until you walked into this courtroom, you had never seen

202
00:12:39.519 --> 00:12:44.279
Lindsay Clancy in person, and doctor Tuff said, yes, that's correct.

203
00:12:44.879 --> 00:12:50.720
Fourteen video calls a patient with worsening depression, insomnia, intrusive thoughts,

204
00:12:51.120 --> 00:12:54.240
a fear of never getting better, cycling through a pharmacy's

205
00:12:54.240 --> 00:12:58.279
worth of medication, and the psychiatrist managing that had never

206
00:12:58.320 --> 00:13:01.080
been in a room with her. Now, I want to

207
00:13:01.120 --> 00:13:03.159
be careful here because I'm not going to stand up

208
00:13:03.200 --> 00:13:06.240
and tell you tell amedicine is the villain. Tell a

209
00:13:06.240 --> 00:13:09.440
psychiatry is how an enormous number of Americans get any

210
00:13:09.440 --> 00:13:12.000
mental health care at all. And for a mother with

211
00:13:12.080 --> 00:13:14.840
three kids under five, a video appointment may have been

212
00:13:14.879 --> 00:13:18.480
the only kind she could actually attend. The alternative to

213
00:13:18.519 --> 00:13:21.720
a video visit is very often no visit. But there

214
00:13:21.720 --> 00:13:24.519
is a difference between a tool and a substitute, and

215
00:13:24.600 --> 00:13:26.720
a jury in Plymouth is now going to sit with

216
00:13:26.799 --> 00:13:29.799
the image of a woman seen fourteen times by a

217
00:13:29.840 --> 00:13:33.159
specialist she found on a website through a screen, and

218
00:13:33.279 --> 00:13:36.480
never once in the same room. Reddington then asked her

219
00:13:36.559 --> 00:13:42.960
what therapy she actually provided, Not medication therapy her answer,

220
00:13:43.159 --> 00:13:45.759
and I'm quoting it because paraphrasing it would be unfair

221
00:13:45.759 --> 00:13:49.080
to her. I listen to her, listen to her concerns,

222
00:13:49.440 --> 00:13:53.559
provided hope. I'm not going to pretend that's nothing. Listening

223
00:13:53.600 --> 00:13:55.879
to a patient and giving her hope is a real

224
00:13:55.919 --> 00:13:58.480
part of the job. And any clinician who has sat

225
00:13:58.519 --> 00:14:00.840
with someone in the worst months of the will tell

226
00:14:00.879 --> 00:14:04.279
you it matters, but it is also and Reddington knew

227
00:14:04.279 --> 00:14:08.159
this a sentence a jury hears as thin. He asked

228
00:14:08.240 --> 00:14:12.000
what treatment she gave. She described a posture. There was

229
00:14:12.080 --> 00:14:14.799
one more line of attack, and it's the most technical

230
00:14:14.879 --> 00:14:19.120
and possibly the most damaging. Reddington asked about a specific

231
00:14:19.200 --> 00:14:23.559
postpartum screening instrument. Tufts testified she did not administer that one,

232
00:14:23.840 --> 00:14:27.039
that she used a different depression screening tool instead, and

233
00:14:27.080 --> 00:14:29.480
that she was not aware the postpartum screening had been

234
00:14:29.480 --> 00:14:33.440
given to Clancy elsewhere and had come back showing severe depression.

235
00:14:34.200 --> 00:14:37.919
That is the whole defense case compressed into one exchange.

236
00:14:38.000 --> 00:14:42.799
A result existed, it showed severe depression, and the psychiatrist

237
00:14:42.879 --> 00:14:46.480
managing her medications did not know about it. Now Here

238
00:14:46.559 --> 00:14:48.559
is the part that a lot of the coverage is

239
00:14:48.600 --> 00:14:51.000
going to scape past, and I don't think we should.

240
00:14:51.840 --> 00:14:56.159
Doctor Tufts and doctor Goodhart are not neutral witnesses. They

241
00:14:56.200 --> 00:14:59.519
are not disinterested experts flown in to explain a concept.

242
00:15:00.120 --> 00:15:03.440
They are the treating physicians. And they are both named

243
00:15:03.440 --> 00:15:07.519
defendants in civil malpractice lawsuits filed by Lindsay Clancy and

244
00:15:07.559 --> 00:15:11.080
by Patrick Clancy over these same four months of care.

245
00:15:11.840 --> 00:15:14.840
A criminal defense attorney in Massachusetts who is not involved

246
00:15:14.840 --> 00:15:17.320
in this case made the point publicly, and she's right.

247
00:15:18.000 --> 00:15:20.919
If you are a doctor facing a malpractice claim and

248
00:15:20.960 --> 00:15:23.360
you take the witness stand in the criminal trial, the

249
00:15:23.519 --> 00:15:25.919
version of events that helps you is the version where

250
00:15:25.919 --> 00:15:30.039
the patient was stable, appropriately medicated, and showing no warning signs.

251
00:15:31.039 --> 00:15:34.879
That's not an accusation of lying. It's a description of incentive.

252
00:15:35.360 --> 00:15:38.600
Every witness in every courtroom has one. Juries are entitled

253
00:15:38.600 --> 00:15:40.480
to know what it is. So when you hear a

254
00:15:40.519 --> 00:15:44.200
treating psychiatrist testify that there were no signs of imminent danger,

255
00:15:44.639 --> 00:15:47.320
you are hearing testimony from a witness who is also

256
00:15:47.559 --> 00:15:50.879
in a different courthouse defending herself against the claim that

257
00:15:50.960 --> 00:15:55.799
she missed the signs. That's not a conspiracy. That's the structure,

258
00:15:56.240 --> 00:15:59.960
and that's why cross examination exists. Here's what I can

259
00:16:00.120 --> 00:16:02.759
keep coming back to. There is no version of this

260
00:16:02.879 --> 00:16:06.240
case where somebody comes out looking good. If the jury

261
00:16:06.240 --> 00:16:10.320
decides Lindsey Clancy was criminally responsible, then a mother who

262
00:16:10.360 --> 00:16:13.320
asked for help fourteen times over four months killed her

263
00:16:13.399 --> 00:16:17.000
three children anyway and will die in prison. If the

264
00:16:17.080 --> 00:16:20.759
jury decides she was not criminally responsible, then she goes

265
00:16:20.799 --> 00:16:24.519
to a state psychiatric hospital, and the finding is essentially

266
00:16:24.600 --> 00:16:27.000
that the system had four months and every warning it

267
00:16:27.039 --> 00:16:30.960
needed and let it happen. Nobody was paying attention to her.

268
00:16:31.279 --> 00:16:34.879
That's the defense argument. And the uncomfortable thing about the

269
00:16:34.960 --> 00:16:37.600
last two weeks of testimony is how much of the

270
00:16:37.639 --> 00:16:41.879
state's own evidence sounds like it. Cross examination of doctor

271
00:16:41.919 --> 00:16:45.360
Tuff's was still underway when we recorded this. Judge William

272
00:16:45.360 --> 00:16:48.039
Sullivan told the jury to expect a full day. We'll

273
00:16:48.039 --> 00:16:50.320
have the rest of it for you more in a moment.

274
00:17:04.599 --> 00:17:08.400
Porgey Torres Junior died on February twenty fourth, twenty twenty

275
00:17:08.480 --> 00:17:12.079
inside an apartment in Orange County, Florida, in the Orlando area.

276
00:17:12.519 --> 00:17:15.240
He was found dead inside a suitcase. He had been

277
00:17:15.279 --> 00:17:18.119
in that suitcase for hours. We have not covered this

278
00:17:18.240 --> 00:17:20.519
case on this show before, so let me give you

279
00:17:20.559 --> 00:17:23.759
the whole thing, and let me start where I always start,

280
00:17:23.839 --> 00:17:27.680
which is with the man who died. Jorge Torris Junior

281
00:17:27.720 --> 00:17:31.119
was somebody's son. He shares his father's name. He had

282
00:17:31.160 --> 00:17:33.839
a family that sat in an Orlando courtroom in twenty

283
00:17:33.920 --> 00:17:36.119
twenty four and had to listen to a recording of

284
00:17:36.160 --> 00:17:39.039
the last minutes of his life because his girlfriend filmed

285
00:17:39.039 --> 00:17:42.200
them on her phone. Sarah Boone and Jorge Torres had

286
00:17:42.240 --> 00:17:45.799
been together for years. On the night of February twenty third,

287
00:17:45.880 --> 00:17:49.680
twenty twenty, according to what Boone told investigators, they had

288
00:17:49.680 --> 00:17:53.240
been drinking and playing hide and seek. Torres hid in

289
00:17:53.240 --> 00:17:57.359
a suitcase. Boone zipped it shut. Two videos on her

290
00:17:57.400 --> 00:18:01.039
phone captured what happened next. Torres inside the bag in

291
00:18:01.119 --> 00:18:04.000
the dark, telling her he couldn't breathe begging to be

292
00:18:04.079 --> 00:18:07.039
let out, and Boone on the other side of the

293
00:18:07.119 --> 00:18:10.880
zipper laughing at him, taunting him. She told police she

294
00:18:10.920 --> 00:18:13.680
went upstairs to bed and fell asleep. She left him

295
00:18:13.680 --> 00:18:16.319
in there. In the morning, she called nine one one,

296
00:18:16.640 --> 00:18:19.559
and on that call she told the dispatcher he was purple.

297
00:18:20.400 --> 00:18:23.279
Prosecutors also said that when he pleaded to be released,

298
00:18:23.640 --> 00:18:26.160
she beat the suitcase with a baseball bat while he

299
00:18:26.240 --> 00:18:30.640
was inside it. Boone's defense at trial was battered spouse syndrome,

300
00:18:30.799 --> 00:18:32.880
and it was not an argument made out of thin air.

301
00:18:33.519 --> 00:18:37.200
Deputies testified about prior domestic calls to that apartment. The

302
00:18:37.279 --> 00:18:40.279
jury saw body camera footage from a twenty eighteen incident.

303
00:18:41.039 --> 00:18:44.480
A neighbor testified she had seen Boone with injuries. A

304
00:18:44.519 --> 00:18:48.240
psychologist testified Boone met the criteria for battered spouse syndrome

305
00:18:48.559 --> 00:18:52.720
along with anxiety and PTSD. I want to be precise

306
00:18:52.720 --> 00:18:56.720
about that, because domestic violence is real, and battered spouse

307
00:18:56.759 --> 00:18:59.599
syndrome is a legitimate doctrine that exists. Because the law

308
00:18:59.640 --> 00:19:02.480
spent of very long time refusing to understand why people

309
00:19:02.519 --> 00:19:06.480
don't just leave. The jury heard all of it, deliberated,

310
00:19:06.920 --> 00:19:10.400
and convicted her of second degree murder in October of

311
00:19:10.480 --> 00:19:15.279
twenty twenty four. Here's why, and it isn't complicated. Self

312
00:19:15.279 --> 00:19:18.440
defense is about immediacy. It's about a threat you are

313
00:19:18.440 --> 00:19:21.680
facing right now with no way out. The man in

314
00:19:21.720 --> 00:19:24.839
the suitcase was zipped inside a piece of luggage, unable

315
00:19:24.880 --> 00:19:29.599
to move, begging whatever came before in that moment. The

316
00:19:29.680 --> 00:19:33.160
only person in that apartment who was in danger was him,

317
00:19:33.279 --> 00:19:36.319
and the jury had the tape. That's not a mistake,

318
00:19:36.400 --> 00:19:39.440
that's a choice. She had hours. All she had to

319
00:19:39.440 --> 00:19:43.400
do was pull a zipper. Days before trial, prosecutors had

320
00:19:43.440 --> 00:19:47.559
offered her a deal plead to manslaughter fifteen years. She

321
00:19:47.680 --> 00:19:50.759
turned it down. She had already gone through nine attorneys

322
00:19:50.799 --> 00:19:53.799
before the trial even started. Enough of them with drawing

323
00:19:53.839 --> 00:19:56.480
over her conduct that a judge ruled she had forfeited

324
00:19:56.480 --> 00:20:00.720
her right to counsel. Her ninth lawyer, James Owens, volunteered

325
00:20:00.720 --> 00:20:03.000
to take the case after seeing an advertisement she had

326
00:20:03.039 --> 00:20:06.160
written from jail looking for a lawyer. She took the

327
00:20:06.160 --> 00:20:09.359
stand in her own defense. She demonstrated for the jury

328
00:20:09.400 --> 00:20:12.640
how she zipped the suitcase. She was asked whether she

329
00:20:12.680 --> 00:20:15.759
had done anything at all to help Jorge Torres get out.

330
00:20:16.079 --> 00:20:19.799
She said no. In December of twenty twenty four, she

331
00:20:19.920 --> 00:20:23.039
was sentenced to life without the possibility of parole. She

332
00:20:23.160 --> 00:20:25.720
told the court she hoped everyone could forgive her the

333
00:20:25.759 --> 00:20:29.079
Torres family most of all. Now here's where it gets strange.

334
00:20:29.519 --> 00:20:33.519
Since that sentencing, Sarah Boone has been through four more attorneys.

335
00:20:34.119 --> 00:20:37.440
Number ten was appointed right after sentencing and withdrew within

336
00:20:37.599 --> 00:20:41.839
days without explanation. Number eleven stopped doing a pellet work.

337
00:20:42.240 --> 00:20:45.680
Number twelve took a new job. In November of twenty

338
00:20:45.799 --> 00:20:51.079
twenty five, the court appointed David Maldonado thirteen, and Maldonado

339
00:20:51.119 --> 00:20:54.759
has now told her in writing that he has finished court.

340
00:20:54.799 --> 00:20:57.440
TV obtained a handwritten letter Boone sent to the court

341
00:20:57.519 --> 00:21:00.960
last month, dated July twenty second, she had been told

342
00:21:00.960 --> 00:21:03.279
by the appellate Court not to write to it directly,

343
00:21:03.599 --> 00:21:06.559
to go through her lawyer. Her letter says, in her

344
00:21:06.599 --> 00:21:10.039
own words that she has to ignore that instruction because

345
00:21:10.039 --> 00:21:13.200
she does not know who else to turn to. Attached

346
00:21:13.200 --> 00:21:15.359
to her letter is a print out of a message

347
00:21:15.359 --> 00:21:18.400
from Maldonado. In it, he tells her he does not

348
00:21:18.519 --> 00:21:21.559
have the time or resources to schedule another call about

349
00:21:21.599 --> 00:21:24.960
the brief, that the brief speaks for itself, and that

350
00:21:25.039 --> 00:21:28.359
he made the best arguments he could. He also tells

351
00:21:28.359 --> 00:21:30.839
her he will not file a reply brief no matter

352
00:21:30.880 --> 00:21:33.640
what the state says, and he will not request oral

353
00:21:33.759 --> 00:21:36.839
argument because he doesn't think it's necessary and appellate Court's

354
00:21:36.960 --> 00:21:40.599
rarely granted on matters like this. Boone's response in her

355
00:21:40.680 --> 00:21:43.599
letter is that her counsel decided in advance not to

356
00:21:43.680 --> 00:21:47.279
respond regardless of what the state filed. That, she writes,

357
00:21:47.480 --> 00:21:52.279
restricts any new argument and prejudices her appeal. So let's

358
00:21:52.319 --> 00:21:56.319
talk about who's right on the law. Maldonado is on

359
00:21:56.400 --> 00:22:00.160
solid ground. A reply brief is optional, oral argument and

360
00:22:00.200 --> 00:22:03.559
a routine criminal appeal is rarely granted in Florida and

361
00:22:03.680 --> 00:22:07.440
courts decide the overwhelming majority of these cases on the briefs.

362
00:22:08.160 --> 00:22:11.720
An appointed appellet attorney is not obligated to file every

363
00:22:11.759 --> 00:22:15.039
document a client demands, or to raise arguments he considers

364
00:22:15.079 --> 00:22:18.680
frivolous and court appointed a pellet council in this country,

365
00:22:18.839 --> 00:22:22.559
Carrie caseloads for compensation that would embarrass you if I

366
00:22:22.640 --> 00:22:25.880
said it out loud. Not having the time or resources

367
00:22:25.880 --> 00:22:27.920
on a case is a sentence born of a system

368
00:22:27.960 --> 00:22:32.640
that underfunds indigent defense to the point of collapse. And also,

369
00:22:33.319 --> 00:22:36.960
Sarah Boone is serving life without parole. She is thirteen

370
00:22:37.039 --> 00:22:40.759
lawyers deep. Her direct appeal, the one shot she gets

371
00:22:40.759 --> 00:22:43.720
at review as of right, has been pending since December

372
00:22:43.759 --> 00:22:47.599
of twenty twenty four. Court TV reported on August sixth

373
00:22:47.720 --> 00:22:50.359
that the initial brief her attorney referenced in a May

374
00:22:50.480 --> 00:22:53.319
letter had not appeared on the public docket at that point,

375
00:22:53.759 --> 00:22:56.599
Though other trial watchers have reported a brief was filed

376
00:22:56.599 --> 00:23:00.119
in the spring and that the state has responded, we

377
00:23:00.119 --> 00:23:03.680
could not independently confirm which is accurate. Read that again.

378
00:23:04.319 --> 00:23:07.240
It is August of twenty twenty six, and the public

379
00:23:07.279 --> 00:23:09.960
record on a life sentence is unclear enough that people

380
00:23:09.960 --> 00:23:12.680
who follow this case for a living disagree about whether

381
00:23:12.720 --> 00:23:16.240
the opening brief exists. Here's what I actually think about this.

382
00:23:16.880 --> 00:23:19.960
I have very little sympathy for Sarah Boone. I've watched

383
00:23:20.000 --> 00:23:22.480
a lot of defendants blow up their own cases, and

384
00:23:22.559 --> 00:23:26.279
she's near the top of the list. Nine attorneys before trial,

385
00:23:26.960 --> 00:23:30.079
a judge finding she'd forfeited her right to counsel through

386
00:23:30.119 --> 00:23:33.960
her own behavior, a fifteen year offer she rejected to

387
00:23:34.000 --> 00:23:37.400
go for broke and lost. She is not a victim

388
00:23:37.440 --> 00:23:40.839
of the process. She is, in large measure the author

389
00:23:40.920 --> 00:23:44.440
of her own predicament, and a court said so, none

390
00:23:44.519 --> 00:23:47.799
of that matters. Appellet review is not a reward for

391
00:23:47.839 --> 00:23:50.519
being a pleasant client. It is not a privilege that

392
00:23:50.599 --> 00:23:54.000
gets revoked when you become annoying. It is the mechanism

393
00:23:54.079 --> 00:23:57.160
by which we find out whether a trial was conducted properly.

394
00:23:57.799 --> 00:24:00.400
If we only bother to run that check onto fans

395
00:24:00.400 --> 00:24:03.839
who are polite, then we are not checking anything. We're

396
00:24:03.880 --> 00:24:08.000
grading personalities. And there is a real appellate issue buried

397
00:24:08.000 --> 00:24:10.799
in this case, whether or not Sarah Boone is capable

398
00:24:10.839 --> 00:24:14.720
of articulating it. Her trial expert on battered spouse syndrome

399
00:24:14.839 --> 00:24:17.400
was so hemmed in by objections that he could only

400
00:24:17.440 --> 00:24:20.640
speak in hypotheticals and was not permitted to address her

401
00:24:20.720 --> 00:24:25.279
case specifically. Whether that was correct is precisely the kind

402
00:24:25.279 --> 00:24:28.920
of question a direct appeal is built to answer. Instead,

403
00:24:28.960 --> 00:24:31.519
we have a woman writing Longhand letters from a prison

404
00:24:31.559 --> 00:24:33.799
to a court that told her to stop writing letters

405
00:24:34.200 --> 00:24:36.720
about a lawyer who told her to stop calling him

406
00:24:36.839 --> 00:24:41.160
regarding a brief nobody can locate. There's a playbook for this,

407
00:24:41.400 --> 00:24:46.119
and the playbook is exhaustion. You outlast the person. You

408
00:24:46.200 --> 00:24:48.759
wait until they run out of lawyers, or the deadlines

409
00:24:48.839 --> 00:24:52.400
run out on them, or they simply give up. Accountability

410
00:24:52.400 --> 00:24:56.400
doesn't have a legal department, but apparently the appeal doesn't either.

411
00:24:57.440 --> 00:25:01.039
Orge Torres Junior is still dead. Nothing that happens at

412
00:25:01.079 --> 00:25:04.200
Florida's District Court of Appeal brings him back. And if

413
00:25:04.200 --> 00:25:06.000
his family never has to hear his name in a

414
00:25:06.039 --> 00:25:09.440
courtroom again, I understand why they'd want that. But a

415
00:25:09.480 --> 00:25:13.079
conviction that never gets reviewed isn't a stronger conviction. It's

416
00:25:13.240 --> 00:25:20.119
just an older one. Do better. In two cases today

417
00:25:20.640 --> 00:25:23.720
in Plymouth, Week three of the Lindsey Clancy trial opened

418
00:25:23.759 --> 00:25:27.960
with Kevin Reddington cross examining doctor Jennifer Tuffs, the psychiatrist

419
00:25:28.000 --> 00:25:31.920
who treated Clancy across fourteen telemedicine appointments and saw her

420
00:25:31.960 --> 00:25:35.720
the day before Cora, Dawson and Callen were killed. Reddington

421
00:25:35.759 --> 00:25:39.359
went after her experience, her advertised specialty, the fact that

422
00:25:39.400 --> 00:25:42.359
she never met her patient in person, and a postpartum

423
00:25:42.400 --> 00:25:45.599
screening result showing severe depression that she testified she did

424
00:25:45.599 --> 00:25:48.599
not know about. Clancy is pleaded not guilty and is

425
00:25:48.599 --> 00:25:52.880
presumed innocent. That trial continues. In Florida, Sarah Boone is

426
00:25:52.920 --> 00:25:55.720
serving life without parole for the second degree murder of

427
00:25:55.759 --> 00:25:58.880
Jorge Torres Junior, who died in a zip suitcase while

428
00:25:58.880 --> 00:26:01.440
she filmed him. Her appeal is in the hands of

429
00:26:01.440 --> 00:26:04.000
her thirteenth attorney, who has told her in writing that

430
00:26:04.079 --> 00:26:07.039
he will not file a reply brief or seek oral argument.

431
00:26:07.559 --> 00:26:10.680
If today's episode was worth your time, send it to somebody,

432
00:26:10.920 --> 00:26:14.079
one person. That's how this show grows, and word of

433
00:26:14.119 --> 00:26:17.119
mouth beats an algorithm every time. And if you're listening

434
00:26:17.119 --> 00:26:20.960
on Spotify, drop a comment. Tell me what you think

435
00:26:21.000 --> 00:26:23.599
about the telemedicine question, because I don't know where the

436
00:26:23.640 --> 00:26:25.960
line is on that one, and I'd like to hear

437
00:26:26.000 --> 00:26:28.559
from the nurses and clinicians who listen to this show

438
00:26:29.000 --> 00:26:33.079
you know things I don't tomorrow more from Plymouth and

439
00:26:33.160 --> 00:26:36.960
whatever else the court's hand us. I'm Garrett Fisher. This

440
00:26:37.119 --> 00:26:42.400
is Daily Crime Injustice from Calaroga Shark Media Disclaimer. This

441
00:26:42.480 --> 00:26:46.599
program covers active criminal proceedings and is based on court testimony,

442
00:26:46.680 --> 00:26:49.920
court filings, and reporting available at the time of recording.

443
00:26:50.599 --> 00:26:53.640
Lindsey Clancy has pleaded not guilty to three counts of

444
00:26:53.680 --> 00:26:57.680
first degree murder and is presumed innocent. She has acknowledged

445
00:26:57.680 --> 00:27:01.480
causing her children's deaths and assert she was not criminally responsible.

446
00:27:02.319 --> 00:27:06.160
No jury has ruled. Testimony described here is public record

447
00:27:06.200 --> 00:27:10.799
and paraphrased. Cross examination of doctor Jennifer Tuffs was still

448
00:27:10.799 --> 00:27:12.960
in progress at the time of this recording and had

449
00:27:12.960 --> 00:27:17.160
not concluded. Details reported here reflect the morning session only.

450
00:27:17.759 --> 00:27:21.759
Outlets differ on callan Clancy's agent death, reported variously as

451
00:27:21.799 --> 00:27:25.880
seven months and eight months. Court TV's trial summary lists

452
00:27:25.880 --> 00:27:29.119
three counts of murder, while multiple other outlets specify first

453
00:27:29.160 --> 00:27:32.000
degree murder. Nothing said here should be taken as a

454
00:27:32.039 --> 00:27:35.920
finding about the quality of any physician's care. Doctor Tuffts

455
00:27:35.960 --> 00:27:39.119
and doctor Goodhart are named defendants, and civil malpractice suits

456
00:27:39.119 --> 00:27:43.000
that have not been tried, and both deny wrongdoing. In

457
00:27:43.039 --> 00:27:45.960
the Florida matter, Sarah Boone was convicted of second degree

458
00:27:46.039 --> 00:27:50.240
murder and sentenced to life without parole. Her appeal remains pending.

459
00:27:51.000 --> 00:27:54.519
Sources conflict on the current status of her initial appellate brief.

460
00:27:55.160 --> 00:27:58.319
Court TV reported on August sixth that the brief reference

461
00:27:58.359 --> 00:28:01.680
in her attorney's correspondence had not appeared on the public dockets,

462
00:28:02.119 --> 00:28:04.920
while other case watchers have reported the brief was filed

463
00:28:04.960 --> 00:28:07.680
in spring of twenty twenty six and that the state

464
00:28:07.720 --> 00:28:11.839
has responded. We could not independently verify which is correct.

465
00:28:12.640 --> 00:28:15.519
Sources also differ on which Florida District Court of Appeal

466
00:28:15.559 --> 00:28:19.319
has jurisdiction over the case. Reporting on the location of

467
00:28:19.319 --> 00:28:23.079
the apartment varies between Orlando and Winter Park, both within
