Christa Pike Unconscious and on a Ventilator, Her Lawyers Say the IVs Blew and the State Pushed a Second Dose, TJ Wiggins Faces Death

Christa Gail Pike is unconscious, intubated and breathing through a ventilator at a Nashville-area hospital five days after Tennessee failed to execute her, her attorneys said in a Friday emergency motion. Stephen Ferrell and Luke Ihnen of Federal Defender Services of East Tennessee wrote that the execution team used at least seven needles, that one bent, that Pike herself suggested an access site, and that no one on the team appeared to realize the IV lines were misplaced and the veins had blown before a second set of syringes was administered. The motion asks a judge to order the Department of Correction to preserve all evidence from that night. The state says it followed its approved protocol; no court has made any finding, and Gov. Bill Lee's third-party review is ongoing. Pike was sentenced to death in 1996 for the 1995 killing of 19-year-old Colleen Slemmer. Also: a Polk County jury is weighing whether to recommend death for Tony "TJ" Wiggins in the Frostproof killings of Damion Tillman, Brandon Rollins and Keven Springfield — Florida requires only eight of twelve votes. And jury selection begins in Boston in the federal trial of former Stoughton detective Matthew Farwell in the death of Sandra Birchmore, 23. Garret Fisher reports.

1
00:00:09.710 --> 00:00:13.189
Good morning. This is Daily Crime and Justice from Calaroga Media,

2
00:00:13.349 --> 00:00:19.050
powered by AI. I'm Garrett Fisher. It's Monday, October 5th, 2026.

3
00:00:19.050 --> 00:00:21.890
As of this recording, Krista Pike is alive. She's in

4
00:00:21.929 --> 00:00:25.550
a hospital in the Nashville area. She is unconscious. She

5
00:00:25.609 --> 00:00:29.489
is intubated and breathing through a ventilator. Her attorneys say

6
00:00:29.570 --> 00:00:32.560
she is critically ill, that she has significant injuries to

7
00:00:32.619 --> 00:00:35.020
both arms, and that staff are working to clear the

8
00:00:35.079 --> 00:00:38.340
lethal injection drug out of her body. That is where

9
00:00:38.420 --> 00:00:41.479
things stand five days after the state of Tennessee tried

10
00:00:41.500 --> 00:00:45.159
to execute her and could not. Her lawyers filed something

11
00:00:45.219 --> 00:00:47.920
on Friday that, for the first time, explains what they

12
00:00:47.960 --> 00:00:51.369
believe went wrong. And if they are right, it is

13
00:00:51.450 --> 00:00:55.750
worse than a drug that did not work. In Polk County, Florida,

14
00:00:55.990 --> 00:00:58.509
a jury is deciding whether Tony Wiggins should be put

15
00:00:58.549 --> 00:01:01.060
to death for murdering three men on a fishing trip.

16
00:01:01.859 --> 00:01:04.680
And in Boston this week, a jury will be chosen

17
00:01:04.760 --> 00:01:08.299
for the federal trial of a former police detective charged

18
00:01:08.359 --> 00:01:11.700
with killing a 23-year-old woman he had known since she

19
00:01:11.739 --> 00:01:20.049
was 12. Let's get into it. Colleen Slemmer was 19

20
00:01:20.049 --> 00:01:22.790
years old when Krista Pike murdered her in Knoxville in

21
00:01:22.870 --> 00:01:27.989
January of 1995. Pike was sentenced to death in 1996

22
00:01:27.989 --> 00:01:30.579
and has been on death row for 30 years. On

23
00:01:30.609 --> 00:01:33.079
Wednesday night, the state tried to carry that sentence out.

24
00:01:33.480 --> 00:01:37.299
Two doses of pentobarbital, more than two hours, and an ambulance.

25
00:01:38.299 --> 00:01:41.650
On Friday, her attorneys, Stephen Farrell and Luke Enin, filed

26
00:01:41.689 --> 00:01:44.859
an emergency motion in Davidson County Chancery Court. And it

27
00:01:44.900 --> 00:01:47.599
contains the first real account of the mechanics. Here is

28
00:01:47.640 --> 00:01:50.959
what they wrote. That apparently at no point did any

29
00:01:51.019 --> 00:01:54.200
member of the execution team realize that the IV lines

30
00:01:54.260 --> 00:01:57.959
were not correctly placed or that the veins had blown

31
00:01:58.400 --> 00:02:01.219
and that the pentobarbital was, in whole or in part,

32
00:02:01.579 --> 00:02:05.400
not entering her body. And that instead of remedying that failure,

33
00:02:05.620 --> 00:02:08.680
the team prepared and administered the backup set of syringes.

34
00:02:09.300 --> 00:02:13.300
Sit with that sequence because it changes the story. The problem,

35
00:02:13.360 --> 00:02:15.960
according to her lawyers, was not that the drug failed.

36
00:02:16.520 --> 00:02:18.479
It is that the drug never fully got where it

37
00:02:18.520 --> 00:02:21.439
was supposed to go. A blown vein means the line

38
00:02:21.460 --> 00:02:24.580
has ruptured and the fluid is going into surrounding tissue

39
00:02:24.740 --> 00:02:27.919
instead of into the bloodstream. It is painful. It is

40
00:02:28.080 --> 00:02:30.879
also visible to anyone trained to look for it. Which

41
00:02:30.939 --> 00:02:33.539
is why her team says she has significant injuries to

42
00:02:33.599 --> 00:02:37.250
both arms. And then, on their account, the response to

43
00:02:37.310 --> 00:02:39.810
a failed line was not to establish a new one.

44
00:02:40.400 --> 00:02:43.039
It was to push a second dose through the same

45
00:02:43.120 --> 00:02:47.159
failed access. NBC News has also reported that there was

46
00:02:47.259 --> 00:02:50.830
no emergency medical oxygen in that execution chamber in case

47
00:02:50.870 --> 00:02:54.370
something went wrong. Now, I want to be scrupulous here.

48
00:02:54.689 --> 00:02:58.469
This is a filing by the defense. It is their characterization.

49
00:02:59.289 --> 00:03:02.139
Tennessee has said it followed every step of its lawful,

50
00:03:02.259 --> 00:03:06.639
established protocol, approved by the Attorney General's office. No court

51
00:03:06.740 --> 00:03:09.400
and no regulator has made any finding about what happened.

52
00:03:09.979 --> 00:03:12.900
the governor has ordered a third-party review, and that review

53
00:03:12.960 --> 00:03:16.979
has not started producing anything. So treat the mechanics as

54
00:03:17.039 --> 00:03:21.550
the defense's account until somebody independent confirms it. But notice

55
00:03:21.590 --> 00:03:24.669
what the filing is actually asking for, because it tells

56
00:03:24.710 --> 00:03:27.490
you what Pike's lawyers are worried about. They are not

57
00:03:27.590 --> 00:03:30.629
asking for damages. They are asking a judge to order

58
00:03:30.669 --> 00:03:33.770
the Department of Correction to preserve all relevant evidence from

59
00:03:33.810 --> 00:03:38.539
that night. The syringes, the lines, the logs, the records.

60
00:03:39.379 --> 00:03:42.719
Her attorney said preserving that evidence is essential to understanding

61
00:03:42.740 --> 00:03:46.900
what happened, to ensuring accountability, and to protecting her legal rights.

62
00:03:47.620 --> 00:03:49.939
That is a legal team that does not trust the

63
00:03:49.960 --> 00:03:52.759
state to keep the record of its own failure. And

64
00:03:52.819 --> 00:03:56.469
given that Tennessee paused executions for three years after an

65
00:03:56.530 --> 00:04:00.310
investigation found officials had not properly tested their drugs, I

66
00:04:00.469 --> 00:04:04.469
understand the instinct. Randy Spivey, an attorney with the Tennessee

67
00:04:04.569 --> 00:04:08.129
Office of the Post-Conviction Defender, told reporters he has witnessed

68
00:04:08.189 --> 00:04:12.189
five executions in that state and that Tennessee has shown, again,

69
00:04:12.389 --> 00:04:15.360
it is not capable of carrying one out consistent with

70
00:04:15.439 --> 00:04:19.060
basic human dignity. He has said the governor's review does

71
00:04:19.220 --> 00:04:22.019
not go far enough. And here is the question that

72
00:04:22.160 --> 00:04:25.579
nobody in American law has a clean answer to. Krista

73
00:04:25.620 --> 00:04:28.670
Pike is being kept alive by a machine, by doctors,

74
00:04:28.930 --> 00:04:31.709
at state expense, after the state tried to kill her.

75
00:04:32.490 --> 00:04:36.170
If she recovers, Tennessee's position is presumably that she still

76
00:04:36.209 --> 00:04:39.430
has a death sentence to serve. Her lawyers will argue

77
00:04:39.449 --> 00:04:42.899
that attempting it twice is a different constitutional question entirely.

78
00:04:43.639 --> 00:04:47.540
There is almost no precedent for this. The closest analog

79
00:04:47.660 --> 00:04:51.019
is a Louisiana case from the 1940s, when a teenager

80
00:04:51.060 --> 00:04:54.170
survived a botched electrocution and the Supreme Court permitted a

81
00:04:54.199 --> 00:04:57.769
second attempt. That decision is nearly 80 years old and

82
00:04:57.810 --> 00:05:00.709
the law around cruel and unusual punishment has moved a

83
00:05:00.750 --> 00:05:04.490
great deal since. This is going to be litigated for years,

84
00:05:04.769 --> 00:05:07.449
and it will be litigated regardless of whether Krista Pike

85
00:05:07.600 --> 00:05:11.959
ever wakes up. Colleen Slemmer was 19. Her mother, May Martinez,

86
00:05:12.019 --> 00:05:15.019
waited 30 years, traveled to that prison, and went home

87
00:05:15.060 --> 00:05:19.579
with nothing settled. Someone has to say her name. When

88
00:05:19.620 --> 00:05:22.610
we come back, a Florida jury decides whether a man

89
00:05:22.689 --> 00:05:25.410
is executed, and it does not have to be unanimous.

90
00:05:37.839 --> 00:05:42.480
Damian Tillman was 23. Kevin Springfield was 30. Brandon Rollins

91
00:05:42.519 --> 00:05:45.779
was 28. They were ambushed and shot near Lake Streetie

92
00:05:45.800 --> 00:05:49.439
in Frost Proof, Florida on the night of July 17, 2020,

93
00:05:49.439 --> 00:05:52.319
as they met up to go night fishing. A week

94
00:05:52.370 --> 00:05:55.529
ago Tuesday, a Polk County jury took under four hours

95
00:05:55.589 --> 00:05:59.769
to convict Tony Lee Wiggins Jr. on all counts. On Thursday,

96
00:05:59.990 --> 00:06:02.529
the same jury began hearing whether he should be executed.

97
00:06:03.220 --> 00:06:05.899
And there is one thing about Florida law that everybody

98
00:06:05.939 --> 00:06:10.160
listening should understand, because it is unusual and it is consequential.

99
00:06:10.759 --> 00:06:13.500
A death recommendation in Florida does not have to be unanimous.

100
00:06:13.839 --> 00:06:19.290
It requires 8 of 12 jurors. Florida changed that in 2023. Before,

101
00:06:19.529 --> 00:06:22.970
it required a unanimous jury. Now, a defendant can be

102
00:06:23.029 --> 00:06:26.430
sentenced to death with 4 jurors objecting. So the 12

103
00:06:26.430 --> 00:06:29.490
people in Bartow are not being asked to agree. They

104
00:06:29.529 --> 00:06:32.829
are being asked to count. Here is what they have heard.

105
00:06:33.529 --> 00:06:37.709
The prosecution's lead aggravating factor is the simplest and heaviest

106
00:06:37.850 --> 00:06:42.870
one available. Three men died. Three separate murders in one night.

107
00:06:43.649 --> 00:06:48.600
Then the family spoke. Ariel Bustos, Brandon Rollins' niece, told

108
00:06:48.620 --> 00:06:50.779
the jury that Brandon missed a lot of milestones in

109
00:06:50.819 --> 00:06:54.959
her life. Her 15th birthday, her graduation, the day she

110
00:06:55.000 --> 00:06:58.759
got her driver's license. That is what victim impact testimony

111
00:06:58.920 --> 00:07:03.069
actually is, not an argument. a list of things that

112
00:07:03.110 --> 00:07:06.509
did not happen. The defense case is mitigation, and it

113
00:07:06.569 --> 00:07:09.750
is the standard shape, which does not make it less real.

114
00:07:10.529 --> 00:07:13.689
They called psychologists who evaluated Wiggins in the years after

115
00:07:13.730 --> 00:07:17.750
the killings. Dr. Scott Mackless testified about what he described

116
00:07:17.800 --> 00:07:21.199
as a traumatic childhood, saying these were things Wiggins went

117
00:07:21.220 --> 00:07:25.079
through and suffered. They testified he struggled in school, was

118
00:07:25.139 --> 00:07:30.019
diagnosed with ADHD, and needed special education classes. They raised

119
00:07:30.079 --> 00:07:34.550
brain development. Their ask is life without the possibility of parole.

120
00:07:35.189 --> 00:07:36.889
And I want to make a point here that connects

121
00:07:37.069 --> 00:07:39.990
all three weeks of this. We have now covered four

122
00:07:40.069 --> 00:07:44.449
capital sentencing proceedings. Vicki Lynn Williams in Lake County, whose

123
00:07:44.490 --> 00:07:48.060
schizophrenia was presented to a jury and who was spared.

124
00:07:48.819 --> 00:07:52.579
Tomasz Kosowski in Pinellas County, who refused to present any

125
00:07:52.620 --> 00:07:55.399
mitigation at all and whose life is in the hands

126
00:07:55.439 --> 00:07:59.079
of one judge this month. Krista Pike in Tennessee, whose

127
00:07:59.139 --> 00:08:02.000
lawyers have spent 30 years arguing that her childhood abuse

128
00:08:02.060 --> 00:08:04.959
was never properly heard, and who is on a ventilator

129
00:08:05.000 --> 00:08:08.319
this morning. And now Tony Wiggins, whose defense is doing

130
00:08:08.500 --> 00:08:11.620
exactly what the system invites them to do, put a

131
00:08:11.670 --> 00:08:13.790
whole life in front of 12 people and ask them

132
00:08:13.829 --> 00:08:16.870
to weigh it against three deaths. Every one of those

133
00:08:16.949 --> 00:08:20.029
is the same procedure. The results have nothing in common.

134
00:08:20.430 --> 00:08:23.850
Brandon Rollins' mother, Dottie Payton, said after the verdict that

135
00:08:23.889 --> 00:08:27.000
they waited six years for it. The families have said

136
00:08:27.040 --> 00:08:30.199
they wanted the death penalty from the start. The judge

137
00:08:30.240 --> 00:08:33.779
is not bound by the jury's recommendation, but in practice,

138
00:08:33.940 --> 00:08:39.269
it carries enormous weight. Damian Tillman was 23. Kevin Springfield

139
00:08:39.309 --> 00:08:42.990
was 30. Brandon Rollins was 28. Someone has to say

140
00:08:43.009 --> 00:08:47.549
their names. When we come back, the medical examiner called

141
00:08:47.590 --> 00:09:01.600
it suicide, then took it back. Sandra Birchmore was 23

142
00:09:01.600 --> 00:09:04.490
years old. She was pregnant with a son. She was

143
00:09:04.539 --> 00:09:07.950
found dead in her apartment in Canton, Massachusetts in February

144
00:09:08.070 --> 00:09:12.690
of 2021. This week, jury selection begins in federal court

145
00:09:12.730 --> 00:09:15.990
in Boston in the trial of Matthew Farwell, a former

146
00:09:16.029 --> 00:09:19.019
Stoughton police detective who is charged with killing her and

147
00:09:19.059 --> 00:09:21.940
with causing the death of her unborn child. He is

148
00:09:21.980 --> 00:09:25.820
pleaded not guilty and he is presumed innocent. If convicted,

149
00:09:26.179 --> 00:09:29.809
he faces life in prison. We previewed this case Thursday

150
00:09:30.009 --> 00:09:32.450
when his attorneys were asking to move the trial out

151
00:09:32.470 --> 00:09:37.309
of Massachusetts entirely because of pretrial publicity. That motion was

152
00:09:37.350 --> 00:09:40.990
his second attempt. Jury selection is going forward in Boston.

153
00:09:41.289 --> 00:09:42.970
Here is the part of this case I did not

154
00:09:43.009 --> 00:09:46.149
have last week, and it is the center of everything.

155
00:09:46.870 --> 00:09:49.990
In May of 2021, the state medical examiner ruled that

156
00:09:50.049 --> 00:09:53.529
Sandra Birchmore died by suicide. In April of this year,

157
00:09:53.610 --> 00:09:56.690
the medical examiner withdrew that opinion and listed her manner

158
00:09:56.769 --> 00:10:00.700
of death as undetermined. Understand what that means for a trial.

159
00:10:01.320 --> 00:10:04.299
The government is prosecuting a homicide in a case where

160
00:10:04.340 --> 00:10:10.929
the official cause of death is formally unknown, not homicide, undetermined.

161
00:10:11.590 --> 00:10:13.909
That is an enormous thing for a defense attorney to

162
00:10:13.970 --> 00:10:16.750
stand up and say to a jury, and Farwell's lawyers

163
00:10:16.789 --> 00:10:20.200
will say it. Their position has been consistent since the

164
00:10:20.259 --> 00:10:24.500
charges were filed. They say Sandra Birchmore took her own life.

165
00:10:24.919 --> 00:10:27.799
They point to the original ruling. They point to what

166
00:10:27.840 --> 00:10:31.240
they describe as a history of suicide attempts and self-harm.

167
00:10:31.740 --> 00:10:35.320
And they point out that DNA testing excluded Farwell as

168
00:10:35.360 --> 00:10:38.690
the father of her child. The government's case is that

169
00:10:38.769 --> 00:10:41.909
Farwell met Birchmore through a police explorer's program when she

170
00:10:41.950 --> 00:10:45.269
was a child. that he sexually abused her for years,

171
00:10:45.690 --> 00:10:48.250
and that he killed her and staged the scene to

172
00:10:48.389 --> 00:10:51.350
look like a suicide to prevent her from disclosing it.

173
00:10:51.850 --> 00:10:55.429
The charge is killing a witness. So this trial is

174
00:10:55.470 --> 00:10:58.330
going to be about several things at once, whether she

175
00:10:58.389 --> 00:11:01.389
was killed or died by her own hand, whether a

176
00:11:01.409 --> 00:11:04.450
police department properly investigated the death of a young woman

177
00:11:04.509 --> 00:11:07.429
connected to one of its own officers, and what was

178
00:11:07.470 --> 00:11:11.240
done to a girl who joined a youth program at 12.

179
00:11:11.240 --> 00:11:15.700
Farwell resigned from the Stoughton Police Department in 2022. Prosecutors

180
00:11:15.740 --> 00:11:18.700
announced last December they will not seek the death penalty.

181
00:11:19.259 --> 00:11:21.220
And I want to say something about why this trial

182
00:11:21.259 --> 00:11:25.149
matters beyond the verdict. A medical examiner ruled this a

183
00:11:25.250 --> 00:11:30.610
suicide in 2021. That ruling stood for years. It was

184
00:11:30.649 --> 00:11:34.610
withdrawn only this past April, after federal investigators had already

185
00:11:34.669 --> 00:11:38.100
charged a man with murder. Whatever a jury concludes about

186
00:11:38.139 --> 00:11:42.259
Matthew Farwell, that sequence should bother everybody. because the number

187
00:11:42.299 --> 00:11:46.399
of deaths in this country initially classified as suicides, involving

188
00:11:46.450 --> 00:11:49.669
young women with a documented connection to someone in law enforcement,

189
00:11:50.110 --> 00:11:53.169
is not zero. And a manner of death ruling is

190
00:11:53.210 --> 00:11:56.990
the thing that decides whether anyone ever looks again. Sandra

191
00:11:57.009 --> 00:12:01.220
Birchmore was 23 and pregnant. She joined that program when

192
00:12:01.259 --> 00:12:04.379
she was 12. Someone has to say her name, and

193
00:12:04.419 --> 00:12:06.679
it is going to be a long trial in which

194
00:12:06.840 --> 00:12:09.240
most of the oxygen goes to the man accused of

195
00:12:09.320 --> 00:12:14.539
killing her. That's the show for Monday, October 5th. If

201
00:12:33.279 --> 00:12:35.740
A jury there can recommend a death sentence with 8

202
00:12:35.740 --> 00:12:38.740
votes out of 12. Four people can think the state

203
00:12:38.779 --> 00:12:42.159
should not kill somebody. And it happens anyway. Should that

204
00:12:42.200 --> 00:12:45.480
decision require everyone? We stay on Tennessee this week. The

205
00:12:45.500 --> 00:12:48.279
Polk County jury could return a recommendation at any time,

206
00:12:48.679 --> 00:12:51.460
and testimony in Boston begins once a jury is seated.

207
00:12:52.100 --> 00:12:58.049
I'm Garrett Fisher. Do better. A few notes on sourcing.

208
00:12:58.549 --> 00:13:02.110
On the Tennessee case. This episode was recorded before the

209
00:13:02.149 --> 00:13:05.269
start of the week, and Krista Pike's condition was as

210
00:13:05.330 --> 00:13:09.159
described in her attorney's Friday court filing. Her condition may

211
00:13:09.179 --> 00:13:12.149
have changed, The account of what went wrong during the

212
00:13:12.250 --> 00:13:16.450
execution attempt comes entirely from that defense filing and has

213
00:13:16.529 --> 00:13:19.850
not been confirmed by the state or established by any court.

214
00:13:20.610 --> 00:13:24.590
Tennessee has said it followed its approved protocol. The governor's

215
00:13:24.629 --> 00:13:29.029
third-party review is ongoing and has not issued findings. On

216
00:13:29.080 --> 00:13:32.120
the Polk County case, Tony Wiggins has been convicted and

217
00:13:32.169 --> 00:13:36.480
the penalty phase is underway. A jury recommendation is not

218
00:13:36.539 --> 00:13:40.960
a sentence. The judge imposes it. Under current Florida law,

219
00:13:41.179 --> 00:13:45.139
a recommendation of death requires at least 8 of 12 jurors.

220
00:13:45.950 --> 00:13:48.950
On the federal case in Boston, Matthew Farwell has pleaded

221
00:13:49.070 --> 00:13:52.809
not guilty and is presumed innocent, and the allegations described

222
00:13:52.929 --> 00:13:56.340
are the government's and have not been proven. His defense

223
00:13:56.379 --> 00:14:00.679
maintains Sandra Birchmore died by suicide. The state medical examiner

224
00:14:00.779 --> 00:14:03.539
initially ruled her death a suicide and in April of

225
00:14:03.580 --> 00:14:06.879
this year withdrew that opinion, listing the manner of death

226
00:14:07.059 --> 00:14:11.730
as undetermined. DNA testing excluded Farwell as the father of

227
00:14:11.789 --> 00:14:15.389
her child. Reporting has varied on the exact start date

228
00:14:15.429 --> 00:14:20.000
of jury selection. This episode discusses the death penalty, suicide,

229
00:14:20.129 --> 00:14:23.879
child sexual abuse, and homicide. If you are struggling, you
